Background

The Chandler Police Department recognizes the current Arizona statutory law dictating that
“no unnecessary or unreasonable force shall be used in making an arrest, and the person
arrested shall not be subjected to any greater restraint than necessary for his detention.”
The Chandier Police Department stipulates officers must adhere to their training unless the
situation justifies a deviation from that training.”

The Chandler Police Department began to utilize the Use of Force Review Board in 2008 to
ensure the proper documentation of all applications of force, evaluate those applications
for adherence to established policy, and determine any additional training needs.? The
board meets monthly to evaluate the prior month’s incidents, and quarterly reviews are
prepared to share information and findings with the Citizen Review Panel.

This analysis contains use of force statistics for the second quarter of 2023 to identify
prevalent trends or deficiencies per the current CALEA standard.* In addition to an internal
comparative analysis, this report will illustrate training issues that emerged throughout the
quarter, as well as the number and general nature of injuries sustained by personnel and
suspects.

2023 Second Quarter Review

The Chandler Police Department logged 2191 arrests during the second quarter of 2023,
yielding a total of twenty-three (23) incidents resulting in a use of force by Chandler Police
Officers to effect an arrest or detain a subject under reasonable suspicion or probabie cause.

All reportable incidents were reviewed by the Use of Force Review Board. This board meets
monthly to determine if the applications of force are justified in accordance with the policies
of the Chandler Police Department.

The following tables document the twenty-three (23) incidents reviewed by the board for the
months of April, May, and June of 2023. It includes the types of force used and dispositions.
In some incidents there were multiple applications of force used by various officers. For this
reason, there were forty-eight (48) distinct applications of force. This report will deliver the
summaries of the twenty-three (23) reviewed incidents.

Policy Violations/Reviews

In the second quarter of 2023 there were no use of force incidents referred to Internal
Affairs.

Training issues

In the second quarter of 2023 there was one training issue identified by the Use of Force
Board. The training issue consisted of an officer no making attempts to de-escalate a
confrontation during a traffic stop. That officer's chain of command has addressed the
incident.

Injuries

In the second quarter of 2023, thirteen (13) officers were injured during use of force
incidents. The injuries sustained by officers were mostly minor in nature, generally
consisting of sprains, abrasions, Cuts, or bruising. Most of the officers’ injuries appeared to
stem from body-to-body contact, takedown techniques, and struggling to handcuff
suspects on hard surfaces or from direct assaults on the officers themselves.

Twenty-two (22) suspects were injured or complained of injury during the use of force
incidents. Most of these injuries were minor in nature, consisting of lacerations, abrasions,
contusions, complaints of pain, and CEW puncture wounds,

Injured officers and suspects received medical attention when requested. Medical
treatment was either provided on scene or ata hospital for more extensive care or

evaluation.

Emotionally Disturbed/Impaired

Sixteen (16) subjects involved in use of force incidents were found to be emotionally
disturbed, under the influence of alcohol or drugs, or a combination of impairments.

Conclusion

The reported types of use of force incidents during the second quarter of 2023 indicate
officers used the appropriate level of force to effect the arrest of suspects. This illustrates
that the use of force policy, defensive tactics training, board reviews, and overall
departmental philosophy are aligned with established case law, statutory regulations, and
the principles of community-oriented policing.

The following pages are the summaries that were presented to the Use of Force Board for
the second quarter of 2023.

summary:

On April 1, 2023, at 1936 hours, Chandler Police Officers responded to a call of a domestic
disturbance at 660 E. El Prado Road in Chandler. The caller stated his roommate was drunk
and they were involved in a disorder.

Officers arrived and spoke with the caller. The caller stated his roommate, jacob Davis, was
drunk and during an argument threw a hard piece of pizza at him striking him on the hand.
The calier had a bleeding cut on his hand from the pizza.

Officers then contacted Mr. Davis who was sitting outside in the back yard. He was
intoxicated, argumentative, and refused to answer questions. After several attempts to get
information from Mr. Davis were unsuccessful, Officer Wofford grabbed Mr. Davis's arm to
effect an arrest. Mr. Davis abruptly got up, pulled his arm away from Officer Wofford’s grip,
and attempted to walk away. Officer Wofford grabbed Mr. Davis by the torso and took him
to the ground, While on the ground Mr. Davis resisted being handcuffed by tensing his
arms. At one point he attempted to bite Detective Lauritzen, who had arrived and was
assisting with the arrest. Mr. Davis was eventually handcuffed and taken into custody.

Mr. Davis sustained abrasions and contusions to his back and left elbow. Medical aid was
not provided. Mr. Davis was booked into the Gilbert Chandler Unified Holding Facility. A
Body worn camera captured the use of force, and photos were taken of the incident.

Summary:

On April 2"4, 2023, at 2019 hours, Chandler Police Officers responded to a call of an
unknown problem at 87 W. ivanhoe Place in Chandler. The caller stated her son was on
drugs and holding a knife.

Officers arrived and spoke with the caller. The caller stated her son was on drugs and
paranoid. He had been holding a knife and pacing in the home stating people were trying
to get him. Officers observed the caller's son, identified as Raul Soto, having what appeared
to be a physical and verbal confrontation with his father inside the home. A family member
opened the home and allowed officers to enter. The officers saw Mr. Soto holding a power
tool in one hand and a plastic bag with unknown items in the other. Two officers grabbed
Mr. Soto's arms to handcuff and detain him. He tensed his arms and attempted to break
free. As the officers struggled with him, Mr. Soto managed to exit the home and enter the
carport area. During the struggle Mr. Soto kicked one of the officers. Officer Thomas
warned Mr. Soto if he continued to resist, he would deploy his CEW. After several warnings
Officer Thomas successfully deployed his CEW. The officers took Mr. Soto to the ground
and attempted to handcuff him. After the CEW's 5 second cycle ended he continued to
resist and began to reach into his waistband. Officer Thomas then drive stunned Mr. Soto's
shoulder/back area with his CEW. Officers were then able to handcuff and detain him.

Mr. Soto sustained puncture wounds from the CEW deployment, as weil as a laceration to
his head. Paramedics responded and sedated Mr. Soto. He was then transported to a local
hospital for treatment. Officers Andrews and Natividad sustained abrasions to their hands.
A body worn camera captured the use of force, and photos were taken of the incident.

Summary:

On April 3°, 2023, at 2020 hours, Chandler Police Officers responded to a call of a DUI
driver around McQueen Road and Warner Road in Chandier. The caller stated a yellow
Nissan had struck a curb and a center median.

Officer Thomas spotted the vehicle around 175 N. McQueen Road and initiated a traffic
stop. The vehicle made an abrupt turn and began to enter the residential complex located
at 1075 E. Chandler Boulevard. As the electric security gate opened, Officer Thomas exited
his patrol car and contacted the driver, later identified as Jonathon Vega. Mr. Vega refused
to provide his driver's license, was reaching into the center console, and refused to put his
vehicle in park. He then drove into the complex. Officer Thomas got back in his vehicle and
followed. Mr. Vega pulled into a parking spot and abruptly got out. Officer Thomas gave
hirn commands to get on the ground, but he refused, stating “shoot me” and making
gestures as if he was going to re-enter his car. A Pitbull dog was in the back seat of the car.
Several officers arrived, to include CIT trained officers and Crisis Negotiators. They tried to
reason with Mr. Vega but to no avail. Officer Wofford, who had arrived with his Sage Gun,
was also present. At one point during the negotiations Mr. Vega made a gesture as if he
was going to return to his car and open the door. Officer Wofford deployed his Sage Gun
striking Mr. Vega in the leg. Officers Thomas, Hall, and Natividad were able to move in,
take him to the ground, and into custody.

Mr. Vega sustained a contusion to his leg from the Sage Gun and a laceration to his head
from being taken to the ground. Paramedics responded and transported him to a local
hospital for treatment. A Body worn camera captured the use of force, and photos were
taken of the incident.

Charges on suspect:

DUI
Resisting arrest
Interfering with duties of a public official

Injuries:

Mr. Vega sustained a contusion to his leg from the Sage Gun deployment and a laceration

to his head from being taken to the ground.

Summary:

On April 10%, 2023, at 2306 hours, Chandler Police Officer Hullings was on patrol around
McQueen Road and Pecos Road in Chandler. He heard a woman screaming near a vehicle
at a restaurant located at 1020 E. Pecos Road.

As Officer Hullings approached the driver of the vehicle who stated a woman was harassing
customers at the restaurant and was banging on the restaurant window with a large
skateboard. The driver provided the officer with a description of the woman and last
direction of travel.

Officer Hullings located the woman behind a nearby strip mall and made contact. The
woman, later identified as Andrea McMurray, fled from Officer Hullings after he ordered
her to stop. The officer followed Ms. McMurray as she eventually got tired and slowed
down. As Officer Hullings got out of his vehicle to make contact, Ms. McMurray raised the
skateboard over her shoulder as if preparing to strike the officer, Officer Hullings ordered
her to drop the skateboard, but she refused. Officer Hullings stepped to the side, grabbed
Ms. McMurray by the arm, and took her to the ground. Ms. McMurray resisted being
handcuffed by tensing her arms and not obeying the officer's commands. Officer Hullings
kept control of her until additional officers arrived and handcuffed her.

Ms. McMurry sustained a laceration to her mouth from being taken to the ground.
Paramedics responded and transported her to a local hospital where she was admitted.
Officer Hullings sustained abrasions to his knee. A body worn camera captured the use of
force, and photos were taken of the incident.

Summary:

On April 11%, 2023, at 1545 hours, Chandler Police Officers responded to a domestic
disturbance at 501 E. Ray Road in Chandler. According to the caller, her boyfriend had
assaulted her.

Officers arrived and contacted the caller and her boyfriend, identified as John Waiter. As
the officers spoke to them separately, the caller explained how Mr. Walter had assaulted
her by slapping her face. During their conversation, Officer Wofford could hear Mr. Walter
getting upset with Officer Green. As he approached them, Mr. Walter clenched his fists and
got into a fighting stance. Officer Wofford attempted to de-escalate Mr. Walter but was
unsuccessful. Mr. Walter punched the side of the trailer and punched out a window. Officer
Wofford drew his CEW and ordered Mr. Walter to the ground, warning him several times he
would be “tazed.” Mr. Walter refused. Officer Wofford deployed two CEW cartridges which
connected with Mr. Walter. As he fell to the ground, officers approached and took him into
custody.

Mr. Walter sustained puncture wounds from the CEW deployment. Paramedics responded
and transported him to a local hospital where he was admitted. A Body worn camera
captured the use of force, and photos were taken of the incident.

summary:

On April 19", 2023, at 1627 hours, Chandler Police Officers responded to a domestic
disturbance at 750 S. Crosscreek Place in Chandler. According to the caller, Krystal Rebhun
was on her way to the Crosscreek address to harm her ex-boyfriend armed with a hammer.

Officers arrived and contacted the ex-boyfriend and his family. As they spoke with the ex-
boyfriend Ms. Rebhun was seen driving past the home in her car. Officers attempted to
catch up to her and conduct a traffic stop. She failed to stop for the officers and returned
to the ex-boyfriend's home. She exited her car with a hammer in her hand and walked
towards the home. Officer Land ordered her to stop but she refused. Officer Land
deployed his CEW, causing Ms. Rebhun to fall to the ground. She was piaced in handcuffs
and arrested.

Ms. Rebhun sustained puncture wounds from the CEW deployment and a laceration to her
head. Paramedics responded and transported her to a local hospital for treatment. After
being released, Ms. Rebhun was transported to the Gilbert Chandler Unified Holding
Facility and booked. A body worn camera captured the use of force, and photos were taken
of the incident.

summary:

On April 20", 2023, at 0545 hours, Chandler Police Officers responded to a trespassing at
600 W. Galveston Street in Chandler. The caller stated a previously trespassed person was
at the store. The caller had locked himself in the store prior to calling police.

Officers arrived and the previously trespassed person, identified as Kevin Kelly. As Officer
Orozco spoke to him, he abruptly took off running. Officer Orozco grabbed him by the arm
to detain him as Officer Rimbach arrived and tackled him. Both officers and Mr. Kelly went
to the ground. Mr. Kelly was subsequently taken into custody. it was later determined Mr.
Kelly had not been previously trespassed.

Mr. Kelly sustained abrasions to his face and hands. Paramedics responded and treated
him. Mr. Kelly was then transported to the Chandler City Court Holding facility to be seen
by a judge. Officers Rimbach and Orozco sustained abrasions to their hands and knees. A
body worn camera captured the use of force, and photos were taken of the incident.

Subject Actions: Refused to get out of vehicle
Summary:

On April 28", 2023, at 2333 hours, Chandler Police Officer Davisson responded to a
suspicious vehicle in the greenbelt area within a parking lot near a Goodwill store. The
location was within the Town of Gilbert but due to the proximity of the location Officer
Davisson responded.

Officer Davisson arrived and observed the vehicle was high centered on a curb within the
parking lot. Officer Davisson contacted the driver, identified as William Carnduff. Mr.
Carnduff stated he had come from a bar but had not had any alcohol to drink, His speech
was slurred, he had red and watery eyes, and appeared to be sweating. Gilbert Police
arrived to initiate a DUI investigation.

As Gilbert Officers instructed Mr. Carnduff exit the vehicle, he refused. After several
requests, the decision was to remove him from the vehicle. Mr. Carnduff gripped the
steering wheel and resisted being removed. Officer Davisson entered the passenger door
and told Mr. Carnduff that if he did not release the steering wheel and get out, he would be
“tazed.” After he refused, Officer Davisson activated his CEW in drive stun mode on Mr.
Carnduffs arm, causing him to release the steering wheel. He still resisted getting out, so
Officer Davisson activated his CEW a second time in drive stun mode to his midsection. Mr.
Carnduff was then removed from the vehicle and taken into custody by Gilbert Police
Officers.

Mr. Carnduff did not sustain any visible injuries. He was taken to the Gilbert Chandler
Unified Holding Facility by Gilbert Police and processed for DUI. A body worn camera
captured the use of force. No photos were taken of the incident.

Subject Actions: Refused to identify themselves

Summary:

On April 29", 2023, at 0239 hours, Chandler Police Officers responded to Harrison Street
and jackson Street in Chandler to assist an officer who was contacting two males. The
officer contacting the two males had requested non-emergency backup.

Officers Davisson and Lerma, along with other officers, arrived to assist. During the contact
with the two males, the decision was made to arrest them both for failing to identify
themselves. One of the males attempted to walk away but was handcuffed and arrested
without further incident. An officer approached the second male, later identified as Ramon
Martinez Alvarado, to effect an arrest. Mr. Alvarado turned and advanced towards the
officer in an aggressive manner. Officers Davisson and Lerma grabbed Mr. Alvarado by his
arms but he tensed up and attempted to break away. Both officers took Mr. Alvarado to
the ground. Once on the ground Mr. Alvarado punched Officer Davisson in the face as he
continued to actively resist and fight the officers. Officer Davisson delivered two fist strikes
to Mr. Alvarado’s head and positioned himself on top of him. As he continued to resist,
Officer Lerma delivered three fist strikes to Mr. Alvarado's torso. Both officers gave
instructions for Mr. Alvarado to stop resisting. Mr. Alvarado reached for Officer Davisson’s
knife that was on his duty belt. When Officer Davisson repositioned himself, he felt Mr.
Alvarado grab his gun holster. Officer Davisson told Officer Lerma what Mr. Alvarado was
attempting to do. Both officers repositioned themselves and were eventually able to take
Mr. Alvarado into custody.

Mr. Alvarado sustained abrasions to his legs, arms, and torso. He refused medical
treatment and was taken to the Gilbert Chandler Unified Holding Facility and booked.
Officer Davisson sustained abrasions to his hands. Officer Lerma sustained abrasions to his
neck. Officer Davisson’s body worn camera became dislodged and inoperable during the
altercation. Officer Lerma’s body worn camera captured the use of force. Photos were
taken of the incident.

Mr. Alvarado sustained abrasions to his legs, arms, and torso.

Subject Actions: Non-compliance with commands, attempted to break free from
officers

Summary:

On May 8", 2023, at 0845 hours, officers responded to a disorder at the Chandler Police
Station lobby located at 250 E. Chicago Street in Chandler. There was already an officer
contacting the disorderly person, who had been identified as Desiree Kirkpatrick.
Additional officers responded to assist.

Officers arrived and contacted Ms. Kirkpatrick outside the lobby area. Arecords check
revealed she had an active warrant for her arrest. Officers told her she was under arrest for
a warrant. Officers Madaras and Youcupicio grabbed her by the arms to effect an arrest.
Ms. Kirkpatrick resisted by attempted to break away. Both officers took her to the ground
and into custody.

Ms. Kirkpatrick sustained an abrasion to her shoulder. She was provided medical aid by
responding paramedics and was transported to the nearby Chandler City Court Holding
Facility. Photographs were not taken of the incident. A body worn camera captured the use
of force.

Subject Actions: Non-compliance with commands, active aggression
Summary:

On May 13", 2023, at 0217 hours, Officer Bailey was on duty patrolling the area of Arizona
Avenue and the 202 Freeway. He contacted a male later identified as Quinn Harrison who
was trespassing behind a business located at 1400 S, Arizona Avenue in Chandler.

Upon contact Mr. Harrison refused to provide identification, became agitated, and
clenched his teeth and his fists, challenging the officer to fight. Officer Bailey withdrew his
CEW and kept Mr. Harrison at bay until other officers arrived to assist. Officers Bailey and
Clark tried to take him into custody by grabbing his arms. Mr. Harrison resisted being
arrested by tensing his arms, preventing the officers from handcuffing him. Both officers
took Mr. Harrison to the ground. Mr. Harrison tucked both his arms underneath his body.
Officer Bailey delivered several knee strikes to his torso to gain compliance as Officer Clark
continued to pull on Mr. Harrison's arms to effect an arrest. Additional officers arrived and
he was subsequently taken into custody.

Mr. Harrison complained of not being able to breathe. Paramedics arrived and transported
him to a local hospital where he was admitted. Photographs were not taken of the incident.
A body worn camera captured the use of force.

Summary:

On May 14°, 2023, at 2200 hours, Chandler Police Officers responded to a call of a theft at
2755 W. Chandler Boulevard in Chandler. According to the caller, two males had taken
items without paying and fled. One of the males was observed to be in possession ofa
handgun. A description and direction of travel was provided.

Officer jordan located the two males near 2595 W. Chandler Boulevard. Upon contact the
two males fled on foot. Officer Jordan pursued one of the males, later identified as Joseph
Gonzales. As he pursued Mr. Gonzales on foot, Officer jordan deployed his department
issued Bola Wrap with negative results. Officer Jordan was able to catch up with Mr.
Gonzales and push him to the ground. Mr. Gonzales got pack up and attempted to flee.
Officer jordan pushed him to the ground a second time and attempted to handcuff him. He
was able to control once hand as Mr. Gonzales reached into his waistband with his other
hand. Officer Jordan observed a firearm falling out of Mr. Gonzales’ waistband. Officer
jordan was able to grab the firearm and throw it away as he continued to struggle with
him. Once the gun was discarded, Mr. Gonzales became compliant and stopped resisting.
He was taken into custody.

Mr. Gonzales complained of having asthma and had abrasions to his arm. Paramedics
arrived and treated him prior to being transported to the Gilbert Chandler Unified Holding
Facility where he was booked. Photographs were not taken of the incident. A body worn
camera recorded the use of force.

Summary:

On May 19°, 2023, at 0031 hours, Chandler Police Officers responded to a call of threats
with a gun at 299 S, Oregon Street in Chandler. According to the caller, a male stated he
had a gun and threatened to shoot him in the face. An unknown object was seen in the
male’s hand. A description of the male and direction of travel was provided.

Officer Rimbach observed a male fitting the description of suspect at the corner of Oregon
Street and Boston Street, Upon contact the male, later identified as Luis Hernandez, fled
from Officer Rimbach on foot. The officer was able to catch up with Mr. Hernandez and
took him to the ground. Once on the ground Officer Rimbach was able to take him into
custody. No item was found in Mr. Hernandez.

Mr. Hernandez sustained abrasions to his forehead and hand. Paramedics arrived and
treated him prior to being transported to the Gilbert Chandler Unified Holding Facility
where he was booked. Photographs were not taken of the incident. A body worn camera
recorded the use of force.
