RESOLUTION NO. 5711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING AMENDMENT NUMBER ONE TO THE MASTER ROADWAY MAINTENANCE INTERGOVERNMENTAL AGREEMENT BETWEEN THE STATE OF ARIZONA, BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION, AND THE CITY OF CHANDLER, FOR THE MAINTENANCE OF THE STATE HIGHWAY SYSTEM FOUND WITHIN THE CITY OF CHANDLER’S BOUNDARIES. WHEREAS, it is to the mutual benefit of the State of Arizona (the “State”) and the City of Chandler (the “City”) to specify their respective construction, operation, and maintenance responsibilities concerning certain State highway routes which are encompassed within the City’s system of streets and which form necessary and convenient links in the State highway system; and WHEREAS, pursuant to A.R.S. §48-572(B)(1), the City has the power to join with the State, or any of its departments or agencies, in the construction, operation, or maintenance of public improvements; and WHEREAS, on October 1, 2012, an intergovernmental agreement known as the Master Roadway Maintenance Intergovernmental Agreement, IGA 08-111-I, A.G. Contract No. P0012010001127, was entered between the City and the State, acting by and through its Department of Transportation (ADOT), to address said construction, operation, and maintenance responsibilities, which is currently in full force and effect; and WHEREAS, an amendment to the Master Roadway Maintenance Intergovernmental Agreement is required in order to, among other things, reflect changes in roles and responsibilities delegated between ADOT and the City for the maintenance of State highway routes I-10, SR 101L, and SR 202L within the City’s boundaries and the arterial ADOT right of way and City right of way along those routes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chandler, Arizona, as follows: Section 1. Approving Amendment No. One to the Master Roadway Maintenance Intergovernmental Agreement (No. 22-0008768-I) between the State of Arizona, acting by and through its Department of Transportation, and the City of Chandler. Section 2. Authorizing the Mayor to sign and execute Amendment No. One to the Master Roadway Maintenance Intergovernmental Agreement (No. 22-0008768-I) on behalf of the City of Chandler. Section 3. Authorizing City staff to perform all acts necessary to give effect to this Resolution and comply with the terms of Amendment No. One to the Master Roadway Maintenance Intergovernmental Agreement (No. 22-0008768-I).
