RESOLUTION NO.  5538 
 
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, 
MARICOPA COUNTY, ARIZONA, APPROVING AND AUTHORIZING THE 
MAYOR TO ENTER INTO A JOINT PROJECT AGREEMENT BETWEEN THE 
CITY OF CHANDLER AND THE STATE OF ARIZONA TO PROVIDE 
AMERICAN RESCUE PLAN ACT FUNDING FOR THE PURPOSE OF 
RESTORING THE WATERMAIN PIPE NEAR THE LOOP 101 AND 202 
FREEWAYS; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO 
SIGN DOCUMENTS AND TAKE OTHER ACTIONS NECESSARY ON BEHALF 
OF THE CITY OF CHANDLER TO CARRY OUT THE INTENT OF THE 
AGREEMENT. 
 
WHEREAS, the State, acting by and through, its Department of Administration (the “State” or 
“ADOA”) has received State and Local Fiscal Recovery Funds (SLFRF) from the American 
Rescue Plan (ARP) ACT funding in the amount of $8,000,000.00, which has been dedicated to 
restoring the compromised Chandler Watermain Pipe near the Loop 101 and 202 Freeway  
Interchange; and  
 
WHEREAS, Arizona Revised Statutes, Section 11-951, et. seq., provides that public agencies may 
enter into intergovernmental agreements for the provision of services, or for joint or cooperative 
action; and 
 
WHEREAS, the City of Chandler and the State seek to enter into this Joint Project Agreement 
dedicated to the Loop 101 and 202 Freeway Waterline and Sewer Rehabilitation (“Project”).  
 
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Chandler as follows: 
 
Section 1. 
Approves the Joint Project Agreement between the City of Chandler and the State 
of Arizona for the purpose of restoring the Watermain Pipe near the Loop 101 and 
202 Freeway Interchange, and authorizes the Mayor to sign the agreement in the 
form attached hereto and incorporated herein by reference. 
 
Section 2. 
The City Manager, or designee, is hereby authorized and directed to execute, any 
documents and to take such other actions as are necessary on behalf of the City to 
carry out the intent of this Resolution. 
 
PASSED AND ADOPTED by the Mayor and Council of the City of Chandler, Arizona, this 9th 
day of December, 2021.
