The applicant seeks a Conditional Use Permit as required, resulting from their acquisition of an Arizona Department of Liquor License and Control Series 6 liquor license for a bar, solely for administrative compliance with ARS Title 4. The applicant's business is a neighborhood gastro pub with live entertainment. The applicant's business totals four thousand four hundred sixty-nine (4,469) square feet, with three thousand nine hundred eighty (3,980) square feet of inside restaurant space and four hundred eighty-nine (489) square feet attached outdoor patio space. The business has a seating capacity of two hundred four (204) persons, with one hundred twenty-one (121) persons designated for the interior dining area, fourteen (14) persons designated for the bar area, and sixty-nine (69) persons designated for the outdoor attached patio area. The applicant's regular business hours are 11:00 AM through 2:00 AM Monday through Friday, and 9:00 AM through 2:00 AM on Saturday and Sunday. They employ seven (7) fulltime and twenty-nine (29) part-time employees with various job functions. ® Page 2 February 17, 2023 The business has twenty-one (21) wall mounted televisions throughout the interior and two (2) televisions wall mounted on the attached outdoor patio. The outdoor patio is fully enclosed with a fifty-four (54) inch high block wall, in compliance with Arizona Revised Statute Title 4. The applicant has planted multiple Ficus trees around the perimeter of the patio to further mitigate any sound leaving the area. In accordance with the EUP approval, live acoustical music on the outdoor attached patio shall be at a low level and terminate on or before 8:00 PM. The applicant provides live entertainment not to exceed four (4) nights weekly, generally on Friday and Saturday nights. Such live entertainment consists of rock bands, solo entertainers, and karaoke. All live entertainment will be facing in the northerly direction to minimize sound detectable outdoors. The exterior facing east door is restricted for emergency exit use only. Further, supplemental sound barrier material has been installed to mitigate and/or eliminate any detectable sound outdoors. The applicant continues to be in strict compliance with the stipulations of City of Chandler EUP PLH21-0054. The applicant currently holds an Arizona Department of Liquor License and Control Series 12 liquor license for a restaurant (12070014101). This liquor license requires the licensee to have a food to liquor ratio of 40%/60%, thus a minimum of 40% of the gross revenues from operation to be food related items. During a recent audit of the applicant by members of the Arizona Department of Liquor Licenses and control, the results of said audit resulted in a food items sales percentage of less than the required 40%. @ Page 3 February 17, 2023 As a result of the food sales percentage audit disclosing a food sales percentage of less than 40 %, the applicant was ordered to acquire an Arizona Department of Liquor Licenses and Control Series 6 liquor license for a bar. The acquisition of said Series 6 liquor license requires the application for and issuance of a City of Chandler Conditional Use Permit, applied for herewith. The applicant now holds two (2) stacked liquor licenses; Series 12 (12070014101) and Series 6 (06070568) and is in full administrative compliance with ARS Title 4 currently.
