ORDINANCE NO. 5066

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER,
ARIZONA, GRANTING A NON-EXCLUSIVE POWER DISTRIBUTION
EASEMENT TO SALT RIVER PROJECT AGRICULTURAL IMPROVEMENT
AND POWER DISTRICT FOR REPLACEMENT OF OLD 12 KV ELECTRIC
CABLE AND CONDUIT AND EXTENSION OF A POWER LINE ON THE
CITY’S WATER FACILITY AT 2107 N. 9187 PLACE IN CONSIDERATION
FOR THE PAYMENT OF ONE THOUSAND DOLLARS.

WHEREAS, Salt River Project Agricultural Improvement and Power District (“SRP”) wants to
replace old existing power cables and conduit on, and extend a power line across, the City of
Chandler water production facility at 2107 N. 91% Place; and

WHEREAS, SRP has agreed to pay the City of Chandler One Thousand Dollars ($1,000.00) for
the new easement; and

WHEREAS, the improvements will benefit the City of Chandler and the City of Chandler is
willing to grant the non-exclusive power distribution easement to SRP in consideration for the
payment to the City of $1,000.00.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona,
as follows:

Section 1. That the City Council of the City of Chandler, Arizona, authorizes and approves the
granting of a non-exclusive power distribution easement to SRP, under and across
that certain property legally described and depicted in Exhibit “A” attached hereto
and made a part hereof by this reference.

Section 2. ‘That the granting of said non-exclusive power distribution easement shall be in
substantially the form approved by the City Attorney attached hereto as Exhibit
“p>

Section 3. That the Mayor of the City of Chandler, Arizona, is hereby authorized to execute
the easement and this Ordinance on behalf of the City.

INTRODUCED AND TENTATIVELY APPROVED by the City Council of the City of
Chandler, Arizona, this day of 2023.
