Call to Order
The meeting was called to order by Mayor Kevin Hartke at 6:00 p.m.

2. Proclamation – Domestic Violence Month

MAYOR HARTKE read the proclamation and invited Katie Cain, Chandler Police Department,
Domestic Violence Commissioner members, and Police Chief Sean Duggan to accept.
MS. CAIN thanked Mayor and Council for supporting their 14th annual domestic violence event
on September 26th. The free event aims to raise awareness and provide resources for survivors.
The council was thanked for their efforts in combating domestic violence.
3. Proclamation – Friends of the Library
MAYOR HARTKE read the proclamation and invited Rachel Kuzyk, Library Senior Manager, and
Bob Lowry, Friends of the Library, to accept.
Friends of the Library thanked Mayor and Council, patrons, donors, and volunteers for their
invaluable support.
4. Recognition – Annual Water Festival Sponsors
MAYOR HARTKE invited Deina Burns, Water Conservation Coordinator Public Works & Utilities,
and Hazen and Sawyer to accept.
MS. BURNS thanked sponsors for making the annual Water Festival in Chandler possible for over
18 years. The festival provides fourth graders with an extensive understanding of water systems
and conservation. We appreciate your contribution and recognize Black and Beach's support.
5. Recognition – 2023 Outstanding Biology Teachers Miranda Thornton
MAYOR HARTKE invited Miranda Thorton, a Biotechnology teacher at Basha High School, to
accept.
FRANK NARDUCCI, CUSD Superintendent, thanked Ms. Burns for the positive impact she has on
students' lives and their future paths.

1. Approval of Minutes
Move City Council approve the Council meeting minutes of the Study Session of August 14,
2023, the Regular Meeting of August 14, 2023, the Work Session of August 17, 2023, and the
Regular Meeting of August 17, 2023.
Community Services
2. Final Adoption of Ordinance No. 5067 Amending Chapter 31 of the Code of the City of
Chandler

Move City Council adopt Ordinance No. 5067 amending Chapter 31 of the Code of the City
of Chandler, sections 31-3 and 31-5; and adding a section 31-5.1, relating to enforcement
of community services code provisions.
COUNCILMEMBER STEWART asked for clarification on how Ordinance 5067 will affect
neighborhoods, homes, or individuals who want to use sparklers in front of their residences.
KELLY SCHWAB, City Attorney, answered that the ordinance will solely impact properties managed
by the Community Services department of the city and will not have any effect on private property
or residential areas. Under the current law, littering in the park is considered a class one
misdemeanor. However, this ordinance will convert it to a civil offense that comes with a fine and
a ticket.

3. Final Adoption of Ordinance No. 5062, Rezoning PLH22-0071 One Chandler, Located at the
Southeast Corner Arizona Avenue and Chandler Boulevard
Rezoning
Move City Council adopt Ordinance No. 5062 approving PLH22-0071 One Chandler,
Rezoning from CCD, MF-1, C-3, and PAD for a fast-food restaurant to PAD for mixed-use
development including commercial, office, and multi-family with Mid-Rise Overlay for
building heights up to 120 feet, subject to the conditions as recommended by Planning and
Zoning Commission.
Public Works and Utilities
4. Final Adoption of Ordinance No. 5060 Granting a Non-Exclusive Power Distribution
Easement to Salt River Project Agricultural Improvement and Power District for Electrical
Service to Fire Station 282
Move City Council adopt Ordinance No. 5060 granting a non-exclusive power distribution
easement to Salt River Project Agricultural Improvement and Power District (SRP), at no
cost, for electrical service to Fire Station 282 near Alma School and Warner roads.
Consent Agenda Motion and Vote
Vice Mayor Orlando moved to approve the Consent Agenda of the September 18, 2023, Regular
City Council Meeting; Seconded by Councilmember Encinas.
Motion carried unanimously (7-0).
