RESOLUTION NO. 5859 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF CHANDLER AND BRINSHORE DEVELOPMENT, L.L.C. RELATING TO REAL PROPERTY LOCATED AT 73 S. HAMILTON STREET TO BE KNOWN AS THE HAVEN ON HAMILTON; DIRECTING THE CITY MANAGER TO GIVE SPECIFIC CONSIDERATION TO HAVEN ON HAMILTON APPLICANTS BELONGING TO SPECIAL POPULATIONS SUCH AS SENIORS, PERSONS WITH DISABILITIES AND VETERANS; AND DIRECTING THE CITY TO CONTINUE ITS REDEVELOPMENT EFFORTS FOR THE CHANDLER PUBLIC HOUSING PORTFOLIO. WHEREAS, the City owns a public housing property, approximately 7.4 acres located at 73 South Hamilton Street that is currently known as Site 3; and WHEREAS, the City desires to redevelop Site 3 into approximately 250 new units of housing with community amenities using the Rental Assistance Demonstration program and other methods as available and approved by the U.S. Department of Housing and Urban Development, the Arizona Department of Housing and other financing partners; and WHEREAS, the City has determined that Brinshore Development, L.L.C. (“Brinshore”) is qualified and capable of acting as the co-developer for the new multifamily housing project, to be known as the “Haven on Hamilton,” in a manner that will facilitate the creation of affordable housing and provide public benefits for the City and the citizens of Chandler, Arizona; and WHEREAS, the City and Brinshore wish to enter into a development agreement to address certain matters related to the development of the subject property; and WHEREAS, Resolution 5604, approved on July 14, 2022, gave the City of Chandler broad authority to redevelop the Chandler Public Housing Portfolio as defined therein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chandler, Maricopa County, Arizona, as follows: Section 1. Approves the City of Chandler entering into a Development Agreement with Brinshore in substantially the form attached hereto as Exhibit “A” and incorporated herein by this reference. Section 2. Authorizes the Mayor of the City of Chandler to execute the Development Agreement and the City Manager or designee to execute related documents for and on behalf of the City of Chandler. Section 3. Directs the City Manager, where not otherwise prohibited by law or regulation, to give specific consideration to Haven on Hamilton applicants belonging to special populations such as seniors, persons with disabilities and veterans. Directs the City to continue to exercise its authority as provided in Resolution 5604 to pursue redevelopment and/or rehabilitation or other repositioning of the Chandler Public Housing Portfolio.
