RESOLUTION NO. 5921 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING AMENDMENT NO. 1 TO CITY OF CHANDLER COMMUNICATION SERVICES LICENSE (CLASS 5) ISSUED TO BICENTEL, LLC FOR JOINT USE AND CONSTRUCTION OF TELECOMMUNICATION FACILITIES; AND APPROVING A JOINT USE AND CONSTRUCTION PROJECT WITH BICENTEL, LLC UNDER AMENDMENT NO. 1 FOR A NORTH CHANDLER SEGMENT OF THE CITY OF CHANDLER FIBER MASTER PLAN; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AMENDMENT NO. 1 AND ALL RELATED DOCUMENTS FOR PURPOSES OF THIS RESOLUTION. WHEREAS, the City of Chandler believes that it is in the City’s best interest to enter Amendment No. 1 to City of Chandler Communication Services License (Class 5) issued to Bicentel, LLC for Joint Use and Construction of Telecommunication Facilities (“Amendment No. 1”); and WHEREAS, the City of Chandler believes that it is in the City’s best interest to approve a joint use and construction project with Bicentel, LLC under Amendment No. 1 for a North Chandler segment of the City of Chandler Fiber Master Plan. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chandler, Arizona, as follows: Section 1. Approving Amendment No. 1 in the form attached hereto as Exhibit “A” and incorporated herein by reference. Section 2. Approving a joint use and construction project with Bicentel, LLC under Amendment No. 1 for a North Chandler segment of the City of Chandler Fiber Master Plan in an amount not to exceed THREE MILLION SEVENTY-FOUR THOUSAND ONE HUNDRED FORTY-ONE DOLLARS ($3,074,141.00). Section 3. Authorizing the City Manager or City Manager’s designee to execute Amendment No. 1 and all related documents for purposes of this Resolution.
