CITIZENS’ PANEL FOR REVIEW OF POLICE COMPLAINTS AND USE OF FORCE SPECIAL MEETING MINUTES October 1, 2024 1. Approval of the Minutes a. Minutes of July 9, 2024 There were two clerical errors on the July 9, 2024, meeting minutes. Clerical errors were corrected on meeting minutes. Panel member Yang moved to approve the minutes of the July 9, 2024, Citizens’ Panel for Review of Police Complaints and Use of Force meeting. Panel member Leibowitz seconded the motion. The minutes were approved by all Panel members present. 4. ANNOUNCEMENTS a. Chairperson Fagen announced the meeting schedule for 2025. Dates were approved by Chairperson Fagen. b. Chairperson Fagen read letter to Panel from Chief Chapman regarding the pilot program. 5. ACTION AGENDA a. Presentation by Det. Werther on Body Worn Cameras Det. Werther gave a presentation on how Body Worn Cameras work and the difference between viewing the footage from body worn cameras and viewing it person. b. Review and discuss the Shooting Incident of March 28, 2023, presented by Det. Werther (2023-35945) There were questions and discussion, but no questions specific to the use of force. The findings of the investigation were approved by all Panel members present. c. Review and discuss the Shooting Incident of November 17, 2023, presented by Det. Ynclan (2023-132590). There were questions and discussion, but no questions specific to the use of force. The findings of the investigation were approved by all Panel members. d. Use of Force Summary Quarter 2 2024 Incident Review Summary 1 - Panel member Yang moved to approve Incident 24-40273. Panel member Leibowitz seconded the motion. The incident was approved by all Panel members present. Incident Review Summary 2 – Panel member Yang moved to approve Incident 24-40616. Panel member Lozano seconded the motion. The incident was approved by all Panel members present. Incident Review Summary 3 – Panel member Diefenbacher moved to approve Incident 24-43078. Panel member Vukadinovich seconded the motion. The incident was approved by all Panel members present. Incident Review Summary 4 – Panel member Yang notified the Panel and staff of a clerical error in incident summary 24-50141. Location of incident should reflect Ray Road and Arizona Avenue instead of Chandler Blvd and Ray Road. Panel member Yang moved to approve Incident 24-50141. Panel member Whitaker seconded the motion. The incident was approved by all Panel members present. Incident Review Summary 5 – Panel member Lozano moved to approve Incident 24-51149. Panel member Vukadinovich seconded the motion. The incident was approved by all Panel members present. Incident Review Summary 6 – There were questions and discussion, but no questions specific to the use of force. Panel member Yang moved to approve Incident 24-51483. Panel member Enoch seconded the motion. The incident was approved by all Panel members present. Incident Summary 7 – Panel member Yang moved to approve Incident 24- 51483. Panel member Enoch seconded the motion. The incident was approved by all Panel members present. Incident Summary 8 & 9 – Panel member Lozano moved to correct number of taser deployments from three to two due to clerical error. Panel member Schinke moved to approve Incident 24-51737. Panel member Lozano seconded the motion. The incident was approved by all Panel members present. Incident Summary 10 – Panel members had general questions regarding the department’s mental health pickup order procedure but no specific questions to use of force. Panel member Lozano moved to approve Incident 24-52642. Panel member Schinke seconded the motion. The incident was approved by all Panel members present. Incident Summary 11 – Panel member Vukadinovich moved to approve Incident 24-56518. Panel member Yang seconded the motion. The incident was approved by all Panel members present. Incident Summary 12 & 13 – Panel member Yang moved to approve Incident 24-56741. Panel member Vukadinovich seconded the motion. The incident was approved by all Panel members present. Incident Summary 14 – Panel member Enoch moved to approve Incident 24-58274. Panel member Leibowitz seconded the motion. The incident was approved by all Panel members present. Incident Summary 15 – Panel member Slavin moved to approved Incident 24-58617. Panel member Yang seconded the motion. The incident was approved by all Panel members present. Incident Summary 16 – Panel member Yang moved to approve Incident 24-62357. Panel member Lozano seconded the motion. The incident was approved by all Panel members present. Incident Summary 17 – Panel member Leibowitz moved to approve Incident 24-62895. Panel member Schinke seconded the motion. The incident was approved by all Panel members present. Incident Summary 18 – Panel member Vukadinovich moved to approve Incident 24-66350. Panel member Yang seconded the motion. The incident was approved by all Panel members present. Incident Summary 19 – There were questions and discussion, but no questions specific to the use of force. Panel member Yang moved to approve Incident 24-69673. Panel member Vukadinovich seconded the motion. The incident was approved by all Panel members present. Incident Summary 20 – Panel member Leibowitz moved to approve Incident 24-70792. Panel member Lozano seconded the motion. The incident was approved by all Panel members present. e. Election of officers: Chairperson and Vice Chairperson Panel member Yang nominated Vice Chairperson Diefenbacher to serve as Chair. Panel member Slavin seconded the motion. The vote carried unanimously. Panel member Yang self-nominated himself to serve as Vice Chair. However, there was concern among the Panel of a possible conflict of interest due to Panel member Yang currently running for council. There was no second motion. Panel member Yang withdrew his nomination. Panel member Schinke nominated Panel member Martinez to serve as Vice Chair. Panel member Slavin seconded the motion. The vote carried unanimously. 6. Discussion a. None 7. CALENDAR/FUTURE AGENDA ITEMS Next meeting will be Tuesday, January 7, 2025, at 6:00 pm. 8. INFORMATION ITEMS Panel member Yang would like to send a commendation to Officer Heslop for the officer involved shooting incident. Panel member Yang would like to send a commendation to Detective Ynclan and Detective Werther on the officer involved shooting incident presentation. Panel member Martinez informed the board of an event being held to honor fallen Officer David Payne. The event will be held at Valley of Sun Cemetery on October 31, 2024, at 10 a.m. Panel member Schinke requested the Panel be notified of public events held by the department. 9. ADJOURNMENT Panel member Vukadinovich moved to adjourn, seconded by Panel member Lozano. The motion was approved by all Panel members present, and the meeting adjourned at approximately 8:11 p.m.
