C-22-20-035-3-03 Amendment No. 3 AMENDMENT NO. 3 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND CITY OF CHANDLER Maricopa County (“County”) administered by its Human Services Department, entered into a non-financial Intergovernmental Agreement (“Agreement”) with the City of Chandler (“City”), which was fully executed on or about July 13, 2020. The County and the City collectively are referred to here as the “Parties.” The purpose of the Agreement is for the Parties to work cooperatively to assist individuals experiencing homelessness. The original term of the Agreement was from April 27, 2020, through July 26, 2020. The Parties fully executed Amendment No. 1 on or about September 2, 2020. Amendment No. 1 revised the Agreement from non-financial to financial in nature and added that the County shall provide the City with a not-to-exceed amount of $79,580 to procure hotel space as temporary housing to prevent exposure to the COVID-19 health pandemic for individuals experiencing homelessness and be responsible for the procurement and management of security services. Amendment No. 1 extended the term of the Agreement from July 26, 2020, through September 30, 2020 (i.e., two, one-month terms). The Parties fully executed Amendment No. 2 on or about October 27, 2020. Amendment No. 2 extended the term of the Agreement from September 30, 2020 through December 30, 2020, (i.e., three, one-month terms). And the County provided additional funding in the amount of $79,580 under the Catalog of Federal Domestic Assistance (CFDA) 21.019 Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136. The Parties now agree to amend the Agreement by this Amendment No. 3 as follows: A. Revise Section 3.1 to read as follows: 3.1 This Agreement may be extended for eight additional one-month terms. Extensions must be in writing and approved and signed by both Parties. Written notice of intent to extend this Agreement shall be sent to the City fifteen calendar days prior to the end of the original or extended Agreement term, as applicable. B. Extend the term of the Agreement for three additional one-month terms: from December 31, 2020, through January 31, 2021; from February 1, 2021, through February 28, 2021; and from March 1, 2021, through March 31, 2021. Cc. Add that the County shall provide the City with an additional $ 79,580 in funding in return for the services provided under this Agreement. The total available funding now increased from $159,160 to a not-to-exceed amount of $238,740. The funding for this Amendment No. 3 is provided by Catalog of Federal Domestic Assistance (CFDA) 21.019 Coronavirus Aid, Relief, and Economic Security Act (CARES Act), C-22-20-035-3-03 Public Law 116-136. Amendment No. 3 D. The City shall submit monthly invoices no later than the 10th calendar day of each month. E. The City shall submit a final invoice for expenditures under Amendment No. 3 not later than April 15, 2021. F. The City shall submit invoices and supporting documents to: HSDFinance@Maricopa.gov ll. The Agreement is amended to incorporate the changes contained in this Amendment No. 3. All other terms and conditions of the Agreement, Amendment No. 1, and Amendment No. 2 shall remain unchanged and in full force and effect as executed by the Parties. IV. The Parties have authorized the undersigned to execute this Amendment No. 3, and it shall be effective upon approval and signature by both Parties.
