Meeting Minutes Public Safety Police Personnel Retirement Board Regular Meeting February 5, 2025 | 9:00 a.m. Council Chambers Conference Room 88 E Chicago St., Chandler, AZ Call to Order The meeting was called to order by Chairperson Turner at 9:04 a.m. Roll Call Board Attendance Staff Attendance Chairperson Steven Turner Nichole Bombard, Medical Leave Coord. Regular Meeting Minutes of Wednesday, January 8, 2025 Consent Agenda Motion and Vote Citizen Member Remington moved to approve the meeting minutes of the Chandler Local Police Public Safety Personnel Retirement Board Regular Meeting on January 8, 2025; Seconded Citizen Member Crawford. Motion carried unanimously (3-0). Executive Session - Pursuant to A.R.S. Section 38-431.03 (A), the Chandler Local Police Public Safety Personnel Retirement Board may vote to convene in executive session to discuss or consider confidential records exempt by law from public inspection, and/or to consult with the Board’s attorney for legal advice and to consider the Board’s position and to instruct the Board’s attorney regarding its position on the following items. The Board will take action on those items in open session. Page of 2 4 Action Agenda Item No. 2 and Discussion 2. Application for Accidental Disability Mulliken Consideration, Discussion, and Appropriate Action regarding the Application for an Accidental Disability for William Mulliken. Mr. Mulliken and his attorney Steve Serbalik were present Executive Session – Citizen Member Crawford made the motion to end the Open Session and to move into Executive Session; Citizen Member Remington seconded the motion, and the vote was unanimous to end the Open Session and move into Executive Session at 9:05 a.m. Open Session – Chairperson Turner made the motion to end the Executive Session and move into Open Session; Citizen Member Crawford seconded the motion, and the vote was unanimous to end the Executive Session and move into Open Session at 9:28 a.m. Mr. Serbalik addressed the board he thanked the board for taking the time to consider the application. After review of the report, they are disappointed the report makes it sound like Mr. Mulliken could somehow perform the duties of a police officer although the city has decided based upon the medical information received from the treating physician that Mr. Mulliken can no longer be a sworn member of the Chandler Police Department. Mr. Serbalik asked the Board to consider options of requesting more information from the treating provider or requesting a new IME rather than denying his application. Chairperson Turner thanked Mr. Mulliken for everything that he has done not only with his service to the community, but also being patient with the Board through the process. Chairperson Turner stated the application looked like it was heading in a certain direction but given the fact that the roles and responsibilities in the statutes the Board must follow based on PSPRS rules and procedures. He stated this application is hard for him on many levels, but this is a process that we are going to have to follow at this point in time. Citizen Member Remington stated she is not a doctor, and the Board needs to follow the IME doctor opinion and to deviate from that would be inconsistent. Citizen Member Crawford thanked Mr. Mulliken for his service, and he appreciates everything he has done for the Chandler Police Department. Based upon the IME and being consistent the Board is limited on options and as previously stated we have to adhere to the IME and to deviate from that could present issues for the Board. Action Agenda Item No. 2 Motion and Vote Citizen Member Remington moved to deny of the Application for an Accidental Disability for William Mulliken, based on the medical board opinion of Dr. Anthony Theiler, as set forth in the report and PSPRS Questionnaire dated October 29, 2024, and January 14, 2025. The applicant’s condition did not result in the permanent inability to return to work as a police officer and there is no conflict in the medical evidence based on the review of the records and the evaluation performed by Dr. Theiler. The motion was seconded by Citizen Member Crawford. Motion carried unanimously (3-0). Page of 3 4 Action Agenda Item No. 3 and Discussion 3. Application for Accidental Disability Wiley Consideration, Discussion, and Appropriate Action regarding the Application for an Accidental Disability for Paul Wiley. Mr. Apodaca requested that Ms. Bombard discuss the job application processes, status, and where is stalled. Ms. Bombard stated she received a message from the background investigator, Charles Kirkham in PSS: Mr. Wiley applied for the Chandler Police Department on November 22, 2023, for the position of lateral police officer. On November 24, 2024, Mr. Wiley was sent a notice to submit an AZPOST PH form by the deadline of December 1, 2023. Mr. Wiley failed to submit the form and was disqualified from the process for Fail - Unable to Contact. He did not have a background check performed and was not formally disqualified and thus did not receive a letter of disqualification. Citizen Member Crawford stated based upon that we have been working on this process for some time and the fact that Mr. Wiley has failed to follow through, although he has been given ample opportunity to complete this process, made his decision terminate his accidental disability. Citizen Member Remington stated it doesn't appear that that he has made a good attempt to actually follow through on his application. Therefore, the Board couldn't determine to offer a job or not. Chairperson Turner wants to echo those comments. Mr. Wiley didn’t complete the process to apply to be a police officer and other circumstances that we've become aware of may lead to future inability to qualify for a position with the Police Department. Action Agenda Item No. 3 Motion and Vote Citizen Member Crawford moved to terminate the accidental disability pension for Paul Wiley based upon his failure to successfully complete the Police Officer application process as reported by Chandler Police Department PSS Division. The motion was seconded by Citizen Member Remington; Motion carried unanimously (3-0). Action Agenda Item No. 4 and Discussion 4. Membership Termination Price, Jaroszewski Pereira, and Martinoz Consideration, Discussion, and appropriate Action regarding the termination of PSPRS membership for Eric Price and Thiago Jaroszewski Pereira, and Alex Martinoz. Action Agenda Item No. 4 Motion and Vote Citizen Member Crawford moved to terminate the PSPRS membership for Eric Price, Police Officer – Lateral Certified, effective January 13, 2025; Thiago Jaroszewski Pereira, Police Officer – Lateral Certified, effective January 1, 2025; and Alex Martinoz, Police Office, effective December 14, 2024. The motion was seconded by Citizen Member Remington. Motion carried unanimously (3-0). Member Comments/Announcements Page of 4 4 Calendar 5.
