RE: 67" AVE AND BROADWAY ROAD DE-ANNEXATION

The purpose of the letter is to notify Maricopa County and request approval from the Board of
Supervisors for a de-annexation of property by the City of Phoenix, pursuant to A.R.S. §9-
471.02. The subject property, approximately 0.287 acres, is 22 feet of right-of-way from the City
of Phoenix to accommodate the required 55-foot street completely within MCDOT’s jurisdiction
for the arterial roadway. In addition, the northwest corner of 67" Ave and Broadway Road to
include the MCDOT controlled signal. The de-annexation was requested by the City of Phoenix
Street Transportation Department of the subject property to place the property entirely within the
same municipality.

The de-annexation ordinance was adopted by the Phoenix City Council on June 14", 2023. A
copy of the City of Phoenix Ordinance is enclosed for your information. The ordinance does not
contain an emergency clause.

Pursuant to A.R.S. §9-471.02, to become effective, these actions require formal action and
approval by the Board of Supervisors. Therefore, we request that the Board schedule this for
formal action. Please notify us when the public hearing is scheduled by the Board of
Supervisors so that we can provide timely notice of the hearing at least 20 days in advance to
the owner of real property within the proposed de-annexation are as required by A.R.S. §9-
471.02 (E).

ORDINANCE S-49903

AN ORDINANCE CONDITIONALLY DEANNEXING AN AREA
NEAR 67TH AVENUE AND BROADWAY ROAD AND
DECREASING THE CORPORATE LIMITS OF THE CITY OF
PHOENIX, ARIZONA, PURSUANT TO THE PROVISIONS OF
ARIZONA REVISED STATUTES, SECTION 9-471.03.

WHEREAS, the City of Phoenix desires to deannex a certain public right-of-
way partially located within the corporate limits of the City of Phoenix and returned the

right-of-way to Maricopa County pursuant A.R.S. Section 9-471.03.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY

OF PHOENIX AS FOLLOWS:
SECTION 1. That the City Council hereby determines that the tract to be

deannexed is as follows:

That part of the Southeast quarter of the Southeast quarter of
Section 24, Township 1 North, Range 1 East, G&SRB&M, Maricopa
County Arizona being a part of the area annexed by the City of
Phoenix Ordinance No. S-39443, recorded at Document No. 2012-
1165282 official Records of Maricopa County, Arizona, and a part
of the area annexed by the City of Phoenix Ordinance No. G-4897,
recorded at Document No. 2007-0577735 official records of
Maricopa County, Arizona, described as follows:

PART NO. 1:
The West 100 feet of the South 33 feet of said Section 24 as
described in said Ordinance S-39443.

PART NO. 2:

BEGINNING at the point of intersection of the North line of the
South 33 feet of said Section 24, and the West line of the East 33
feet of said Section 24, said point also being the Southeast corner
of said Ordinance No. G-4897;

Thence Westerly along the south line of said Ordinance No. G-
4897 to the West line of the East 100 feet of said Section 24;

thence Northerly along said West line to the North line of the south
60 feet of said Section 24;

thence Northeasterly to the point of intersection of the North line of
the South 105 feet and the West line of the East 55 feet of said
Section 24;

thence Northerly along said West line of the East 55 feet to the
North line of the South 350 feet of said Section 24;

thence Easterly to the West line of the East 33 feet of said Section
24;

thence South along said West line of the East 33 feet of said
Section 24 to the POINT OF BEGINNING.

SECTION 2. The deannexation is contingent on the Maricopa County
Board of Supervisors adopting by ordinance the legal description of the public right-of-
way and declaring the return of public right-of-way to the Maricopa County.

SECTION 3. That the corporate limits of the City of Phoenix be, and they are
hereby, reduced and decreased so as to exclude within the corporate limits of the City of
Phoenix the territory above described in Section 1 hereof, and that said territory is hereby .
deannexed and declared to be no longer a part of the City of Phoenix, contingent upon the

fulfillment of the conditions of A.R.S. Section 9-471.03 and Section 2 of this ordinance.

SECTION 4. That the map or plat attached to this ordinance is an
accurate map of the territory deannexed, and the same is hereby adopted as the official
map of the territory hereby deannexed, which said map and plat show the legal
boundaries thereof, together with the avenues, streets, alleys and lanes and the

locations thereof.

SECTION 5. That the Mayor of the City of Phoenix is authorized and
directed to certify that said map is an accurate map of the territory conditionally

deannexed under the provisions of this ordinance.

SECTION 6. That this ordinance with a certified copy of said official map

attached hereto shall be filed with the Maricopa County Board of Supervisors, Maricopa

County, Arizona.

SECTION 7. That upon the filing of a copy of this ordinance, together with
the attached official map, with the Board of Supervisors of Maricopa County, State of

Arizona.
