ORDINANCE NO. 5077 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA APPROVING AN AMENDMENT TO THE FIRST AMENDED AND RESTATED CITY OF CHANDLER GROUND LEASE NUMBER 017 WITH CHANDLER AVIATION SERVICES, INC.; AND AUTHORIZING THE MAYOR TO SIGN THE AMENDMENT AND THE CITY MANAGER TO SIGN ALL DOCUMENT AND TAKE ALL OTHER ACTION NECESSARY OR APPROPRIATE. WHEREAS, the City of Chandler leased certain premises to Chandler Aviation Services, Inc. (“Tenant”) pursuant to the First Amended and Restated City of Chandler Ground Lease Number 017 effective July 1, 2017 (the “Lease”) to provide aviation maintenance and repair services at the Chandler Municipal Airport; and WHEREAS, ownership of the Tenant entity is being sold and the new owners are seeking financing from the U.S. Small Business Administration (the “SBA”); and WHEREAS, the City and Tenant desire to amend the Lease to revise the original Exhibit “D,” Landlord Consent and Agreement, to incorporate certain terms required by the SBA. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Chandler, Arizona, hereby as follows: Section 1. Approves Amendment No. 1 to the Lease (the “Amendment”) between the City of Chandler and the Tenant in substantially the form attached hereto as Exhibit “A.” Section 2. Authorizes the Mayor to sign the Amendment and the City Manager, or designee, to sign all documents and take all action necessary or appropriate to carry out the purposes of this Ordinance.
