CITIZENS’ PANEL FOR REVIEW OF POLICE COMPLAINTS AND USE OF FORCE SPECIAL MEETING MINUTES July 9, 2024 1. Approval of the Minutes a. Minutes of April 2, 2024 Vice Chair Diefenbacher moved to approve the minutes of the April 2, 2024, Citizens’ Panel for Review of Police Complaints and Use of Force meeting. Panel member Schinke seconded the motion. The minutes were approved by all Panel members present. b. Minutes of June 4, 2024 Panel member Yang moved to approve the minutes of the June 4, 2024, Citizens’ Panel for Review of Police Complaints and Use of Force Special meeting. Panel member Slavin seconded the motion. The minutes were approved by all Panel members present. 4. ANNOUNCEMENTS a. The Chairperson announced Panel member Christopher Heo has resigned from the panel due to scheduling conflicts. b. Newly appointed Panel member Allen Leibowitz introduced himself to the Panel. Panel member Leibowitz is replacing Vice Chair Ingersoll. Currently, the Panel has two vacancies. c. Chief Chapman, Chief of Police formally introduced himself to the Panel. Chief Chapman’s ultimate goal is for the Panel and department to find a middle ground on reviewing the department’s Use of Force Quarterly summaries. Chief Chapman proposed presenting intermediate Use of Force incidents Quarterly summaries at the October meeting. The quarterly packets will be similar to what the Panel was reviewing in the past. Chief Chapman stated the Panel would also be able to view the use of force on video by viewing body worn camera footage of three to four incidents. 5. ACTION AGENDA a. Discussion and possible action to approve Annual Report: Citizens’ Panel for Review of Police Complaints and Use of Force memo for the Annual Report: Citizens’ Panel for Review of Police Complaints and Use of Force, July 1, 2023 – June 30, 2024. Vice Chair Diefenbacher moved to approve the Annual Report: Citizens’ Panel for Review of Police Complaints and Use of Force Review Council memo. Panel member Vukadinovich seconded the motion. The minutes were approved by all Panel members present b. Discussion and possible action to approve changes to the Bylaws of the Chandler Citizens’ Panel for Review of Police Complaints and Use of Force Discussion and possible action to change Bylaw Ordinance No. 3135 to current Bylaw Ordinance No. 4983. Panel member Yang moved to approve the change from Ordinance No. 3135 to Ordinance No. 4983. Panel member Enoch seconded the motion. Ordinance No. 4983 was approved by all Panel members present. Change Chairman to Chairperson and change him/his to their/them. Panel member Yang moved to approve the removal of gender specific. Panel member Vukadinovich seconded the motion. The removal of gender specific wording was approved by all members present. II. Meetings – Regular Full Board Meeting: Regular Full Board Meetings from 7:00 pm to 6:00 pm and adding ‘a time the Chairperson specifies”. Panel member Yang moved to changed regular meeting time from 7:00 to 6:00 pm and adding “a time the Chairperson specifies”. Panel member Vukadinovich seconded the motion. Motion was approved by all Panel members present. Recommendation to the Chief of Police: The Panel requested The Bylaws include the following; “The Panel may make recommendations to the Chief of Police concerning training programs, revisions of policies or procedures, commendable actions, preventive or corrective measures except for employee discipline and community concerns regarding Police action and procedures”. Add as a new paragraph under C. Recommendation to the Chief of Police. There was discussion between Panel members on where exactly the paragraph would be placed. Some Panel members discussed adding a new letter D while others believed it should be a new title. The Panel ultimately agreed that it would be a paragraph under C. Recommendation to the Chief of Police Vice Chair Diefenbacher moved to approve the adding Recommendation to the Chief of Police as a new paragraph under C. Panel member Vukadinovich seconded the motion. Motion was approved by all Panel members present. IV. Official Records: B. Recording of Meetings: A court recorder shall take minutes and provide a transcript of each meeting/session. Minutes with approval signatures of the Chairman will be submitted to the City Clerk’s Office. Panel requested to remove the word “court” from Recording and Minutes. The staff liaison does record minutes, however; is not a court recorder. Panel member Slavin moved to remove the word “court”. Panel member Yang seconded the motion. Removing the word “court” was approved by all members present. c. Discussion and possible action to recommend proposed changes to the Chandler City Council regarding Section 2-23.4 concerning The Chandler Citizens’ Panel for Review of Police Complaints and Use of Force. 2-23.4 Powers and Duties. The Panel discussed on changing 23.2.4 Powers and duties B; to allow Panel members to miss no more than two regular meetings per year instead of three (3) consecutive regular meetings. There was discussion among Panel members between unexcused and excused meetings. However, the Panel agreed no Panel member should miss more than two regular meetings. Panel member Yang moved to recommend Panel members miss no more than two regular meetings per year. Panel member Enoch seconded the motion. Motion was approved by all Panel members present. The Panel lastly discussed what the Panel reviews including all police shootings and police incidents when direct physical force by the Police results in serious physical injury or death. The Panel discussed also reviewing lethal and intermediate use of force. Vice Chair Diefenbacher is open to Chief Chapman’s proposal. Panel member Yang proposed recommending changes to Council to include the revision of lethal and intermediate use of force. There was discussion among all Panel members on whether or not to recommend making the changes should move forward to Council. Panel member Yang’s motion failed and the Panel ultimately agreed to table the motion. Panel member Schinke believes the Panel should allow Chief Chapman’s proposal to be presented at the next October meeting. 6. Discussion a. Discuss statistics on the number of citizen complaints regarding the use of force at Chandler Police Department for the past four years. Commander Shellum informed the Panel, Chandler Police has received a total of external six police complaints related to use of force in the past four years. Chairperson Fagen asked what the findings of each complaint were. Commander Shellum stated five out of the six complaints were cleared by body worn camera review. The Chain of Command will review the complaint and review the body worn camera. The sixth complaint was unfounded, personnel attempted to contact complainant, however; the complainant was unable to be contacted. There was more discussion regarding citizen complaints but no action was taken. 7. CALENDAR/FUTURE AGENDA ITEMS Next meeting will be Tuesday, October 1, 2024 at 6:00 pm. 8. INFORMATION ITEMS Panel member Yang informed the board Jason Sieczkowski has been promoted to Assistant Chief. 9. ADJOURNMENT Panel member Yang moved to adjourn, seconded by Panel member Whitaker. The motion was approved by all Panel members present, and the meeting adjourned at approximately 7:28 p.m.
