ORDINANCE NO. 5020 
 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, 
ARIZONA, AMENDING THE CODE OF THE CITY OF CHANDLER, 
CHAPTER 6 EMERGENCY MANAGEMENT, SECTION 6-3 POWERS AND 
DUTIES, SUBSECTION 6-3.2 RELATING TO THE MAYOR’S AUTHORITY 
TO DECLARE AN EMERGENCY; PROVIDING FOR THE REPEAL OF 
CONFLICTING ORDINANCES; AND PROVIDING FOR SEVERABILITY. 
 
WHEREAS, the Mayor of Chandler has the authority to proclaim an emergency pursuant to the 
Arizona Revised Statutes (“A.R.S.”), Title 26, Chapter 2, and Chapter 6 of the Chandler City Code; 
and 
 
WHEREAS, the Mayor and Council have determined that transparency when the City is operating 
under an emergency is in the best interests of the citizens of Chandler. 
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, 
as follows: 
 
Section 1. 
That the Chandler City Code, Chapter 6 Emergency Management, Section 6-3 
Powers and duties, Subsection 6-3.2, is hereby amended to read as follows 
(additions in ALL CAPS, deletions in strikeout): 
 
6-3. - Powers and duties. 
 
6-3.1. The City Council shall have all the powers and authority as set forth in 
A.R.S. Title 26, Chapter 2. 
 
6-3.2. In addition to the powers granted by other provisions of the law or City 
Charter, in accordance with A.R.S. Title 26, Chapter 2, the Mayor is hereby 
authorized to declare, by proclamation, an emergency or a local emergency to 
exist and shall have the powers and authority established in that chapter.  The 
proclamation may be rescinded by a majority of the City Council after twenty-
four (24) hours. THE PROCLAMATION WILL EXPIRE WITHOUT 
FURTHER ACTION NINETY (90) DAYS AFTER THE DATE OF 
ISSUANCE OR AT THE NEXT REGULARLY SCHEDULED COUNCIL 
MEETING, WHICHEVER OCCURS LATER UNLESS EXTENDED OR 
MODIFIED BY A MAJORITY VOTE OF THE COUNCIL.  FURTHER, THE 
NEED FOR THE EMERGENCY PROCLAMATION WILL BE REVIEWED 
AT A REGULARLY SCHEDULED COUNCIL MEETING EVERY MONTH 
AFTER ISSUANCE UNTIL THE PROCLAMATION EXPIRES OR IS 
REPEALED.  NOTHING HEREIN SHALL PREVENT THE MAYOR AND 
COUNCIL FROM PUTTING THE EMERGENCY PROCLAMATION ON A 
COUNCIL AGENDA FOR DISCUSSION OR ACTION.

Section 2. 
Providing for Repeal of Conflicting Ordinances. 
 
All ordinances or parts of ordinances in conflict with the provisions of this 
ordinance, or any parts hereof, are hereby repealed. 
 
Section 3. 
Providing for Severability.   
 
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is 
for any reason held to be invalid or unconstitutional by the decision of any court of 
competent jurisdiction, such decision shall not affect the validity of the remaining 
portions thereof.
