Background

The Chandler Police Department recognizes the current Arizona statutory law dictating that
“No unnecessary or unreasonable force shall be used in making an arrest, and the person
arrested shall not be subjected to any greater restraint than necessary for his detention.”
The Chandler Police Department stipulates officers must adhere to their training unless the
situation justifies a deviation from that training.”

The Chandler Police Department began to utilize the Use of Force Review Board in 2008 to
ensure the proper documentation of all applications of force, evaluate those applications
for adherence to established policy, and determine any additional training needs.? The
board meets monthly to evaluate the prior month's incidents and quarterly reviews are
prepared to share information and findings with the Citizen Review Panel. The Citizen
Review Panel will review all intermediate use of force incidents. The Citizen Review Panel
will also review all incidents involving an officer discharge of a firearm once the internal
investigation is completed.

This analysis contains low and intermediate use of force statistics for the third quarter of
2024 to identify prevalent trends or deficiencies per the current CALEA standard.* In
addition to an internal comparative analysis, this report will illustrate training issues that
emerged throughout the quarter, as well as the number and general nature of injuries
sustained by personnel and suspects. This use of force report does not include any
incidents involving an officer discharge of a firearm.

2024 Third Quarter Review

During the third quarter of 2024, the Chandler Police Department logged 2316 combined
arrests of adults and juveniles which resulted in a total of fourteen (14) low or intermediate
reportable use of force incidents. The incidents occurred while Chandler Police Officers
arrested or detained a subject under reasonable suspicion or probable cause. There were
ten (10) intermediate use of force incidents and four (4) low level use of force incidents. In
some incidents there were multiple applications of force used by various officers. For this
reason, there were thirty (30) distinct applications of low and intermediate level of force. The
fourteen incidents resulted in only 0.6% of the arrests by Chandler Police officers concluding
with a Use of Force.

All low and intermediate level of reportable use of force incidents were reviewed by the Use
of Force Review Board. The board meets monthly to determine if the applications of force
are justified in accordance with the policies of the Chandler Police Department.

The following tables document the fourteen (14) incidents reviewed by the board for the
months of July, August, and September of 2024. It includes the types of force used and
dispositions. This report will deliver the summaries of the ten (10) reviewed intermediate use

of force incidents.

Policy Violations/Reviews

In the third quarter of 2024 there were no low or intermediate use of force incidents

referred to Internal Affairs.

Training Issues

In the third quarter of 2024 there was one training issue identified. The board wanted the
officers to document the subject was found to be in possession of a pocketknife in the
narrative of their report. The officers were notified of this recommendation.

Injuries

In the third quarter of 2024, four (4) officers were injured during low or intermediate use of
force incidents. The injuries sustained by officers were mostly minor in nature, generally
consisting of sprains, abrasions, cuts, bruising or feeling pain. Most officer's injuries
appeared to stem from body-to-body contact, takedown techniques, foot pursuits,
struggling to handcuff suspects on hard surfaces or from direct assaults on the officers
themselves.

Twelve (12) suspects were injured or complained of injury during the use of force incidents,
Most of these injuries were minor in nature, consisting of lacerations, abrasions,
contusions, complaints of pain, and CEW puncture wounds. One subject sustained a minor
ulnar fracture to his forearm.

Injured officers and suspects received medical attention when requested. Medical
treatment was either provided on scene by the fire department or at a hospital for more

extensive care or evaluation.

Emotionally Disturbed/Impaired

Twelve (12) subjects involved in low or intermediate use of force incidents were found to be
emotionally disturbed, under the influence of alcohol or drugs, or a combination of
impairments.

Conclusion

The low and intermediate use of force incidents during the third quarter of 2024 indicates
officers used the appropriate level of force to effect the arrest of suspects. This illustrates
that the use of force policy, defensive tactics training, board reviews, and overall
departmental philosophy are aligned with established case law, statutory regulations, and
the principles of community-oriented policing.

Use of Force Incident Summaries

The following pages are the ten (10) intermediate use of force incidents that were
presented to the Use of Force Review Board for the third quarter of 2024.

Incident Summary #1:

Incident Report: 2024-77189

Date of Occurrence: July 9, 2024

Time of Occurrence: 1829 Hours

Subject Actions: Verbal and physical non-compliance with commands

Summary:

On July 9, 2024, at approximately 1829 hours, several detectives with the criminal apprehension
team responded to 210 E Brown Rd in Mesa, regarding a suspect that was located at this
location and wanted in conjunction with a drive by shooting.

Upon arrival to the scene, the juvenile male subject, Lasahte Goeman, was located standing
near his vehicle in the parking lot. As the officers contacted the male, they gave him multiple
commands to put his hands on his head and to stop moving. The male did not comply with
commands and walked away from officers and put his hands near his waist. Detective Mohney
#841 deployed his Taser, but the taser probes were ineffective. Detective Wagstaff #743 then
deployed his PepperBall gun at the subject, which made direct impact on the male. The male
hunched over and then moved further away from the officers towards a brick wall. The male
continued to not follow commands and moved his hands towards his waistband at which time
Detective Rodgers #552 deployed his less lethal munition 40 mm round striking the male on his
left side. The detectives continued to give the male commands. The male then placed his hands
on the wall as instructed and the team closed in and took him into custody.

The male complained of pain from the PepperBall and was provided water for his face. The male
sustained impact bruises from the PepperBall and 40mm round. He was transported by Mesa
Fire to Banner Desert Medical Facility and treated for his injuries. The male was then booked
into jail for aggravated assault with deadly weapon, drive by shooting, discharge firearm at
residence and discharge firearm in city limits.

Subject Actions: Verbal and physical non-compliance with commands, pulled away from
officers, resisting arrest

Summary:

On July 19, 2024, at approximately 1248 hours, Officer Coronado #842 responded to 652 N
Colorado St in Chandler regarding an officer stating he had a subject, Nicky Valencia, at gunpoint
after he exited a vehicle during a traffic stop and was in possession of a handgun.

Upon arrival to the scene, Officer Coronado heard Officer Ponce #892 giving several commands
for Mr. Valencia to get on the ground as he had his issued handgun pointed at him. The male
was non-compliant with commands. Officer Coronado deployed his taser at the male while
simultaneously pushing him to the ground. The probes made effective contact with the male
and he fell to the ground. The male continued to resist, and a drive stun was applied. The male
continued to struggle and not follow commands, causing Officer Coronado to fire another probe
which made a positive connection. The subject continued to be non-compliant causing Officer
Coronado to drive stun the male two more times. The male was then compliant and handcuffed
by several officers.

Mr. Valencia sustained taser probe puncture wounds and complained of knee pain. He was
transported to Dignity Health Medical Center where he was treated and released. He was then
booked into jail for resisting arrest, possession of weapon by prohibited person, possession of
drug paraphernalia, possession of dangerous drug, possession of weapon in drug offense, take
contraband into correction facility, and driving with license suspended. The use of force incident
was captured on officer’s body worn camera.

vehicle, rammed police vehicle in attempt to evade arrest

Summary:

On July 25, 2024, at approximately 1830 hours, multiple officers responded to 2225 W Frye Rd
to attempt the arrest of a male subject, Warren Thomas, who was wanted in connection with an
Order of Protection Violation and fled from officers in his vehicle.

Upon arrival to the scene, Detective Mohney #841, Sergeant Kerzie #5148, Detective Goddard
#792, Detective Rodger #552, and Detective Le #626 were acting members of an apprehension
team. The male was inside a vehicle in the parking lot. His vehicle had been pinned in by police
vehicles and he was ramming the police vehicle in his car attempting to evade arrest. The male
refused to follow officer’s commands to exit the vehicle. The incident became a male barricaded
inside a vehicle and further resources were requested.

Detective Mohney #841, Detective Goddard #792, and Sergeant Kerzie #5148 fired multiple
PepperBall rounds to the front exterior of the vehicle in an attempt to get the male to exit the
vehicle. This tactic had no effect on the male. Detective Rodgers #552 then fired a less lethal
munitions 37mm round through the rear passenger window, which broke the window and
created a port for the insertion of PepperBall. Sergeant Kerzie #148 then fired multiple rounds
of PepperBall into the vehicle through the port in the window. This caused the male suspect to
eventually exit the vehicle.

Once outside the vehicle, the male refused to follow multiple commands to put his hands on his
head and walk backwards to officers on scene. Sergeant Kerzie #5148 then fired multiple rounds
of PepperBall striking the male in the back. The male then briefly complied with commands, but
again reached his hands towards his waist. Sergeant Kerzie #5148 then fired more PepperBall
rounds striking the male in the back again. Detective Le #626 fired one less lethal munition
40mm round striking the male in the leg. Mr. Thomas then complied with commands and was
placed into custody.

Mr. Thomas sustained multiple impact bruises from the less lethal munitions and was
transported to Chandler Regional Medical Center for further medical treatment. He was later
booked into jail for aggravated domestic violence, criminal trespass DV, aggravated assault on
officer, fail to comply with court order- DV, burglary, warrant arrest, DUI, unlawful flight from
law enforcement and driving with suspended license.

Summary:

On August 04, 2024, at approximately 0118 hours, officers were dispatched to Circle K, 498 S
Arizona Av in Chandler, reference an Indecent Exposure. The reporting party advised a male
subject attempted to steal beer from the store and was exposing his genitals, urinating in public,
and causing a disturbance in the area.

Officer Liggitt #735 located the male, Arnold Carpio, walking in the area of S. Oregon St and W.
Elgin St which was directly behind the business. Officer Liggitt initiated his overhead emergency
lights and contacted Mr. Carpio. The officer told him to sit down multiple times, which he
refused and continued to walk towards the officer. The male then stopped and asked, “are you
gonna shoot me?”. The officer told him he was not going to shoot him and told him to sit down
again. The male then flipped the officer off and said, “fuck you” while he attempted to walk past
him. The officer did an impact push to the male, which caused him to fall backwards onto his
back. The officer mounted him and gained control of his right arm while he waited for other
officers to arrive for assistance. Other officers then arrived on scene and placed Mr. Carpio into
handcuffs.

After further investigation, Mr. Carpio was placed under arrest for Disorderly Conduct and City
Code Violations Prohibited Public Activities and Obstructing Public Officers. Mr. Carpio sustained
a scrape and blood on his left cheek and a scrape on his left elbow area. He refused medical
treatment. The use of force incident was captured on the officer’s body worn camera and the
injury was photographed.

Incident Summary #5:

Incident Report: 2024-92738

Date of Occurrence: August 16, 2024

Time of Occurrence: 2248 Hours

Personnel Involved: Officer Martin Orozco #818 and Officer Maurisio Miranda #874

Force Used: Closed Fist Strikes

Subject Actions: Fled from officers during contact, verbal and physical non-compliance with
commands, resisting arrest

Summary:

On August 16, 2024, at approximately 2248 hours, Officer Orozco #818 conducted a traffic stop
ona male subject, Juan Carlos Del Rio, for riding a bicycle with no light equipment at night near
Harrison St and Colorado St in Chandler. The male stopped and Officer Orozco recognized the
male from prior police contacts and knew he had active felony and misdemeanor warrants for
his arrest.

Officer Miranda #874 arrived on scene to assist, and the male fled from the officers. The officers
pursued the male until he arrived at the front door of 529 N Colorado St and gave him verbal
commands to stop. Officer Miranda observed the male aggressively swing open the metal
security screen door and attempt to push in the door with his shoulder while yelling for
someone. The officer gave him commands to get on the ground. As the officer approached the
male to apprehend him and prevent him from entering the residence, the front door opened.
This caused the male and officer to fall to the ground inside of the residence. The male grabbed
the officers vest, and the officer commanded him to put his hands behind his back. The male did
not listen to commands. Officer Miranda was seated on top of the male in a mounted position,
when he conducted right hand closed fist strikes to the male’s face approximately three to four
times to induce compliance for the male to flip over to his stomach and provide his hands to the
officers. The male flipped over to his stomach but refused to give the officers his hands. Officer
Orozco then took a mounted position on top of Juan’s back and attempted to gain control of his
left arm, but Juan continued to resist and began to turn towards the officers. The male reached
to grab Officer Orozco’s hand and leg area at which time Officer Orozco conducted
approximately two right hand closed fist strikes to the male’s face. The officers forcefully pulled
the male’s hands from underneath him and placed him into handcuffs.

The male requested paramedics as he had issues with his heart and had shortness of breath and
possible facial injuries. The male was transported to Banner Ocotillo Hospital for further medical
evaluation. Mr. Del Rio sustained abrasions to his face and had blood inside and around his
mouth. Mr. Del Rio was arrested for the misdemeanor and felony warrants, Possession of Drug
Paraphernalia and Obstructing Police Officers. Officer Miranda had a sore left leg. Officer’s body
worn camera captured the use of force incident.

Incident Summary #6:

Date of Occurrence: August 23, 2024

Time of Occurrence: 2203 Hours

Force Used: Closed Fist Strikes and take down with injury

Subject Actions: Fled from officers, verbal and physical non-compliance with commands,
physical assault on officer, resisted arrest

Summary:

On August 23, 2024, at approximately 2203 hours, Officer Arreola #923 attempted to stop a
subject, Nathaniel Peter, for riding a bike without a front or rear light near Arizona Ave and
Fairview St in Chandler. Mr, Peter fled from the officer on his bicycle. The officer activated his
patrol vehicles emergency lights and siren and pursued the male. The officer gave several verbal
commands of “police” and “stop”.

The officer eventually caught up to the male at 66 E Kesler Ln in Chandler and exited his patrol
vehicle. The officer ran towards the male, who got off his bike and pushed it towards the officer
causing the officer to fall on his hands and knees which caused injury. The officer got back onto
his feet and grabbed onto the male pulling him down to the ground. The male began reaching
towards his waistband with his left hand. The officer told the male multiple times to stop
reaching towards his waistband, but he continued to do so. Officer Bailey #876 arrived on scene
and while assisting to gain control of the male’s hands, he delivered two closed fist strikes to the
male’s right rib cage area as he did not listen and continued to reach towards his waistband with
his left hand. Other officers arrived on scene and were able to gain control of the male’s hands
and placed him into handcuffs. The male was searched, and a pocketknife was found in his right
pocket along with methamphetamine.

Mr. Peter sustained visible injuries to his face and complained of pain in his arm. Mr. Peter was
evaluated by Chandler Fire Department and then transported to CRMC for further evaluation
and clearance. Photographs were taken of his injuries to include abrasions above his left
eyebrow, right side of his face and head, his abdomen, right side of his chest, left arm and right
shoulder. He also sustained a minor ulnar fracture to his forearm, which he received a sling. Mr.
Peter was booked into the holding facility for Aggravated Assault on an officer, Resisting Arrest,
Possession of Dangerous Drugs, and Obstructing police officers. The incident was captured on
officer’s body worn camera.

Subject Actions: Observed pointing a firearm at multiple residences
Summary:

On September 2, 2024, at approximately 2150 hours, multiple citizens contacted the Chandler
Police Department after observing a male, Eduardo Suarez, in the roadway with what appeared
to be a firearm near 2801 W Curry St in Chandler. The reporting party advised the male was
hiding behind vehicles near her residence while appearing to have conversations with himself.
Dispatch voiced a hazard associated to Eduardo Suarez saying he was known to carry firearms,
had possible mental health issues and narcotic use, showed signs of paranoia, and has been
seen in the past on neighbor's cameras running and hiding with a firearm in his hand.

Officers set up a perimeter to contain the incident and a drone was deployed which positively
confirmed the male was armed with a firearm. The male was observed actively pointing the
firearm at multiple residences and taking cover behind vehicles parked in the roadway. The
male walked eastbound on Curry St where he was met with several officers who gave verbal
commands. Officer Osborn stated, “Chandler Police” and “Stop right there”. The male placed
the firearm behind his back initially. Officer Osborn then stated, “Put your hands on top of your
head” and “drop the gun”. The male did not comply with the officer’s commands and Officer
Osborn deployed a single 40 MM round which caused the male to drop the firearm and stand
with his hands on his knees. The male then complied with commands and laid face down on the
sidewalk where officers approached him and placed him into custody.

The male did not know if he was hit by the 40 MM round and Chandler Fire responded to the
scene and evaluated him. Photographs were taken of the male to show there was no injury.
Officers recovered the male’s firearm, which was a Glock 43X (9mm) with one round chambered
as well as a five-round magazine. Mr. Suarez was arrested for Disorderly Conduct, Possession of
Narcotic Drugs, Endangerment, and Possession of Weapon in Drug Offense. The incident was
captured on officer’s body worn camera.

Subject Actions: Subject in possession of handgun’s, verbal and physical non-compliance
with commands

Summary:

On September 8, 2024, at approximately 0414 hours, officers responded to the area of S
Washington St and E Elgin St in Chandler reference a disturbance involving a firearm. Chandler
Police received a 911 call from an anonymous male who stated he observed a male and female
engaged in a verbal argument. The male then pulled two handguns from his back waistband and
pointed them at the reporting party. The male was described as a Hispanic male, heavy set with
long hair wearing all black. The reporting party did not wish to aid in prosecution.

Officer Arreola #923 arrived on scene and observed a male matching the description standing
with a female in front of 445 S Washington St in Chandler. The officer placed the male, Everardo
Pena, at gunpoint and stated, “Let me see your hands” and “get onto the ground”. The male
stood there, and the officer told him again to get on the ground and announced himself as
“Police”. The male stated he could not see and then stated he was not getting on the ground.
The officer gave the male commands again to get on the ground now. During this, the female
distanced herself and walked back towards the residence and it was unknown if she was in any
danger. Officer Miranda #874 arrived on scene and placed the male at gunpoint and told him to
get on the ground. The male began to slowly get onto his knees when Officer Arreola observed
what appeared to be a handgun in the back of his waistband. The officer announced he
observed something in the back of his waistband and commanded him to not reach for it. As
the male was getting onto his knees, he was looking away from the officer. As the officer
approached him, the male turned and looked at him. Officer Arreola feared the male was going
to reach for the gun, so he delivered a kick to his back, which caused the male to fall forward to
the ground causing injury to his face. Officer Arreola continued to hold the male at gunpoint,
while he controlled his left arm and head. Officer Miranda secured the firearm located in his
back waistband and then controlled his right arm and placed him into handcuffs.

The male informed officers he had another firearm in his pocket. The officers waited for further
officers to arrive on scene at which point they finished searching the male, secured the second
firearm, and placed him into the back seat of a patrol vehicle. The male complained of pain in
his head and his arm feeling dislocated. The male sustained an abrasion near his eye. Chandler
Fire responded and provided medical treatment. While Chandler Fire was providing medical
treatment to the male, he began to hit the front of his head on the patrol plexiglass partition in
front of him. The male was then transported to Dignity Health Emergency Room where he was
provided with further medical evaluation/treatment as he complained of pain in his left
shoulder/neck area. Ultimately, the male was medically cleared for booking. Mr. Pena was
arrested for Aggravated Assault- Deadly Weapon and Disorderly Conduct involving a firearm.

Subject Actions: Armed with firearm, verbal and physical non-compliance with commands
Summary:

On September 11, 2024, at approximately 1430 hours, officers from several units conducted
surveillance on a trailer near 54" St and Fairview St in Chandier that belonged to Nathan Nutt,
who had a $200,000 warrant for kidnapping out of San Jose, CA PD. Mr. Nutt had a very
extensive and violent criminal history and was known to carry a firearm on his person. While
officers were conducting surveillance, they observed the male leave the trailer on foot wearing
a cross-body bag across his chest and walking with a female.

The male walked southbound on 54" street. Several officers contacted him on 54" St just south
of Fairview St and put him at gun point. The officers gave him several verbal commands such as
“Police, don’t move”, “hands on top of your head”, “interlace your fingers” and “face away from
us”, There was intel provided that the male kept a firearm in the cross-body bag that was across
his chest. The male turned his body and head to try and observe officers positions several times.
On a few occasions, the male removed his hands from his head, however, he kept them in the
air. The male was asked if he had a gun on him to which he acknowledged he was in possession
of a gun and at that point dropped his hands and touched the strap of the cross-body bag he
was wearing. Officers gave him commands to keep his hands on top of his head and to walk
backwards to the sound of their voice. As the male began to walk backwards with his hands on
top of his head, he lowered his right arm towards his waist area. Detective Wagstaff deployed
PepperBall which had direct impact on the male’s back. He then laid on the ground and
followed commands. He was placed into custody.

The male sustained three small welts on his back from the PepperBall. Mr. Nutt was arrested for
the arrest warrant, Misconduct Involving Weapons, and Possession of a Dangerous Drug. The
incident was captured on officer’s body worn camera.

commands, resisting arrest

Summary:

On September 28, 2024, at approximately 0837 hours, officers were dispatched to a disturbance
that occurred at 3400 N Alma School Rd #2091 in Chandler. Contact was made with both
involved parties who engaged in a physical altercation with one another. Officers determined
they were going to arrest Letita Jenkins for assault- domestic violence and disorderly conduct-
domestic violence.

Officer Martinez #720 and Officer Pones #937 approached the female while she was lying on
her stomach on a mattress on the floor. Officer Pones informed her she was going to be arrested
at which time she turned and began to resist arrest, was non-compliant with commands, and
kicked Officer Martinez in the stomach. Officer Pones delivered an elbow strike to the females
face and commanded her to “stop, don’t kick”. Officers continued to give verbal commands and
gained control of the female’s arms where she was placed into handcuffs.

She was arrested for aggravated assault on a police officer, Assault-DV and Disorderly Conduct-
DV. Ms. Jenkins did not sustain any injuries from the elbow strike in the face. She was
transported to GCUHF for booking. The incident was captured on officer body worn camera.
