ORDINANCE NO. 5104 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, GRANTING A NON-EXCLUSIVE POWER DISTRIBUTION EASEMENT TO SALT RIVER PROJECT AGRICULTURAL IMPROVEMENT AND POWER DISTRICT, AT NO COST, FOR ELECTRICAL FACILITIES NECESSARY TO POWER THE RECLAIMED WATER INTERCONNECT FACILITY IMPROVEMENTS (WW1901.402). WHEREAS, the City of Chandler is constructing the Reclaimed Water Interconnect Facility (“RWIF”) at the Airport Water Reclamation Facility located at 905 E. Queen Creek Road; and WHEREAS, in order to provide electrical service to the RWIF, Salt River Project Agricultural and Power District (“SRP”) requires a non-exclusive Power Distribution Easement for their electrical facilities; and WHEREAS, the City of Chandler is willing to grant the non-exclusive Power Distribution Easement to SRP, at no cost, for the purpose of facilitating the installation of the electrical facilities necessary to power the RWIF. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, as follows: Section 1. That the City Council of the City of Chandler, Arizona, authorizes and approves the granting of a non-exclusive Power Distribution Easement to SRP, at no cost, in, upon, over, under, across, through, and along that certain property legally described and depicted in Exhibit “A” attached hereto and made a part hereof by this reference. Section 2. That the granting of said non-exclusive Power Distribution Easement shall be substantially in the form approved by the City Attorney attached hereto as Exhibit “B.” Section 3. That the Mayor of the City of Chandler, Arizona, is hereby authorized to execute the easement and this Ordinance on behalf of the City. Section 4. That the City Clerk shall cause the original or a certified copy of this Ordinance to be recorded in the Office of Maricopa County Recorder after the effective date of this Ordinance.
