RESOLUTION NO. 5727 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA APPROVING AN AMENDMENT OF THE INTERGOVERNMENTAL AGREEMENT WITH THE ARIZONA GAME AND FISH COMMISSION TO PROVIDE A COMMUNITY FISHING PROGRAM AT DESERT BREEZE PARK LAKE AND VETERANS OASIS PARK LAKE. WHEREAS, via an Intergovernmental Agreement effective June 22, 2018 (“IGA”), the City of Chandler partners with the Arizona Game and Fish Commission (“AGFC”) to conduct a Community Fishing Program at the Desert Breeze Park Lake and Veterans Oasis Park Lake; and WHEREAS, both entities desire to continue providing community sport fishing to the extent such a program is found practical; and WHEREAS, the City and AGFC desire to amend the IGA to extend the term for one year and modify certain provisions while negotiating a new, longer-term IGA; and WHEREAS, the AGFC has authority under A.R.S. § 17-231.B.7 to make agreements with other entities for the operation of wildlife facilities and the conduct of related management studies, and the City has authority under A.R.S. § 9-240(B)(9) and A.R.S. § 4-494 to provide recreation through a Parks and Recreation Department. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Chandler, Arizona, hereby as follows: Section 1. Approves Amendment No. 1 to the IGA (the “Amendment”) between the City of Chandler and the AGFC in substantially the form attached hereto as Exhibit “A” and Section 2. Authorizes the Mayor to sign the Amendment and the City Manager, or designee, to take all action necessary or appropriate to carry out the purposes of this Resolution.
