ORDINANCE NO. 5048 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, DECLARING THAT DOCUMENT ENTITLED “2023 AMENDMENTS TO CHANDLER CITY CODE CHAPTER 22” TO BE A PUBLIC RECORD; AMENDING CHAPTER 22 (SHORT TERM RENTALS), RELATED TO REGULATION OF SHORT-TERM RENTALS IN RESIDENTIAL PROPERTY, BY AMENDING SECTIONS 22-1 THROUGH 22- 6 AND ADDING SECTIONS 22-7 THROUGH 22-13; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PENALTIES. WHEREAS, Chapter 22 of the Chandler City Code provides for the regulation of short-term rental of residential property within the City of Chandler; and WHEREAS, Senate Bill 1168, codified as Ariz. Rev. Stat. § 9-500.39, relating to the regulation of short-term rentals, was approved by the Governor of Arizona on July 6, 2022; and WHEREAS, the City Council desires to protect the public’s health and safety through the regulation of short-term rental of residential property within the City as allowed by state law; and WHEREAS, the City Council desires that City staff will first educate short-term rental owners of the requirements of this Ordinance before enforcing its provisions for all property owners who are operating short-term rentals in good faith; and WHEREAS, in accordance with Chandler City Code Section 2.15, the Chandler City Council may amend the code by adoption of an ordinance. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, as follows: Section 1. That certain document known as the “2023 Amendments to Chandler City Code Chapter 22,” one paper copy and one electronic copy of which shall remain on file in the Office of the City Clerk, a copy of which is attached to this Ordinance as Exhibit A, is hereby declared to be a public record. Section 2. That the Chandler City Code is hereby amended by adoption of the amendments contained in the “2023 Amendments to Chandler City Code Chapter 22,” said document having been declared a public record. Section 3. Providing for Repeal of Conflicting Ordinances. All ordinances or parts of ordinances in conflict with the provisions of this ordinance, or any parts hereof, are hereby repealed. Section 4. Providing for Severability. Ordinance No. 5048 Page 2 If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Section 5. Providing for Penalties. A violation of this ordinance shall be punishable as provided for in Chandler City Code, Sections 22-10 and 30 Article II upon conviction. Section 6.
