The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, May 24, 2023, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix, 
AZ 85003, with the following members present:  Clint Hickman, Chairman, District 4; Jack Sellers,

INVOCATION - INVOCACIÓN
Supervisor Gates introduced his guest, Assessor, Eddie Cook. He congratulated 
Assessor Cook for recently being selected to be part of the 2023 Flinn-Brown 
Fellowship, a nonpartisan Arizona Center Civic Leadership program. Assessor Cook 
came forward and initially offered condolences to the family of Lesley Kratz, former 
team member in the Assessor’s office, who passed away this past week. He then 
offered the invocation. 
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Assessor Cook led the Pledge of Allegiance to the flag.
Chairman Hickman spoke briefly about Lesley Kratz and her contributions to Maricopa 
County over the 30 years she worked at Maricopa County.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Kim Powell with Maricopa County Animal Care and Control introduced one-year-old, 
Squirt, a Terrier / Chihuahua mix. She said he is very playful and loving and walks well 
on a leash. Squirt is available at the West Shelter. For more information, go to 
Pets.Maricopa.gov.
Chairman Hickman asked the Clerk if there were any announcements or corrections to 
the agenda. The Clerk replied there were none.

TOM MANOS OUTSTANDING SERVICE AWARD
In April of 2016, the Maricopa County Board of Supervisors created the Tom Manos 
Outstanding Service Award to recognize the legacy of public service left by retired County 
Manager Tom Manos. This includes his ability to achieve consensus on the most tenuous of 
issues; his service on a local and state level in budget and finance; his tireless work on behalf 
of the homeless; his support of regulatory reform; and his unwavering commitment to 
improving the justice system through Smart Justice. (C-20-23-015-X-00)

Chairman Hickman called on County Manager, Jen Pokorski, to explain the Tom Manos 
Outstanding Service Award. Ms. Pokorski spoke about the history of this prestigious 
award and Tom Manos’ commitment to excellence in public service and this award has 
become his legacy.
 
Ms. Pokorski announced the recipient, Nicole Busser, Vector Control Lab Supervisor.  
Ms. Busser has been described as a generous and inclusive leader and a dedicated 
County employee for 17 years, having spent most of her time in the Medical Examiner’s 
office. Three years ago, she transferred to Environmental Services and Vector Control 
and stepped up in response to the first locally transmitted case of dengue in November 
and December 2022.
Ms. Busser came forward to speak. She said thank you and she was honored to be 
nominated for this award, knowing that Maricopa County is full of good candidates. Ms. 
Busser stated she was humbled to be the recipient. She thanked her home-family and 
her work-family for coming out to support her today and she introduced the family and 
friends in attendance. Chairman Hickman asked the Board and guests to come forward 
for pictures in front of the dais.

Site Location:  Generally located between the alignments of Courthouse Road on the north, 
Southern Avenue on the south, Harquahala Valley Road on the west and 491st Avenue on 
the east.
Commission Recommendation:  On 4/20/23, the Commission voted 7-0 to adopt a motion 
recommending the Board of Supervisors approve Z2022214 subject to conditions ‘a’ – ‘u’:
a. Development of the site shall be in substantial conformance with the Legal Description 
entitled “Legal Description”, consisting of 4 pages, stamped received February 23, 2023, 
except as modified by the following conditions.
 
b. Development of the site shall be in substantial conformance with the Site Plan entitled 
“Harquahala Sun II Site Plan” consisting of 17 full-size sheets, dated April 11, 2023, and 
stamped received April 11, 2023, except as modified by the following conditions. The Plan 
of Development may be amended administratively under separate application as long as the 
amendment complies with the established IUPD development standards as approved by the 
Board of Supervisors. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the site plan will 
be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
c. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Harquahala Sun II”, consisting of 13 pages, dated March 3, 2023, and stamped 
received March 21, 2023, except as modified by the following conditions.
d. The following IND-2 IUPD Zoning District standards shall apply: 
1. Max. Electric Transmission Line Height: 140’
2. Parking Spaces Required: None required
3. Pavement: Pavement not required for parking spaces with an approved dust control plan 
by Maricopa County Air Quality Control
4. Loading and Unloading Spaces: No loading and unloading spaces required
5. Landscaping: No landscaping setback required
6. Screening: Min. 6’ chain-link fence required along perimeter of site; fence shall be setback 
a min. of 10’ from the property boundaries of any abutting rural or residential zoned property 
boundaries internal to the area of the zone change
7. Sight Visibility Triangles (SVT): SVT’s waived at project site entry/exit points, section line 
and midsection line intersecting alignments
8. Article 902.9.1: All utility uses permitted outdoors, except that inverters and transformers 
shall be setback 300’ from existing residences; other outdoor private infrastructure shall be 
set back a min. of 10’ from the fenceline located within 10’ any abutting rural or residential 
zoned property boundaries internal to the area of the zone change
e. The following Planning Engineering conditions shall apply:
 
1. On-site retention basins must be designed to contain overflows/spillways designed to 
accommodate the unattenuated peak 100 year inflow to each respective basin, inclusive of 
offsite flows.

2. Detailed grading and drainage plans must be submitted with building permit application(s) 
indicating that runoff from each solar field area will be directed to a retention basin.
3. Any reduction in the 100 year, 2hr. retention volume requirement will require approval of 
a Drainage Waiver. The waiver application is a separate application and must demonstrate 
that there will be no increase in runoff from the site as a result of the proposed development. 
At a minimum, the first flush volume of runoff must be retained. The Drainage Waiver is a 
separate application must be approved prior to issuance of building permit(s).
4. Existing contour lines must be annotated on the plans submitted for building permit(s).
5. Any buildings located in a floodplain must be elevated to the RFE or otherwise 
floodproofed.
6. Disturbance to floodplains will require a floodplain use permit (issued concurrent with 
building permit(s) by PND).retention basins shall drain within 36 hours per County 
requirements.
7. The gen-tie line will require an FCD issued R/W permit where it crosses FCD encumbered 
properties (i.e. Saddleback FRS/Diversion Channel), prior to issuance of a building permit(s) 
involving this work.
8. Preservation of R/W is required as shown on the approved plans.
9. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
10. Based on the conceptual design nature of the information submitted, changes to the site 
layout and/or a reduction in the number of solar arrays or BESS may be necessitated by the 
final engineering design of the site’s drainage infrastructure.
f. The IUPD overlay is applied to restrict the use of the site. IND-2 IUPD shall limit the use of 
the site exclusively to a solar electric generating facility including ancillary offices, ancillary 
uses and existing agricultural uses.  Any other site uses shall require a Zone Change Major 
Amendment.  
g. The Owner or Developer shall implement the construction best practices as guaranteed 
in the e-mail communication between Arizona Game and Fish Department (AZGFD) and 
Copia Power on February 6, 2023.  The Zoning Inspector and/or their designee shall review 
whether these best practices are being implemented in accordance with the e-mail following 
the issuance of relevant permits and periodically as needed through either the inspection 
process or communication with AZGFD.  Should the Zoning Inspector and/or their designee 
decide that the Owner or Developer has not substantially undertaken these best practices in 
good faith, the Owner or Developer shall not receive a final permit and certificate of 
occupancy until the best practices are implemented.
h. The Developer shall conduct a Class II Cultural Resources Survey as per the comments 
from the Arizona State Historic Preservation Office (AZSHPO) included in the e-mail dated 
April 11, 2023 prior to issuance of construction permits unless otherwise coordinated with 
AZSHPO.  Prior to the Cultural Resources Survey, the Developer shall send a map and 
sampling strategy to AZSHPO for approval.  Additionally, the Cultural Resources Survey

shall include 100 percent survey coverage in and around washes including Centennial Wash 
and its tributaries as depicted on historical topographical maps and historic aerial imagery. 
The remainder of the site shall be sample surveyed using larger transect spaces as 
necessary and smaller transect widths where cultural resources have been identified in 
sample areas. 
i. Development of APN#506-29-025A for utilities uses shall void the Agricultural Exemption 
on the parcel.
j. The Plan of Development shall maintain and illustrate an approximately one (1) acre 
development exclusion area directly east of the boundaries of APN#506-29-031C 
approximately 140’ running from north to south and approximately 330’ running from east to 
west.
k. The developer shall provide at least five-days notice to rural or residential zoned privately-
owned parcels internal to the area of the zone change of heavy construction traffic and 
disruption beyond incidental disruption to any easement providing those owners with direct 
access to their properties.  An appropriate detour shall be provided to these owners.
l. The developer shall reasonably repair any damage to easements that provide direct access 
to rural or residential zoned privately-owned parcels internal to the area of the zone change 
upon completion of use of the easements for heavy construction traffic and shall abate dust 
during the construction.  If use of the easements is intermittent, then easements shall be 
repaired following the cessation of the period in which the construction traffic is occurring.
m. Two palm trees located south of the boundaries of APN#506-29-031C as illustrated on 
the Plan of Development shall be left untouched from site development.  
n. At the time of application for building permits, plans shall indicate construction of paved 
shoulders along the intersection of and extend through Salome Hwy and the frontage road 
(Harquahala Valley Road) south of eastbound ramps within ADOT ROW. Work shall also 
include replacement of the top 2" of the roadway surface and re-striping at this location. Work 
within ADOT right-of-way shall require a permit from ADOT. Timing of improvements shall 
be coordinated with ADOT prior to the start of work and the extent of the work shall be limited 
to the illustration in the e-mail dated Thursday, March 30, 2023 between Kimley-Horn and 
ADOT.
o. All outdoor lighting shall be in compliance with Section 1112 of the Maricopa County 
Zoning Ordinance.
p. Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
q. In the event that Harquahala Sun II, in whole or in part, is constructed and ceases 
operating for a period of five years or more, the Owner shall be responsible for 
decommissioning the non-operating portion of the site and for the regrading and restoration 
of the site.  Decommissioning of the site shall include the removal of all structures above and 
under the ground (up to 3 feet) that are not a part of, or provide utility to, other operating 
portions of the site.  The Owner shall be responsible for reporting any areas decommissioned 
to Staff and either converting the site to other uses permitted in condition ‘f’ of Z2022214 or 
otherwise Staff may present the CPA and Zoning to the Board of Supervisors for 
consideration of reversion within five years.  All decommissioning and restoration activities

will adhere to the requirements of the appropriate governing authorities, and will be in 
accordance with all applicable, federal, state and Maricopa County regulations. 
Decommissioning removal requirements may also be amended and amount of time to 
decommission extended, if warranted, by the Zoning Inspector or his or her designee.  The 
Owner shall inform any future buyers/property owners of this decommissioning requirement 
and of their responsibility to decommission.
r. Amendments to the zone change shall be processed as a revised application in 
accordance with Maricopa County Zoning Ordinance requirements. 
s. Noncompliance with the conditions of approval will be treated as a violation in accordance 
with the Maricopa County Zoning Ordinance, and may be grounds for further action, including 
zoning revocation, by the Maricopa County Board of Supervisors.
t. Non-compliance with the regulations administered by the Maricopa County Environmental 
Services Department, Maricopa County Department of Transportation, Drainage Review 
Division, Planning and Development Department, or the Flood Control District of Maricopa 
County may be grounds for initiating a revocation of this Zone Change as set forth in the 
Maricopa County Zoning Ordinance.
u. The granting of this Zone Change has been at the request of the applicant, with the 
consent of the landowner.  The granting of this approval allows the property owner to enjoy 
uses in excess of those permitted by the land use existing on the date of the application, 
subject to conditions.  In the event of the failure to comply with any condition of approval, the 
property shall change to the land use designation that existed on the date of the application. 
It is, therefore, stipulated and agreed that revocation due to the failure to comply with any 
conditions does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in the value of the property 
from the value it held on the date of application due to such revocation.  The Zone Change 
enhances the value of the property above its value as of the date the Zone Change is granted 
and changing to the prior land use designation results in the same value of the property as 
if the Zone Change had never been granted. (C-44-23-245-X-00)

a. Development of the site shall be in conformance with the Zoning Exhibit entitled “411th 
Ave and I-10 Zoning Exhibit“, consisting of 1 page, dated January 19, 2023, and stamped 
received February 15, 2023, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Project Narrative”, consisting of 8 pages, dated February 15, 2023, and stamped 
received February 15, 2023, except as modified by the following conditions.
c. Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to issuance 
of a building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to 
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction 
review and approval will be required.
d. The following Planning Engineering conditions shall apply:
 
1. Without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to number of proposed buildings, site layout, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement.
2. A traffic impact study must be submitted with future entitlement (POD) application(s).
3. Right-of-way dedication (TBD along 411th Ave.; and 40’ along the northern and eastern 
tract boundaries) may be required as part of future entitlement(s) (POD).
4. Compliance with any ADOT requirements is required.
5. Disturbance to floodplains (FEMA Zone A) will require procurement of a floodplain use 
permit concurrent with required building permit(s).

6. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction.
e. The CUPD overlay is applied to restrict the use of the site. The C-3 CUPD zoning district 
shall limit the use of the site to automobile service only, equipment rentals and sales, but not 
including equipment customarily used for heavy construction; Landscape material sales 
provided all incidental equipment and supplies, including fertilizer and empty cans, are kept 
within a completely enclosed building or within an area enclosed on all sides by a solid fence 
or wall at least six feet in height, and no goods, materials or objects are stacked higher than 
the fence or so erected; Commercial storage of mobile and  manufactured homes, travel 
trailers, recreational vehicles and boats; Truck stops, with customary accessory facilities 
including restaurant, gasoline service stations, convenience retail, truck-wash, and minor 
repair facilities provided all incidental repair work is conducted wholly within a completely 
enclosed building and space required for such repair work does not constitute more than 
60% of the floor area; Drive-thru restaurants and refreshment stands; Feed stores, inside 
storage only; Gas (butane or propane), retail sales of; Restaurants and cafes, including 
patios, cocktail lounges, and outside dining and drinking areas; Self-storage facilities; 
Accessory buildings and uses customarily incidental to the above uses including a solar field 
providing energy exclusively to a truck stop and its customary accessory facilities. Until such 
time as the site is served by sewer and water, of the uses permitted, the uses on site shall 
only be those acceptable to the Maricopa County Environmental Services Department 
(MCESD) that can be accommodated by septic and well. A public water system and 
wastewater treatment shall be required prior to establishment of any use that requires 
potable water.
f. The developer shall address all requirements of ADOT as per the e-mail dated March 1, 
2023 prior to issuance of construction permits.
g. The Owner or Developer shall address all recommendations of the Arizona Game and 
Fish Department (AZGFD) included in the letter dated March 10, 2023, prior to issuance of 
the initial construction permit.  
h. All outdoor lighting shall be designed as recommended by the International Dark-Sky 
Association and shall be in compliance with Section 1112 of the Maricopa County Zoning 
Ordinance.
i. Prior to issuance of the initial building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
j. Amendments to the zone change shall be processed as a revised application in accordance 
with Maricopa County Zoning Ordinance requirements. 
k. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and 
ARS § 11-814 for six (6) years within which time a Plan of Development and initial 
construction permit must be obtained.

2022, and terminates on June 30, 2023. 
ACJC Victim Compensation Grant funding is recurring. 
The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35% or 
$41,571 for the additional funding.
The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect 
cost is $41,571. Non-recoverable indirect costs will be covered by the departmental general 
fund budget. There is no requirement for matching funds. The original grant was competitive 
and does not require ongoing cash contributions after the grant period's end date. Grant 
revenues are not “local revenues” for the purpose of the constitutional expenditure limitation,

ARIZONA DEPARTMENT OF EDUCATION
Approve the application for and acceptance of $172,272 for the Title III Consortium grant 
from the Arizona Department of Education (ADE). This grant is a federal entitlement grant 
that provides funds for the support of students who are learning the English language. These

funds also support instructors who teach classes for students who are learning the English 
language. The Maricopa County School Superintendent’s Office (MCSSO) serves as the 
fiscal agent for this consortium as the districts, by federal law, must have a consortium when 
their federal allocation is less than $10,000 a year. There are 19 school districts or charter 
schools that are part of the Consortium in fiscal year 2023. The term of this grant is for one 
year, July 1, 2022, to June 30, 2023. Authorize the Chairman to sign all documents related 
to these grant funds, as applicable.
The grant award is reoccurring and has been awarded to the Office in previous years. The 
cash or in-kind match is not applicable. MCSSO’s indirect cost rate for fiscal year 2023 is 
0.45 percent. Total indirect costs on this award are $0 as all the monies are a pass through 
to the Consortium members. The estimated unallowable indirect costs are $775. Ongoing 
cash contributions not applicable. The grant award is non-competitive and an entitlement 
grant from the federal government. There are no costs that will need to be absorbed by the 
department’s operating budget.
As a result of this funding and pursuant to A.R.S. §42-17106(B), approve an adjustment to 
the FY2023 County School Superintendent (D370) Schools Grants Fund (715) Operating 
(OPER) revenues and expenditures budget in the amount of $51,276.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

FUNDING FROM THE ARIZONA GAME AND FISH COMMISSION FOR LAW 
ENFORCEMENT BOATING ACTIVITIES GY23
Approve a Collection Agreement between the Arizona Game and Fish Department and the 
Maricopa County Sheriff’s Office (MCSO).  This agreement is effective upon signature by all 
Parties (estimated to be May 25, 2023) and shall expire on June 30, 2024.   Also approve 
the acceptance of $4,000 in funding to the MCSO. 
This funding is designated solely to ensure emergency medical services (“EMS”) and critical 
incident response capabilities and will be used for the purchase of Taylor-Made Life Rings 
(24”/orange) for distribution to MCSO deputies for their patrol vehicles.
This is the second time MCSO has received this funding.  The award is non-competitive and 
non-recurring. Indirect cost recovery is not allowed. The Sheriff’s indirect cost rate for FY23 
is 12.30% applicable to the award amount of $4,000. There are no capital expenses, for an 
indirect cost base of $4,000 and indirect costs of $492.00 to be absorbed by the General 
Fund. There is no match requirement and there are no future or ongoing contributions 
required after the grant period ends; however, there is an expectation to continue patrolling 
Maricopa County waterways if the funding from the State was to end. This funding supports 
MCSO mandated activities of enforcing statutory watercraft Law and Regulations and 
preventing accidents, injuries, and deaths on the Arizona waterways.

Number PSN-23-005 in the amount of $21,999 for the award period beginning retroactively 
on March 31, 2023 and terminating on September 30, 2023. This Agreement may be 
terminated by any of the parties by written notice to the other parties thirty (30) business

and indirect costs of $2,705.88.  Indirect costs are unallowable by the terms of this

Approve a Competition Impracticable (CI) with Omnigo Corporation DBA QueTel in the 
amount of $452,428 for ongoing support and maintenance of TraQ software system.  Omnigo 
DBA QueTel is the creator of the TraQ software system and is the only authorized vendor 
that can provide software support and system upgrades for this system. The MCSO Property 
Management Division (PMD) has been using this system for tracking inventory for eight 
years. Authorize Office of Procurement Services to sign Master Service Agreement (MSA)

Department (MCAQD) in the not-to-exceed amount of $872,692.00.  The purpose of this 
agreement is to fund the continued implementation of the Maricopa County Travel Reduction 
Program (TRP). This agreement is effective July 1, 2023, to June 30, 2024. 
An amount of up to $175,000.00 will be passed through to the Regional Public Transportation 
Authority as an external service provider upon separate agenda and approval for services 
provided between July 1, 2023, and June 30, 2024. 
This item has been budgeted and approved by the Board of Supervisors with the adoption 
of the FY2024 MCAQD budget. Grant revenues are not local revenues for the purpose of 
the constitutional expenditure limitation, and therefore expenditures of these revenues are 
not prohibited by the budget law. 
The grant award is reoccurring and has been awarded to MCAQD in previous years. The 
cash or in-kind match is not applicable. Indirect cost is fully recoverable. MCAQD's FY2024 
indirect cost rate is 35.34%. All indirect costs are allowable and fully recoverable. Indirect 
costs will be applied to the MCAQD retained amount of $697,692.00. The total direct costs 
are $515,510.00 and recoverable indirect costs are $182,182.00.
Future ongoing cash contributions are not required after the grant period. Per Arizona 
Revised Statutes (ARS) §49-581 et seq., the TRP is a mandated function of MCAQD. The 
grant award is non-competitive - not applicable. There are no costs that will need to be

Approve an agreement between Dogtree Pines Senior Dog Sanctuary and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care 
and Control estimates ten (10) New Hope transfers annually, for a total of $520.00 per year, 
over the term of the agreement. The term of this agreement shall commence upon approval

Approve an agreement between Intensive Treatment Systems of Arizona (ITS) and Maricopa 
County to address joint training needs.
The purpose of this Agreement is to establish a program to increase access to Medication 
Assisted Treatment (“MAT”), Opioid Use Disorder (“OUD”) recovery support services, and 
opioid prevention awareness for incarcerated patients transitioning to the community.
This Agreement shall begin upon approval by both parties and shall terminate one year 
thereafter unless otherwise terminated or amended as provided herein. By mutual written 
amendment executed by the Parties’ authorized representatives, this Agreement may be 
extended for supplemental periods of twelve (12) months, up to maximum of forty-eight (48)

AFFAIRS - REVISED AMOUNT
Approve and accept grant funds from Arizona Department of Emergency and Military Affairs, 
Grant No.  EMF-2022-EP-00009-S01, CFDA # 97.042 in the updated amount of 
$1,230,921.45. These grants are for emergency planning within Maricopa County. The grant 
award begins on July 1, 2022 and ends June 30, 2023. Authorize the Chairman to sign all 
documents related to these grant funds, as applicable. The reduction of the grant award is 
due to the reduction in the indirect cost plan. The Department will be recovering the allowable 
10%  de minumus rate based on the total direct charges, which totals $229,617.88.
The grant award is reoccurring and has been awarded to the department for the past thirty 
(30) plus years. The department has a match requirement of $1,230,921.45. during the grant 
award period, the match for this grant comes from the General Fund (100-D150-1510), Palo 
Verde (100-D150-1510), and the Intergovernmental Agreements (100-D150-1510-CTIGA). 
Maricopa County does not have to fund any additional costs for the program. The grant 
award is a mandated function for emergency preparedness through the Robert T. Safford 
Act. This grant provides funds for recipients to build and maintain emergency management 
programs at the state and local level. This grant award is non-competitive and all counties in 
the state are eligible to apply for funds to support their Emergency Management Programs.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This

ARIZONA SELF-INSURED BENEFITS TRUST FUND
Approve and adopt the Restated and Revised Declaration of Trust for Maricopa County, 
Arizona Self-Insured Benefits Trust Fund (3rd amendment). The revisions to the Declaration 
of Trust would amend the prior declaration of trust in the areas summarized on Exhibit A.
The proposed revision to section 5.3 of the Trust Document clarifies acceptance of the 
County’s past practice of using contracted actuary/consultant with requisite license to satisfy 
Title 20, Chapter 2, Articles 3 and 9 of the Arizona Revised Statutes. Exhibit A is a redlined 
version of the Restated and Revised Declaration of Trust (3rd amendment). Exhibit B is the

Approve Amendment No. 3 to the financial Intergovernmental Agreement (Agreement) with 
Arizona Department of Economic Security (DES) (DI21-002283) and Maricopa County, 
administered by its Human Services Department. The purpose of the Amendment is to 
increase the Workforce Innovation and Opportunity Act Title I (WIOA) Fiscal Year (FY) 2023 
Dislocated Worker (DW) funding. DES will provide $3,814 DW Administration and $34,327 
DW, the total funding increase is $38,141. The Agreement reimbursement ceiling is now 
increased from $55,990,746 to $56,028,887.
The Amendment shall become effective on the date of last signature. The Agreement term 
is July 1, 2020, through June 30, 2025.
DES contracts with the County for WIOA activities on an annual reoccurring, non-competitive 
basis.

Approve non-financial Amendment No. 1 to the Contract with Mercy Housing Mountain 
Plains (MHMP) 19 Glendale Senior Apartments LLLP, an Arizona Limited Liability Limited 
Partnership (“Contractor” or “Developer”) under Serial 220166 RFP for Affordable Housing 
Development Opportunities. 
The purpose of the Amendment is to amend administrative portions of the agreement and 
adjust the structure of the Agreement accordingly.
The summary of changes include throughout the document, minor grammatical errors have 
been changed (e.g., articles, etc.), and address the following: 
1. Section 6.0 Department of Housing replaced with Human Services Department

MARICOPA COUNTY RURAL AND UNINCORPORATED WATER & WASTEWATER 
INFRASTRUCTURE PROGRAM
Maricopa County has established the Rural and Unincorporated Water and Wastewater 
Infrastructure Program (Program) to support water and wastewater infrastructure for 
communities that have been disproportionately affected by the COVID-19 pandemic. This 
Program is focused on improving the overall health and safety of residents in these rural 
areas by addressing the health and safety needs related to water and wastewater in low- to 
moderate-income multi-family properties.  
The Program is a voluntary, first-come, first-served application-based program for eligible 
property owners. In order to assist with the successful implementation of the Program, 
approval of the following items, agreement templates or substantially similar, and the 
following actions is requested:
1. Request approval of draft Property Owner Agreement and Deed of Trust, to be finalized 
when projects are identified. The Human Services Department will process agreements with 
multi-family Property Owners for water and/or wastewater improvements to their properties. 
Request authorization for the Chairman to sign Agreements and documents for full 
execution.  
2. Contracts with Civil Engineering Firms selected by the Direct Select Procurement Process, 
as defined by Arizona Revised Statutes, to design the scope of work for the identified 
properties to remediate water and sewer deficiencies. The Maricopa County Chief 
Procurement Officer or designee will execute the agreements on behalf of the County with 
the selected Civil Engineering Firms in an amount not-to-exceed $500,000 per contract. 
3. Task Orders to complete scopes of work to remediate water and sewer deficiencies 
identified by the Civil Engineering firms will be issued to construction firms selected through 
the quote process identified in Environmental Services Contract # 200217 ITN. If the County 
is not able to obtain services under the Environmental Services Contract or another County 
contract, the County will secure the services under other approved procurement methods 
within the Maricopa County Procurement Code. 
Funding for these Agreements shall be provided by American Rescue Plan Act, Coronavirus 
State and Local Fiscal Recovery Funds under ALN 21,027. The total funds to be expended 
through these Agreements shall not exceed $5,000,000.
The Human Services Department will process all documents for legal review prior to

The purpose of the Agreement is to expand daytime heat relief services in the Tempe area. 
The Subrecipient shall provide an indoor cooling station (the “Project") to principally serve 
people experiencing homelessness but may also serve other vulnerable populations at risk

Economic Security (DES) (DI23-002395) and Maricopa County, administered by its Human 
Services Department. The purpose of the Agreement is for the County to administer Housing 
Support Services in Maricopa County by providing assistance to individuals/families:
• In obtaining permanent housing for those who are experiencing homelessness, 
• To provide Emergency Shelter for the individuals and households while permanent housing 
options are located.
DES will provide the County with $1,445,832 consisting of $722,916 in U.S. Department of 
Housing and Urban Development (HUD) Emergency Solutions Grants (ESG), and $722,916 
from Temporary Assistance for Needy Families (TANF), Social Services Block Grant 
(SSBG), Lottery, State Homeless funds, and additional funding sources as may be available.
The Agreement term shall begin July 1, 2023, through June 30, 2024. 
DES provided this Agreement through a non-competitive basis. Funding is a first-time 
occurrence.

Services Department (“County”), and UMOM Housing 9, LLC, an Arizona limited liability 
company, (“Contractor” or “Developer”). The County and the Contractor are collectively 
referred to here as the “Parties” and individually as a “Party.”
The purpose of the Contract is for the Contractor to expand housing availability by 
constructing a 96-unit rental housing community to be located at 3101 W. McDowell Rd., 
Phoenix, AZ 85009 (the “Property”). Following U.S. Department of the Treasury guidance, 
HSD exercised its ability to allocate ARPA funds to the development project to be completed 
by UMOM.

Approve the permanent addition of one vehicle to the Maricopa County Department of Public 
Health (MCDPH) Fleet.  The Office of Vital Registration (OVR) is requesting to add one fleet 
vehicle to allow for the ever-demanding need of onsite field training of its various partners 
and stakeholders who share a mandated role in the vital records process.  OVR requests 
the new purchase of a mid-size sedan.  The approximate cost of the vehicle is $32,584.04. 
It will be garaged at the Maricopa County Office of Vital Registration-Central Valley, 3221 N. 
16th St., 100, Phoenix, AZ  85016.  
The OVR uses vehicles to sustain its field programs that support hundreds of funeral 
establishments, licensed healthcare facilities and educational institution’s training and

FOR COVID-19 VACCINATIONS
Approve Amendment 1 to the cost reimbursement Intergovernmental Agreement (IGA), 
CTR062177, between ADHS and Maricopa County by and through its Department of Public 
Health (MCDPH), Office of Community Wellness and Health Promotion, provides funding for 
the COVID-19 Vaccinations. The IGA provides vaccines to children and adults in accordance 
with recommendations of the CDC Advisory Committee on Immunization Practices (ACIP), 
prevents and controls Vaccine-Preventable Diseases (VPD).  
It is mutually agreed that the referenced IGA is amended as fellow:

(MCDPH) Health, Office of Oral Health Dental Sealant Program for dental sealant services 
for the students. This amendment extends the term for one year to begin July 1, 2023 and 
end June 30, 2024. All other terms and conditions of the original IGA shall remain in full force 
until terminated by either party. This amendment is for the final year of the 5-year term.  
The purpose of this IGA is to continue cooperation between MCDPH and Dysart Unified 
School District to provide dental sealants to eligible students for the prevention of tooth 
decay. School-based dental sealant programs are evidence-based and provide a safe, 
inexpensive model for delivering sealants to school-age children. Dental sealants are best-

The budget period is in the not exceed amount of $1,555,368.77 for the budget period 
starting October 1, 2022 and ending on September 30, 2023. This is the second year of the 
five-year term that began on January 14, 2021 and ending on January 13, 2027. 
The amendment also serves to revise and replace the Contract, Section 5.1 Amendment, 
Purchase Orders and Change Orders, the Price Sheet. All other provisions of the agreement

The NFP MIECHV IGA award is reoccurring and has been awarded to the Public Health 
Department for many years. This grant does not require an in-kind match, indirect cost is 
fully recoverable and ongoing cash contributions are not required. The IGA award is not a 
mandated function but provides a benefit to the citizens of Maricopa County by providing 
evidence-based home visiting models to communities identified to be at risk. The award is 
competitive. 
MCDPH’s Indirect Rate for FY23 is 17.24 %.  The indirect costs are estimated at $228,715.09 
which are fully recoverable. Departmental indirect rates are reestablished at the beginning 
of each fiscal year and the future indirect rates will be collected at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. 
This Amendment does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted 
as necessary to accommodate this grant through a future reconciliation.  Funding for this

Approve Intergovernmental Agreement (IGA) CTR064828 for the HIV Prevention Program 
between Arizona Department of Health Services (ADHS) and Maricopa County by and 
through its Department of Public Health (MCDPH) to provide grant funding for the HIV 
Prevention Services. Previous contract (IGA ADHS18-188819) put this program to $280,000, 
this new contract breaks this program out and adds an additional funding of $43,000 and 
brings the not-to-exceed amount is 323,000 for the budget period January 1, 2023 through 
December 31, 2023.  The IGA term is January 1, 2023 through December 31, 2028.
The grant award is reoccurring and has been awarded to the department in previous years. 
It is non-competitive and there is no cash or in-kind match required.  The grant award is a 
mandated function; should it be discontinued, it is not known whether on-going contributions 
would be required.
This grant deviates from County Policy A2505 and does not allow for any indirect cost 
reimbursement.    The Department of Public Health’s indirect rate for FY2023 is 17.24% . 
Total indirect expenses based on the award are estimated to be $7,413.20 of which none is 
recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal 
year and the future indirect rates will be collected at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This

The HIS grant award is reoccurring and has been awarded to the department in previous 
years.  This competitive grant does not require an in-kind match, indirect cost is fully 
recoverable, and ongoing cash contributions are not required.  Healthy Start services are not 
a mandated function but provide benefit to the citizens in perinatal case management 
services, health education events and learning opportunities, and community referrals to 
women and their families in Maricopa County.  All program costs are allocated to the grant 
so there will be no additional burden on the department’s operating budget.

limitation, and therefore, expenditure of the revenues is not prohibited by the budget law.

This is not a mandated service but provides a benefit to the citizens by improving the 
effectiveness of local government implementation of culturally appropriate, evidence-based 
health literacy strategies to vulnerable populations disproportionately impacted by COVID-

RYAN WHITE PART A PLANNING COUNCIL REFLECTIVENESS ROSTER
Approve the Reflectiveness Roster for the Ryan White Part A Planning Council requested 
by Health Services and Resources Administration (HRSA). 
Each year, the Maricopa County Ryan White program is required to report compliance with 
legislative requirements regarding membership representation on the Planning Council. 
These requirements include ensuring that Planning Council is comprised of a minimum of 
33% unaffiliated consumers of Ryan White services and that each membership category is 
represented on the Council. 
A new requirement this year states that a signature by the Chief Elected Official (CEO) or 
designee is required if any membership categories are vacant. Currently, the Planning 
Council has one legislatively mandated vacancy for the State Medicaid Agency 
Representative position. 
The Ryan White program has attempted multiple times over the past five years through direct 
contact with Medicaid and through partner connections at the State to engage Medicaid on 
the Council. In March 2023, Medicaid informed our office that they do not have the capacity 
for ongoing participation or membership on the council. Their representative has agreed, 
however, to present at up to two (2) Planning Council meetings this year that will cover

TEACHER POWERED SCHOOL NETWORK
Approve an Agreement with The Edison School of Innovation (charter school) for the purpose 
of providing participation in the Maricopa County Teacher Powered School Network 
(“MCTPSN” or “The Network”). The agreement shall become effective upon execution by the 
last signer and shall expire on September 30, 2024.
The MCTPSN is designed to address the recruitment and retention crisis in Arizona through 
the strengthening of strategies, practices, and structures that have been correlated with low 
teacher turnover. The Parties agree to cooperate and assist each other as they explore ways 
to strengthen collaborative practices, elevate teacher voice, and create a regional TPS 
network.
Funding for the MCTPSN is provided by the Arizona Department of Education through an 
ESSER LEA Capacity Building Support Grant.

Chairman Hickman asked the Clerk if there was anything to report regarding Public 
Comment email responses. The Clerk said there were no email responses received. 
The Clerk said she had two speaker slips received: one from Dianne Barker and one 
from Blue Crowley.
Dianne Barker, resident, talked about the Regional Area Road Fund and how it relates 
to air quality. She stated she would be going to the Maricopa Association of 
Government (MAG) meeting today. They are looking at the passage of proposition 400 
in the legislature and the disagreements that are related to that. She talked briefly about 
the history of transit in the valley and asked the Board to consider where we have come 
from and where are we going.
Blue Crowley, resident, talked about the Regional Public Transportation Authority and 
how they do not allow the public to comment on the election of officers, or on matters 
of salary. He stated the board talks about light rail but not about buses.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Gallardo commented on the upcoming three-day weekend for County 
employees. He said graduation season is upon us. He stated Water Days are coming 
in June and that event helps introduce citizens to services available in Maricopa County. 
He said thank you to the Maricopa County staff that help with that event. He mentioned 
some new summer programs in which Maricopa County is partnering with Cartwright 
Elementary and Phoenix Union to offer kids activities during the summer break.
Supervisor Sellers attended a variety of meetings and events:

the Azcend Eggs Benefit breakfast with CEO, Trinity Donovan.

the Board meeting for the I-11 Coalition.

he met with Tempe Mayor Cory Woods to discuss affordable housing. 

the East Valley Partnership Advocacy Group to discuss Proposition 400.

he met with Queen Creek Mayor Julia Wheatley to discuss growth in that area. 

he and Supervisor Gates joined the Recorder for a media tour of MCTEC 
which generated a lot of good questions and full answers.

he attended a lunch meeting with Senator Mark Kelly yesterday and learned 
about Telemechanic jobs that would be valuable in the US. 
He said he had many productive meetings. Chairman Hickman said he admires the 
amount of ground that Supervisor Sellers covers, gathering information and sharing it 
with the Board.
Supervisor Galvin congratulated Nicole Busser and extended his condolences to Lesley 
Kratz’s family and friends. He said he attended the Greater Phoenix Economic Council 
(GPEC) board meeting. They discussed economic development of the Phoenix area 
and the work of the Legislature and Governor’s office. He attended the Valley 
Partnership Breakfast and County Manager, Jen Pokorski was one of the panelists 
representing Maricopa County. He closed by wishing everyone a safe Memorial Day 
weekend and remember to honor those who sacrificed.
Supervisor Gates echoed his colleagues’ comments to enjoy the Memorial Day 
weekend. He said his family will be celebrating their daughter’s college graduation and 
he is grateful for the education system in Arizona. In closing, he mentioned the MCTEC

tour he and Supervisor Sellers attended and believes that experience would be valuable 
for every citizen to have.
Chairman Hickman reminded everyone to please be careful this holiday weekend. He 
also acknowledged an Arizona Republic reporter, Sasha Hupka, and thanked the 
Republic for taking the time to cover Maricopa County. Chairman Hickman thanked his 
staff for the diligent work that went into the budget this year, addressing the needs of 
Maricopa County and its residents.

GRANT-IN-AID FROM THE ARIZONA STATE LIBRARY, ARCHIVES AND PUBLIC 
RECORDS
Approve the application and acceptance of grant funds from the Arizona State Library, 
Archives and Public Records in the amount not to exceed $25,000 for the purpose of 
professional development of staff and providing access to digital resources for customers. 
The grant award begins July 1, 2022 and ends on June 30, 2023.  Authorize the Chairman 
to sign all documents related to these grant funds as applicable.  The Library District indirect 
rate for FY23 is 7.93%.  Total grant indirect costs are estimated to be $1,982.50 and are not 
recoverable.  The grant award is reoccurring and has been awarded to the Library District in 
previous years.  The Library District does not have an in-kind match, or ongoing contributions 
requirement.  The grant award is not a mandated function, but provides a benefit to the 
citizens by training staff and allowing access to resources to better meet the needs of the 
Library District customers.  The grant award is competitively bid, or non-competitive – not 
applicable.  There are no costs that will need to be absorbed by the Library District’s
