Meeting Minutes Public Safety Police Personnel Retirement Board Regular Meeting November 1, 2023 | 9:00 a.m. City Hall, 2nd Floor, Training Room B 175 S. September 6, 2023, Chandler Local Police Public Safety Personnel Retirement Board Minutes Consent Agenda Motion and Vote Page 2 of 7 Police Member Elect Shellum moved to approve the Consent Agenda of the September 6, 2023, Regular Public Safety Police Personnel Retirement Board Meeting; Seconded by Police Member Elect Kieffer. Motion carried unanimously (5-0). Executive Session - Pursuant to A.R.S. Section 38-431.03 (A), the Chandler Local Police Public Safety Personnel Retirement Board may vote to convene in executive session to discuss or consider confidential records exempt by law from public inspection, and/or to consult with the Board’s attorney for legal advice and to consider the Board’s position and to instruct the Board’s attorney regarding its position on items 2-4. The Board will take action on those items in open session. Action Agenda Item No. 4 was moved to Action Agenda Item No. 2 Action Agenda Item No. 2 and Discussion 2. Application for Accidental Disability Mills Consideration, Discussion, and Appropriate Action regarding the Application for an Accidental Disability for Michael Mills. Action Agenda Item No. 2 Motion and Vote Mr. Mills’ attorney, Steve Serbalik, was given an opportunity to make a statement to the Board. Mr. Mills is requested to withdraw his application for Accidental Disability. Police Member Elect Shellum moved to accept the withdrawal of the application for accidental disability for Michael Mills; Agenda Item No. 2 of the November 1, 2023, Regular Public Safety Police Personnel Retirement Board; Seconded by Citizen Member Crawford. Motion carried unanimously (5-0) Action Agenda Item No. 3 and Discussion 3. Application for Accidental Disability Moore Consideration, Discussion, and Appropriate Action regarding the Application for an Accidental Disability for Michael Moore. Executive Session – Chairperson Turner asked for a motion to end the Open Session and to move into Executive Session for legal advice. Police Member Elect Shellum made a motion to end the Open Session and to move into Executive Session for legal advice in matter Action Agenda Item No. 2. Police Member Elect Kieffer seconded the motion, and Page 3 of 7 the vote was unanimous to end the Open Session and move into Executive Session at 9:01 a.m. Open Session – Chairperson Turner asked for a motion to end the Executive Session and move into Open Session. Police Member Elect Shellum made the motion to end the Executive Session and to move into Open Session; Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Executive Session and move into Open Session at 9:19 a.m. Action Agenda Item No. 3 Motion and Vote Mr. Moore and his attorney, Thomas Griffin, were given an opportunity to make a statement to the Board. Executive Session – Chairperson Turner asked for a motion to end the Open Session and to move into Executive Session for legal advice. Police Member Elect Shellum made a motion to end the Open Session and to move into Executive Session for legal advice in matter Action Agenda Item No. 3. Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Open Session and move into Executive Session at 9:08 a.m. Open Session – Chairperson Turner asked for a motion to end the Executive Session and move into Open Session. Police Member Elect Shellum made the motion to end the Executive Session and to move into Open Session; Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Executive Session and move into Open Session at 9:19 a.m. I move to approve the application for Temporary Disability for Michael Moore based on the Medical Board reports from Dr. Parker dated August 11, 2023, and October 7, 2023, finds that Mr. Moore can satisfy all statutory requirements for a Temporary Disability. The P5-LB-T Accidental Disability questionnaire completed by Dr. Parker dated October 27, 2023, finds that Mr. Moore can satisfy all statutory requirements and there are no conflicts in medical evidence that require Board evaluation.; Agenda Item No. 3 of the November 1, 2023, Regular Public Safety Police Personnel Retirement Board; Seconded by Citizen Member Crawford. Motion carried unanimously (5-0) Action Agenda Item No. 4 and Discussion 4. Application for Accidental Disability Hancock Page 4 of 7 Consideration, Discussion, and Appropriate Action the Application for an Accidental Disability for Shawn (Allen) Hancock. Action Agenda Item No. 4 Motion and Vote Mr. Hancock and his attorney, Judith Abramsohn, were given an opportunity to make a statement to the Board. Executive Session – Chairperson Turner asked for a motion to end the Open Session and to move into Executive Session for legal advice. Police Member Elect Shellum made a motion to end the Open Session and to move into Executive Session for legal advice in matter Action Agenda Item No. 4. Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Open Session and move into Executive Session at 9:33 a.m. Open Session – Chairperson Turner asked for a motion to end the Executive Session and move into Open Session. Police Member Elect Shellum made the motion to end the Executive Session and to move into Open Session; Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Executive Session and move into Open Session at 10:06 a.m. Police Member Elect Shellum moved to acknowledge the receipt of the application and table the Application for an Accidental Disability for Shawn (Allen) Hancock for further investigation and to obtain additional relevant records. Motion carried unanimously (5-0) Action Agenda Item No. 5 and Discussion 5. New Membership for Ramirez, Paskett, E. Ponce, Homer, Silvestri, Sprague, and M. Ponce Consideration, Discussion, and appropriate Action for New Membership for Marcos Ramirez, Kyle Paskett, Erubey Ponce, Randy Homer, Matthew Silvestri, Evan Sprague, and Miranda Ponce. Action Agenda Item No. 5 Motion and Vote Police Member Elect Shellum moved to approve find that the following employees met the applicable PSPRS membership definitions for service with the City of Chandler Police Department: Marcos Ramirez, Police Officer Lateral - Certified, hire date May 9, 2023; Kyle Paskett, Police Officer Lateral - Not Certified, hire date August 1, 2023 with a Tier 3 service date Page 5 of 7 of October 30, 2023; Erubey Ponce, Police Officer Lateral - Not Certified, hire date August 1, 2023 with a Tier 3 service date of October 30, 2023; Randy Homer, Police Officer Recruit, hire date August 15, 2023, with a Tier 3 service date of November 13, 2023; Matthew Silvestri, Police Officer Recruit, hire date August 15, 2023, with a Tier 3 service date of November 13, 2023; Evan Sprague, Police Officer Recruit, hire date August 15, 2023, with a Tier 3 service date of November 13, 2023; Miranda Ponce, Police Officer Lateral - Not Certified, hire date September 5, 2023 with a Tier 3 service date of December 4, 2023. Police Member Elect Shellum made the motion to end the Executive Session and to move into Open Session; Police Member Elect Kieffer seconded the motion, and the vote was unanimous to end the Executive Session and move into Open Session at 10:14 a.m. Chairperson Turner moved to declare two pre-existing medical conditions listed on the pre- existing cover sheet for Marcos Ramirez; Seconded by Citizen Member Crawford. Motion carried unanimously (5-0) Citizen Member Crawford moved to declare two pre-existing medical conditions listed on the pre-existing cover sheet for Kyle Paskett; Seconded by Citizen Member Remington. Motion carried unanimously (5-0) Citizen Member Remington moved to declare one pre-existing medical condition listed on the pre-existing cover sheet for Erubey Ponce; Seconded by Citizen Member Crawford. Membership Terminations for Anguiano, Lumpp, Bailey, and Mangum PSPRS memberships for Ricardo Anguiano (a Police Officer Lateral Certified) effective September 13, 2023, Shane Lumpp (a Police Officer Lateral Certified) effective October 19, 2023, Sean Bailey (a Police Officer Recruit) effective September 27, 2023, and Matthew Mangum (a Police Officer) effective October 16, 2023. Action Agenda Item No. 6 Motion and Vote Police Member Elect Kieffer moved to terminate the PSPRS memberships for Ricardo Anguiano (a Police Officer - Lateral Certified) effective September 13, 2023, Shane Lumpp (a Police Officer Lateral Certified) effective October 19, 2023, Sean Bailey (a Police Officer Recruit) effective September 27, 2023, and Matthew Mangum (a Police Officer) effective October 16, 2023 the dates of their voluntary resignations. Action Agenda Item No. 7 Motion and Vote Police Member Elect Shellum moved to approve the 2024 Board meeting dates as presented in the Board memo.
