Resolution No. 5913, Ordering and Calling a Special Election for the Submission of Proposed
Amendments to the City Charter Clarifying Term Limits for Councilmembers and Mayor
Move City Council pass and adopt Resolution No. 5913, ordering and calling a special
election for November 4, 2025, for the submission of proposed amendments to Article II,
Section 2.01 of the City Charter clarifying term limits for Councilmembers and Mayor;
directing publications as required by law; designating the place and time to accept
arguments for and against the question; establishing the conduct of elections including
ballot tabulation requirements; authorizing an agreement for services with the County and
payment of election expenditures; setting forth the voter registration deadline and Voter
Rights Act requirements; designating the election as an all-mail ballot election; establishing
canvassing and reporting requirements; and including a severability and ratification clause.
MAYOR HARTKE said these items are to review and consider a path forward with potential
amendments to the city charter in preparation for the election scheduled in November 2025 and

beyond. The Chandler city charter originally was adopted by voters in 1965 and it serves as the
foundation of the city government. The charter is a document that defines the city’s structures,
powers of elected officials, and how Chandler operates as a local government, like any
foundational document it must be regularly reviewed and thoughtfully updated to reflect the
evolution, growth, and modern needs of our community. Over the past six decades, Chandler has
grown from a small farming community that was beginning to urbanize into a dynamic, diverse,
and modern city of nearly 300,000 residents. Responsibilities have expanded, technology has
advanced, and the expectations of residents has evolved over time: however, much of the charter
language is same as when it was originally adopted. Some language could be outdated or
ambiguous due to modern circumstances, which is why it is vital to ensure the charter continues
to serve the needs of Chandler today as well as for future generations. Updating the charter is not
about political gain or rewriting history, it is meant to adapt what is outdated. This task must be
approached with accountability, and Chandler’s responsibility is to give Chandler voters the
opportunity to consider meaningful and well-reviewed changes that enhance transparency,
efficiency, and good governance.
MAYOR HARTKE explained the second item tonight is to consider the formation of a City Charter
Amendment Resident Advisory Committee consisting of nine Chandler residents with diverse
perspectives to conduct a comprehensive review of the charter and recommend future changes
that Council may consider placing on a future ballot. This is not in conflict with the first item for
calling a special election for the submission of proposed amendments to the city charter clarifying
term limits for councilmembers and mayor. Council has recommended individuals who are
actively and positively engaged in the community for the committee.
MAYOR HARTKE said the first item was tabled from a previous meeting. Council is entrusted with
ensuring the language is clean, fair, and ready for voter consideration. He shared confidence that
through constructive collaboration and responsible leadership these tasks will be completed with
integrity. He reminded residents that any ballot items approved by Council will be ultimately
considered by Chandler voters. The city’s role is to steward the recommendation process with
integrity and ensure what reaches voters reflects thoughtful input, community values, and sound
governance. By working together, Chandler can continue to honor its past, address the present,
and prepare Chandler for a strong and responsive future.

• Current Charter Language
o (Passed in its current form General Election 1996/Special Election 1997)
o (e) Limitation of terms. No person shall be eligible to be elected to the office of
councilmember for more than two (2) consecutive terms, or to the office of
mayor for more than two (2) consecutive terms or to more than a consecutive
combination of same. A person elected to two (2) consecutive terms as a
councilmember or two (2) consecutive terms as mayor or a combination of same
as above set forth shall not be eligible to hold either office again until four (4)
years have elapsed. Councilmembers or mayor[s] who resign shall not be eligible
for re-election or appointment until the second succeeding City election following the
date of tender of their written resignation, except as provided in subsection 2.06(c).
For determining consecutive terms for an incumbent Mayor, if the incumbent Mayor
has been elected to two (2) consecutive two-year terms as of November 6, 2012,
those two (2) two-year terms shall be considered the equivalent of one (1) four-year
term, for purposes of determining this section. All incumbent councilmembers and
the Mayor holding office on May 19, 1997, shall be limited to the number of terms of
office authorized on that date by this Charter, unless there is a Charter amendment
approved setting forth that incumbent councilmembers and mayor are eligible for
election to additional terms.

• How did we get here?
o The Mayor expressed interest in running for Council Member after completing two
mayoral terms.

o Article II – CITY COUNCIL
o (Additions show in ALL CAPS, deletions shown in strikethrough)
o Section 2.01.- Composition, eligibility, terms and election
o (a) Composition. There shall be a City Council consisting of a mayor and six
councilmen COUNCILMEMBERS elected from the city at large by the qualified
electors of the city. The term councilman or councilmen COUNCILMEMBERS shall
include the mayor except where the mayor is specifically mentioned.
• Draft Charter Amendment
o (b) Eligibility. Only qualified electors of the city shall be eligible to hold the office of
mayor or councilman COUNCILMEMBER. Each candidate must have been a resident

of the city or an annexed area for at least two years immediately preceding his
election.
o (c) Term of Councilmembers. The term of office of councilmembers shall commence
at the first regular meeting of the City Council in January following their election and,

o (d) Term of mayor. The term of office of mayor shall commence at the first regular
meeting of the City Council in January following the mayor's election and shall be for
a period of four (4) years or until the mayor's successor is elected and qualified.

YEARS HAVE ELAPSED SINCE THE END OF THE LAST TERM SERVED AS
COUNCILMEMBER, EXCEPT AS PROVIDED IN SUBSECTION 2.06(C).
o (2) NO PERSON SHALL BE ELIGIBLE TO BE ELECTED OT THE OFFICE OF MAYOR FOR
MORE THAN TWO (2) CONSECUTIVE TERMS. A PERSON WHO IS ELECTED TO TWO
(2) CONSECUTIVE TERMS AS MAYOR SHALL NOT BE ELIGIBLE TO HOLD THE
OFFICE OF MAYOR AGAIN UNTIL FOUR (4) YEARS HAVE ELAPSED SINCE THE END
OF THE LAST TERM SERVED AS MAYOR EXCEPT AS PROVIDED IN SUBSECTION
2.06(C).
o (3) NO PERSON SHALL BE ELIGIBLE TO BE ELECTED TO THE OFFICE OF
COUNCILMEMBER OR MAYOR AFTER SERVING SIXTEEN (16) CONSECUTIVE YEARS

SINCE THE END OF THE LAST TERM SERVED, EXCEPT AS PROVIDED IN

o (4) NO PERSON WHO HAS SERVED TWO (2) FOUR-YEAR TERMS AS
COUNCILMEMBER FOLLOWED BY A BREAK IN SERVICE OF TWO YEARS OR LESS
AND TWO (2) FOUR-YEAR TERMS AS MAYOR SHALL BE ELIGIBLE TO HOLD THE
OFFICE OF MAYOR OR COUNCILMEMBER UNTIL AT LEAST FOUR (4) YEARS HAVE
ELAPSED SINCE THE END OF THE LAST TERM SERVED, EXCEPT AS PROVIDED IN
SUBSECTION 2.06(C). {NEW CLARIFICATION}

held in each even numbered years as provided in article VII of this Charter.
▪ (G) Incumbents. If additional terms for the office of mayor are approved by the
voters, incumbent councilmembers and the mayor holding office on May 19,
1997 are eligible for election to such additional terms.

MAYOR HARTKE called for public comment.
BETH BRIZEL, 6130 W. Shannon St. Chandler, AZ, shared support for Resolution No. 5913.
Residents would like this clarified to avoid confusion and stop expensive litigation. Chandler has
a history of councilmembers running for mayor, many voters have voted for mayors with past
councilmember experience. It is beneficial for the mayor to have served on Council for experience.
Chandler voters have supported keeping term limits at total of sixteen years. Adding this proposal
to the November 2025 election is fiscally responsible and gives the voters the opportunity to have
the charter clarified as soon as possible.
RAQUEL ARMSTRONG, 222 W. Boston St. Chandler, AZ, said information presented at this meeting
clarified concerns and thanked Council and city staff.
MARCIA WEISS, 2743 E. Redwood Pl. Chandler, AZ, requested Council vote no on Resolution No.
5913 to allow staff to review findings and take a thoughtful approach to charter amendments
rather than including this question with bond questions already set for the November election.
RUTH JONES, 2734 E. Birchwood Pl. Chandler, AZ, requested Council vote no on Resolution No.
5913. Chandler voters at previous elections have upheld the existing term limits to honor the idea
that no person should hold power for an extended period of time. Council should consider the
wishes and intents of residents and voters when making choices.
LESLIE MINKUS, 3372 E. Gemini Ct. Chandler, AZ, wanted to hear from Council why they’re making
the decision to make this vote.
RICK HEUMANN, 4310 W. Dublin St. Chandler, AZ, shared the initial intent by previous Councils in
previous Charter amendments was not intended to limit anything other than going from council
to mayor. He thanked staff for their work to clarify this language.
LAN LECOUR, 1069 E. Senate Cir. Chandler, AZ, shared support for Resolution No. 5913 in clarifying
the charter language.
MARTIN SEPULVEDA, 891 N. Madrid Ln. Chandler, AZ, shared support for Resolution No. 5913. He
spoke about the 1997 charter election to change term limits which considered updates for
relevancy and resident input.
COUNCILMEMBER HARRIS asked Mr. Sepulveda what the time period was that he had served on
Chandler City Council and asked for more context of the 1997 charter change.
MR. SEPULVEDA said he had served on Chandler City Council from 1996-2000 and then in 2004-
2008, nonconsecutively. He spoke about the historical context of the time and about the
importance of being involved in local government partnerships. One thing that contributed to the

conversation in 1997 was how mayors with shorter term limits had trouble with having standing
to make decisions for the community especially in regional partnerships where funds may be
distributed to different municipalities. There have been other attempts to increase term limits that
citizens have voted to not approve.
COUNCILMEMBER HARRIS asked if the intention was to create stability in someone moving from
the councilmember role to mayor and allowing their terms to be set for two terms, eight years, to
ensure stability in the region.
MR. SEPULVEDA said the councilmember terms were not changed, the change was for the mayor
to serve up to four two-year terms, increasing it from what it was of originally two two-year terms.
This was needed to have stability and presence in regional and national organizations for
leadership.
COUNCILMEMBER HAWKINS asked where resident engagement played a role in these prior
charter amendment discussions.
MR. SEPULVEDA explained that it was an issue initiated from the dais, but residents were able to
give input before the election. The question did go to the voters. Council’s responsibility is to make
decisions and refer it to voters.
SHERRI JOHNSON, 3627 E. Agave Rd. Chandler, AZ, shared support for Resolution No. 5913 and
thanked Council for reviewing this item again to honor the original intent of Chandler voters for
term limits and emphasized the importance of having this question on the November 2025
election.
STEVEN VANKLAMPENBERG, 4375 S. Melody Chandler, AZ, shared support for Resolution No. 5913
and clarifying charter language.
COUNCILMEMBER HAWKINS asked about the number of other charter changes suggested for
consideration.
JOSHUA WRIGHT, City Manager, said that there are a number of items in the charter suggested for
improvements, it depends on Council direction. Some are to change language to reflect modern
terminology, while some are to bring Chandler to best practices and standards in local
government. These decisions would come to Council and ultimately to voters.
MICHELLE DALY, 1710 E. Redwood Pl. Chandler, AZ, shared support for Resolution No. 5913 and
thanked Council and staff for the clarifications made.

COUNCILMEMBER HARRIS thanked Council and staff for their work on clarifying language and
thanked the community for providing thoughtful input.
COUNCILMEMBER ENCINAS said many residents have provided input on this item. He shared this
item is upholding the historical precedence of Chandler and shared that attention to this issue is
of importance to address questions and demonstrate mature leadership.
VICE MAYOR ELLIS thanked residents for sharing their input. She spoke about the importance of
doing the right thing and reviewing resident input and deciding what is best for the people of
Chandler.
MAYOR HARTKE thanked former councilmembers for sharing their perspectives. The role of
mayor requires experience for not only serving Chandler, but serving in regional, statewide, and
national organizations to better local governments. He thanked city staff for their support in
preparing this item.
Action Agenda Motion and Vote
Councilmember Encinas moved to pass and adopt Resolution No. 5913, ordering and calling a
special election for November 4, 2025, for the submission of proposed amendments to the City
Charter clarifying term limits for councilmembers and mayor; directing publications as required
by law; designating the place and time to accept arguments for and against the question;
establishing the conduct of elections including ballot tabulation requirements; authorizing an
agreement for services with the county and payment of election expenditures; setting forth the
voter registration deadline and Voter Rights Act requirements; designating the election as an all-
mail ballot election; establishing canvassing and reporting requirements; and including a
severability and ratification clause as amended to add a new subsection; and to amend the
proposed Section (e)(5) of the resolution to read:
COUNCILMEMBERS WHO RESIGN FOR ANY REASON OTHER THAN TO RUN FOR MAYOR AS
REQUIRED UNDER STATE LAW AND THIS CHARTER AND MAYORS WHO RESIGN SHALL NOT BE
ELIGIBLE FOR RE-ELECTION OR APPOINTMENT UNTIL THE SECOND SUCCEEDING CITY ELECTION
FOLLOWING THE DATE OF TENDER OF THEIR WRITTEN RESIGNATION, EXCEPT AS PROVIDED IN
SUBSECTION 2.06(C), with directions to staff to make all conforming changes necessary before
transmitting the resolution to Maricopa County for placement on the November 4, 2025 ballot;
Seconded by Vice Mayor Ellis.
Motion carried by majority (6-1), Councilmember Hawkins dissenting.

Move City Council tentatively adopt Ordinance No. 5132, forming a City Charter
Amendment Resident Advisory Committee, to review and identify potential amendments
to the City's Charter.
MAYOR HARTKE spoke about item 2, the introduction and tentative adoption of Ordinance No.
5132, forming a City Charter Amendment Resident Advisory Committee. The proposal is to form
a nine-member committee to do a deeper dive on charter language, whether it be clean up or
clarifying ideas. If this ordinance is approved, meetings for the committee will be held where
members of the public are welcome. The committee will have the opportunity to engage with the
charter document deeply and then bring their findings to Council for a potential future charter
election.
COUNCILMEMBER HARRIS said it is important for residents to review the charter and get involved.
COUNCILMEMBER ORLANDO commented on the importance in the continual review of the
charter document by residents.

Councilmember Orlando moved to tentatively adopt Ordinance No. 5132, forming a City Charter
Amendment Resident Advisory Committee, to review and identify potential amendments to the
City's Charter; Seconded by Councilmember Poston.
Motion carried unanimously (7-0).

I write again as a long-time Chandler voter in support of this effort to put clarifying the
term limit issue on the November 2025 ballot. This election is already upcoming,
making the expense of another one wasteful and unnecessary. Moreover, litigation
challenging the currently ambiguous language is likely, which would be another
wasteful, unnecessary expense of taxpayer dollars. At the special meeting tonight,
please act to provide a process that is fair, consistent, and clear to Chandler voters.
Please vote to add this issue to the ballot. Thank you for your consideration.
