RESOLUTION NO. 5894

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER,
ARIZONA, AUTHORIZING SUPPORT FOR A FOREIGN TRADE ZONE
DESIGNATION AND RELATED APPLICATION FOR THE CATALINA
COMPONENTS INCORPORATED FACILITY LOCATED AT 4105 S. MILKY
WAY AND 320 8. MCCLINTOCK DRIVE, AND APPROVING RELATED
INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF PHOENIX.

WHEREAS, Catalina Components Incorporated (“Catalina”) manufactures and assembles
components for the global automotive industry, and operates from two adjacent properties at 4015
W. Milky Way and 320 S. McClintock Drive, in Chandler, Arizona (“Site”); and

WHEREAS, without receiving Foreign Trade Zone (“FTZ”) designation for the Site, Catalina and
its importer/exporter clients are put at a competitive disadvantage; and

WHEREAS, Chandler desires to support Catalina in applying for FTZ Operator status at the Site
under Foreign Trade Zone No. 75, provided that Catalina Components Incorporated agrees to not
pursue classification of any real or personal property at the Site as Class 6 to receive the beneficial
state tax treatment available to an activated FTZ Operator; and

WHEREAS, Catalina is agreeable to such limitation on state tax treatment; and

WHEREAS, the City of Phoenix has received a grant from the federal Foreign-Trade Zones Board
to establish Foreign Trade Zone No. 75 and Chandler does not have any such grant of authority;
and

WHEREAS, Phoenix is willing to submit an application to the Foreign-Trade Zones Board on
behalf of Catalina for the property at the Site to be established, operated and maintained as a
foreign-trade zone usage-driven site; and

WHEREAS, A.R.S. § 11-952 authorizes Chandler and Phoenix to enter into an intergovernmental
agreement memorializing their agreement to work together to establish a FTZ designation for the

Site.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chandler, Arizona,
as follows:

Section 1. Authorizing the City of Chandler’s support of a Foreign Trade Zone designation
for the Catalina Components Incorporated facility located at 4015 W. Milky Way
and 320 8. McClintock Drive, in Chandler, Arizona.

Section 2. Authorizing the City of Chandler’s support of Catalina Components Incorporated’s
application for FTZ Operator status under FTZ No. 75.

Section 3. Approving the Intergovernmental Agreement between the City of Chandler and the
City of Phoenix attached as Exhibit “A” and authorizing the Mayor to execute the
agreement on behalf of the City of Chandler.
