RESOLUTION NO. 5643

A RESOLUTION OF THE CITY OF CHANDLER AUTHORIZING AN
INTERGOVERNMENTAL AGREEMENT WITH THE ARIZONA WATER
BANKING AUTHORITY FOR DISTRIBUTION OF LONG-TERM STORAGE
CREDITS FOR FIRMING MUNICIPAL AND INDUSTRIAL PRIORITY
CENTRAL ARIZONA PROJECT WATER.

WHEREAS, Chandler holds a subcontract for municipal and industrial (M&I) priority Colorado
River water delivered via the Central Arizona Project (CAP); and

WHEREAS, CAP supplies are subject to reductions under the Colorado River Interim
Guidelines for Lower Basin Shortages and Coordinated Operations for Lake Powell and Lake
Mead (“2007 Guidelines”) and the Lower Basin Drought Contingency Plan (““LBDCP”); and

WHEREAS, the Arizona Water Banking Authority (AWBA) has adopted a Policy Regarding the
Distribution of Long-Term Storage Credits for Firming CAP M&I Subcontractors to assist with
the implementation of the Lower Basin Drought Contingency Plan; and

WHEREAS, an intergovernmental agreement between the AWBA and Chandler will enable
Chandler to request and receive a direct distribution of long-term storage credits to mitigate
reductions in Chandler’s M&I priority Colorado River Water under the 2007 Guidelines and the
LBDCP.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL of the City of Chandler,
Maricopa County, Arizona, as follows:

Section 1. Authorizing the Director of Public Works & Utilities to execute the
Intergovernmental Agreement between the Arizona Water Banking Authority and

City of Chandler for M&I Firming in substantially the form attached as Exhibit
«A,

Section 2. Authorizing the Mayor to execute this Resolution.
