CITIZENS’ PANEL FOR REVIEW OF POLICE COMPLAINTS AND USE OF FORCE REGULAR MEETING MINUTES October 3, 2023 1. CALL TO ORDER/ROLL CALL Chairman Fagen called the meeting to order at approximately 6:03 pm. APPROVAL OF THE MINUTES a. Minutes of July 11, 2023 Vice Chair Ingersoll moved to approve the minutes of the July 11, 2023, Citizens’ Panel for Review of Police Complaints and Use of Force meeting. Panel member Vukadinovich seconded the motion. The minutes were approved by all Panel members present. 3. SCHEDULED/UNSCHEDULED PUBLIC APPEARANCES/CALL TO PUBLIC a. Brian Vaughn – Citizen Complaint Mr. Vaughn expressed his concern regarding case 12-P-900559. Mr. Vaughn played an audio recording from Officer Fairclough’s body worn camera. The audio appeared to be a conversation between Officer Fairclough and a female. The female was not identified. Mr. Vaughn stated he would return for the next Citizens’ Panel for Review meeting scheduled in January to finish the rest of his complaint due to time constraints. 4. ACTION AGENDA a. Review and discuss the Shooting Incident of November 12, 2021, presented by Det. Smith (Mesa PD 2021-226061). The findings of the investigation were approved by all Panel members present. b. Review and discuss the Shooting Incident of July 17, 2022, presented by Det. Kallberg (2022-81186). There were questions and discussion, but no questions specific to the use of force. Panel member Whitaker asked if the critical incident videos of officer involved shootings presented at the panel meetings can be sent to panel members prior to the meeting. Cmdr. Sieczkowski explained the critical incident videos are published online for the public to view when there is an officer involved shooting. The critical incident video can be found on the Chandler Police Department website. The findings of the investigation were approved by all Panel members present. c. Review and discuss the Shooting Incident of November 23, 2022, presented by Det. Ynclan (2022-136803). There were questions and discussion, but no questions specific to the use of force. The findings of the investigation were approved by all Panel members present. d. Review, discuss, and approve the Use of Force Summary of the second quarter of 2023. Reference Summary 2, Chair Fagen asked staff to explain what drive stunning means. Sergeant Greene of the Training Unit explained in detail what drive stunning means. Reference Summary 3, Panel members asked a number of questions regarding the use of a sage gun and what a sage gun is. Sergeant Greene described a sage gun is a less lethal rifle. There were questions and discussions, but no questions specific to the use of force. Vice Chair Ingersoll moved to approve the Use of Force summary, seconded by Panel member Enoch. The Use of Force Summary of the second quarter of 2023 was approved by all Panel members present. e. Election of Officers: Chair and Vice Chair Chair Fagen self-nominated to serve another term, seconded by Panel member Vukadinovich. The vote carried unanimously. Vice Chair Ingersoll self-nominated to serve another term, seconded by Panel member Vukadinovich. The vote carried unanimously. 5. ANNOUNCEMENTS Chair Fagen announced the meeting schedule for 2024. Dates were approved by Chair Fagen. Panel did have questions regarding their roles and responsibilities as Panel members appointed to the board. Staff notified the board there will be Open Meeting Law training which will cover roles and responsibilities of panel members appointed to Boards and Commissions with the City of Chandler. Staff advised panel members will be given more information in the near future regarding training for all panel members. 6. CALENDAR/FUTURE AGENDA ITEMS Next meeting will be Tuesday, January 9, 2024. 7. INFORMATION ITEMS Introduction of Det. Jeff Fox, the new staff liaison. Det. Fox replaced Det. Arias who has since retired. Det. Fox notified the board he is currently working on adding a couple of field trips which will help the panel gain a better understanding of the department. 8. ADJOURNMENT Panel member Enoch moved to adjourn, seconded by Panel member Mardis. The motion was approved by all Panel members present, and the meeting adjourned at approximately 7:25 p.m.
