PURPOSE In accordance with state statutes (A.R.S. §§ 16-821 - 16-822), establish policies for Maricopa County Elections, A Department of the Board of Supervisors, for the following procedures. 1. Determining that precinct committeemen vacancies exist. 2. Processing requests from the County Political Parties to create precinct committeemen vacancies. 3. Processing precinct committeemen appointments submitted by the County Political Parties. 4. Submitting Board Agenda Items for Precinct Committeemen Appointment and Vacancy Request II. AUTHORITY This Policy is authorized by the Board of Supervisors pursuant to A.R.S.§11-251. III. APPLICATION This Policy applies to Maricopa County Elections, A Department of the Board of Supervisors and the Clerk of the Board of Supervisors. IV. DEFINITIONS A. Elected Precinct Committeemen: A member of a recognized political party who is a registered voter in the precinct who successfully completes the nomination filing and is elected to the office of Precinct Committeemen at the August Primary Election. Or is a precinct committeeman who is appointed pursuant to A.R.S.§16-822.B when the election is cancelled by the Board of Supervisors because there were fewer nomination filings submitted than the number of precinct committeeman open positions as determined by the vacancy quota formula established in A.R.S.§16-821.A. Appointed Precinct Committeemen: A member of a recognized political party who is a registered voter in the precinct who is appointed by the Board of Supervisors into an existing vacancy after being recommended by the County Chairman of the appropriate political party. C. Vacancy: Precinct Committeemen vacancies exist when there are less elected Precinct Committeemen for the party in a specific precinct than the number of open positions allotted by ARS 16-821. Offices shall also be deemed vacant in accordance with A.R.S.§38-291. This includes, but is not limited to the following conditions: (1) death of the person holding the office, (2) resignation of the person holding the office and the lawful acceptance of the resignation, (3) the person holding the office ceases to be a resident of the precinct for which the person was elected or appointed, (4) absence from the state by the person holding office, without permission of the legislature, beyond the period of three consecutive months, (5) change in political party registration from the party in which the precinct committeeman was elected or appointed. V. POLICY A. County Political Party Requests to Appoint or Create a Vacancy in the Office of Precinct Committeeman 1. Precinct Committeemen Vacancy Requests a. Maricopa County Elections, a Department of the Board of Supervisors, shall create a formal process for the County chairs to submit requests to create a precinct committeeman vacancy. The formal precinct committeeman vacancy request process shall require the County Chair to provide the following information. i. Full Name as it appears on the voter registration record of the Precinct Committeeman ii. Voter Identification Number of the Precinct Committeeman iii. Identification of the applicable political party iv. The reason or cause of the vacancy v. The precinct number and name in which the Precinct Committeeman is currently serving vi. Residential address, phone number, and email address of the Precinct Committeeman (Include Mailing Address if different than the residential address) vii. Congressional, Legislative, and Supervisorial District of the Precinct Committeeman Policy Number: N#### Policy Title: PRECINCT COMMITTEEMEN APPOINTMENT AND VACANCY REQUESTS Current Adoption Date: MM-DD-YYYY Page 3 of 5 viii. For resignations, the signature of the Precinct Committeeman ix. The signature of the County Chairman of the appropriate political party and an attestation confirming that the vacancy requests meets the applicable by-laws of the County Political Party.. b. Upon receiving a request from the County Chairman for the applicable political party, the Maricopa County Elections, a Department of the Board of Supervisors, shall: i. Accept the request and save the supporting documentation. ii. Verify that all required information from A.1.a.i through ix above is included in the request. If any information is not included, alert the County Chair of the omission. Only accept request with all required information. (1) A signature of the precinct committeeman is only required for resignations. The signature is not required in the following instance. (a) Residence change out of their precinct (b) Political Party Change (c) Death (d) Other reasons as determined by the political parties bi-laws iii. Confirm all information has been provided by the County Chair of the applicable political party and send a notification to the residence of the Precinct Committeeman alerting them that the Board of Supervisors will be considering their removal and the date of the scheduled Board Meeting. iv. Submit all required information to the Clerk of the Board to place the requested removals on the agenda for the next available Board of Supervisors meeting. 2. Precinct Committeemen Appointment Requests a. Maricopa County Elections, a Department of the Board of Supervisors, shall create a formal process for the County chairs to submit requests to appoint a voter to fill a vacancy for the office of precinct committeeman. The formal precinct committeeman appointment request process shall require the County Chair to provide the following information. i. Full Name as it appears on the voter registration record of the appointee ii. Voter Identification Number of the appointee iii. The precinct number and name in which the voter is seeking appointment v. Residential address, phone number, and email address of the appointee (Include Mailing Address if different than the residential address) vi. Congressional, Legislative, and Supervisorial District of the appointee vii. The signature of the County Chairman of the appropriate political party . . and an attestation confirming that the appointment meets the applicable by-laws of the County Political Party. b. Upon receiving a request from the County Chairman for the applicable political party, the Maricopa County Elections, a Department of the Board of Supervisors, shall: i. Accept the request and save the supporting documentation. ii. Verify that all required information from A.2.a.i through vii above is included in the request. If any information is not included, alert the County Chair of the omission. Only accept request with all required information. (1) A signature of the appointee is not required iii. Confirm all information has been provided by the County Chair of the applicable political party and send a notification to the residence of the appointee alerting them that the Board of Supervisors will be considering their appointment to fill a vacancy for the office of precinct committeeman and the date of the scheduled Board Meeting. iv. Submit all required information to the Clerk of the Board to place the requested appointments on the agenda for the next available Board of Supervisors meeting. 3. Precinct Committeemen with Voter Registration Changes a. Maricopa County Elections, a Department of the Board of Supervisors, shall create a formal process for notifying County chairs of precinct committeemen who are no longer eligible to hold the office they were elected or appointed to due to changes in their voter registration. The formal notification process shall require Maricopa County Elections to provide the following information. i. Full Name of precinct committeeman who is no longer eligible for the office ii. Voter Identification Number of the ineligible precinct committeeman iii. Identification of the applicable political party iv. The precinct number and name in which the precinct committeeman was elected or appointed to serve Policy Number: N#### Policy Title: PRECINCT COMMITTEEMEN APPOINTMENT AND VACANCY REQUESTS Current Adoption Date: MM-DD-YYYY Page 5 of 5 v. The reason or cause of ineligibility for the office previously held, specifying the change in voter registration that resulted in the inability to continue to hold the office, which is limited to the following. (1) No longer registered in the party (2) No longer registered in the precinct (3) Cancelled, deactivated, or suspended voter registration b. Upon sending notices to County Chairman of precinct committeemen who are no longer eligible to hold the office they were elected or appointed to, the Maricopa County Elections, a Department of the Board of Supervisors, shall: i. Send a notification to the residence of the ineligible precinct committeeman alerting them that the Board of Supervisors will be creating a vacancy for the office they were elected or appointed to, the reason or cause of ineligibility, and the date of the scheduled Board Meeting. ii. Submit all required information to the Clerk of the Board with the vacancy requests to place the ineligible precinct committeemen on the agenda for the next available Board of Supervisors meeting.
