RESOLUTION NO. 5486

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER,
ARIZONA, APPROVING AN AMENDED AND RESTATED WATER
TRANSPORTATION AGREEMENT BETWEEN SALT RIVER VALLEY
WATER USERS’ ASSOCIATION AND THE CITY OF CHANDLER.

WHEREAS, the Salt River Valley Water Users’ Association (the “Association”) is the agent of
the Salt River Project Agricultural Improvement and Power District, a political subdivision of the
State of Arizona, in distributing water developed pursuant to the Salt River Project, a federal
reclamation project, to Association shareholders; and

WHEREAS, City delivers water to its customers from a variety of sources; and

WHEREAS, Association limits the use of its water delivery system to the transportation and
delivery of water to its shareholders and to those entities with specific entitlements to such service;
and

WHEREAS, on September 10, 1991, City and the Association entered into a Water Transportation
Agreement which allowed for the transportation of City water in Association canals; and

WHEREAS, City and the Association have agreed to amend the Water Transportation Agreement
to authorize the transportation of City water in Association canals, laterals, and drain ditches, and
to revise other terms of service between City and the Association related to such expanded service.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chandler, Arizona,
as follows:

Section 1. Approving the terms and conditions of the Amended and Restated Water
Transportation Agreement between Salt River Valley Water Users’ Association
and the City of Chandler attached as Exhibit “A” to this Resolution and
incorporated herein by reference.

Section 2. Authorizing the Mayor of the City of Chandler to execute the Amended and
Restated Water Transportation Agreement on behalf of the City of Chandler.

PASSED AND ADOPTED by the City Council of the City of Chandler, Arizona, this 26th day of
August, 2021.
