RESOLUTION NO. 5621 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING THE ABANDONMENT OF TWO TEMPORARY DRAINAGE EASEMENTS NO LONGER NEEDED FOR PUBLIC USE ON THE SOUTH SIDE OF GERMANN ROAD AND EAST OF COOPER ROAD BETWEEN WRIGHT DRIVE AND STEARMAN DRIVE. WHEREAS, Chandler Connection, LLC, is the owner (the “Owner”) of the property located on the south side of Germann Road and east of Cooper Road between Wright Drive and Stearman Drive, legally described as Lot 2 of Chandler Airport Logistics Center, according to the plat of record in the Office of the County Recorder of Maricopa County, Arizona, recorded in Book 1425 of Maps, Page 37 (the “Property”); and WHEREAS, the Property is encumbered by two temporary drainage easements (the “Easements”) that the City of Chandler acquired in 2006 for the realignment of Germann Road; and WHEREAS, the Owner is currently constructing improvements on the Property that include the installation of permanent drainage facilities required pursuant to development plans approved by the City; and WHEREAS, the Owner has requested that the City abandon the Easements to clear up title to the Property and because they will no longer be needed for public use after the installation of the permanent drainage facilities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chandler, Arizona, as follows: Section 1. That the City of Chandler is authorized to abandon the Easements. Section 2. That the document used to abandon the Easements shall be in a form approved by the City Attorney attached as Exhibits “A” and “B” and made a part of this Resolution. Section 3. That the Mayor of the City of Chandler is hereby authorized to execute and deliver all documents necessary to abandon the Easements.
