This JOB ORDER PROJECT AGREEMENT ("Job Order”) is made this day of 2021
(“Effective Date”), by and between the City of Chandler, an Arizona municipal corporation, (“City”)
and FCI Constructors, Inc., a Colorado corporation, (“JOC Contractor”) and is entered into
pursuant to Job Order Master Agreement No. JOC1911.401 (‘JOC Master Agreement”). City and
JOC Contractor may be referred to individually as “Party” or collectively as “Parties”).
City and JOC Contractor, in consideration of the mutual covenants herein set forth, agree as
follows:
RECITALS
A. On or about January 23, 2020, the Parties entered into the JOC Master Agreement, which terms
and conditions are made a part of and incorporated into this Job Order Project Agreement by this
reference.
B. City proposes to engage JOC Contractor to install a new air conditioner in the 911 Training
Room at the Property and Evidence building located on the northeast corner of Hartford
and Pecos Road as more fully described in Exhibit "A", which is attached to and made a part of
this Job Order by this reference.
C. JOC Contractor is ready, willing, and able to provide the services described in Exhibit “A” for
the compensation and fees set forth and as described in Exhibit “B”, which is attached to and
made a part of this Agreement by this reference.

ARTICLE 1. DESCRIPTION OF WORK
The Parties enter into this Job Order Project Agreement for the POLICE DEPARTMENT AIR
CONDITIONER PROPERTY AND EVIDENCE 911 TRAINING ROOM, Project Number BF2108.402.
The scope of work consists of installing a new air conditioner in the 911 Training Room at the Property
and Evidence building located on the northeast corner of Hartford and Pecos Road., all as more
particularly set forth in Exhibit “A” attached hereto and incorporated herein by reference.
The JOC Contractor will not accept any change of scope, or change in contract provisions, unless
issued in writing, as a contract amendment or change order and signed by the authorized
signatories for each party.
Performance and Payment Bonds, as set forth in Exhibit “C” and Exhibit “D” respectively attached
hereto and incorporated herein by reference, will be due prior to execution of each Job Order
Project Agreement in the full amount of each Job Order.
At project completion, JOC Contractor must complete Contractor's Affidavit Regarding Settlement
of Claims and Certificate of Completion, as set forth in Exhibit “E” and Exhibit “F” respectively
attached hereto and incorporated herein by reference.
ARTICLE 2. PROJECT PRICE
City will pay JOC Contractor for completion of the Work in accordance with the JOC Master
Agreement a fee not to exceed the Guaranteed Maximum Price of $76,639.10 Dollars determined
and payable as set forth in JOC Master Agreement and Exhibit “B” attached hereto and made a
part hereof by reference.
ARTICLE 3. CONTRACT TIME & SCHEDULE
JOC Contractor agrees to complete all Construction within 75 calendar days from the Notice to
Proceed (NTP) Date.

FCI Constructors, Inc. is pleased to present its proposal for the Police Department Air
Conditioner Property & Evidence 911 Training Room project.
This proposal includes demoing the existing heat pump and installation of a new mini-
split and a new split heat pump.
The pricing in this proposal includes sales taxes, insurance, general conditions and
associated constructions cost and fees. Please reference the attached schedule of values
for a budget breakdown for this project.

Scope of Work
Design and Permitting:
1. Not Part of this Scope
Construction:
Demo and make safe existing heat pump for removal.
Demo existing heat pump including refrigerant lines and electrical.
Furnish and install new Trane 4 Ton split heat pump.
Furnish and install new Mitsubishi 2.5 Ton ductless split system.
Furnish and install necessary electrical conduit and wire for two new units.
Remove portion of existing Acoustical ceiling for access above ceiling for HVAC
work.
Re-use existing metal HVAC stand inside existing data closet for new heat pump. It
is assumed new unit will fit on stand without any modifications. If additional
alterations are required there will be a change in cost.
8. Furnish and install new HVAC distribution, diffusers, and refrigerant piping per the
construction documents.
9. Provide a man lift to access roof from exterior of the building.
10. Crane is included to hoist new equipment and removal of existing equipment.
11. Furnish and install motorized control damper per sheet M2.1 Note 8.
12.3 party HVAC test and balance is included.
13. The Trane and Mitsubishi units are currently experiencing a lead time of 14-16
weeks which would put the start date in Mid-March.
14.A $7,000 Owners Allowance is included in the proposal.

Value Engineering:
1. Tempe Mechanical reached out to local suppliers and found similar Daikin HVAC
units that can be acquired in 3-4 weeks. There is no cost increase or decrease to
switch to these units. Switching to Daikin would allow us to start the project on
1/3/22 in lieu of mid-March of 2022.

1. The sequencing of the project is intended for consecutive workdays Monday through
Friday during daytime shifts.

Condensate piping to be ran in type M copper.
Refrigerant piping to be ran in ACR type L copper with 1” insulation on suction line,
Aluminum Jacket on exterior piping.
Hoisting and setting of HVAC equipment and materials as listed above.

We include a one (1) year warranty which will begin from date of final acceptance on
equipment and labor.
This proposal is based on non-union labor and work being performed during normal
working hours.
We will be allowed to provide input to the mechanical section of the project schedule.
We will be furnished enough plans and specifications to distribute to all our subcontractors
and for our own use at no cost.
Add 2% for payment and performances bond.
Upon award of contract, we reserve the right to negotiate terms and conditions of said
contract.
Per the new 2015 State Tax laws this proposal will require the prime contractor to
have a TPT license and Tempe mechanical must receive a form 5005 prior to contract
award.

Any and all roof curbs in a standing seam roof.
Structural calculations and work for mechanical equipment on roof.
Structural beam penetrations as may be required for installing mechanical work.
