Meeting Minutes Public Safety Police Personnel Retirement Board Special Meeting July 23, 2025 | 9:00 a.m. Council Chambers Conference Room 88 E Chicago St., Chandler, AZ Call to Order The meeting was called to order by Chairperson Turner at 9:07 a.m. Roll Call Board Attendance Staff Attendance Citizen Member Valerie Remington Nichole Bombard, Medical Leave Coord. Police Member Elect Cassandra Ynclan Chairperson Steven Turner Others Present Andrew Apodaca, Board Attorney Absent Citizen Member Bill Crawford Executive Session - Pursuant to A.R.S. Section 38-431.03 (A), the Chandler Local Police Public Safety Personnel Retirement Board may vote to convene in executive session to discuss or consider confidential records exempt by law from public inspection, and/or to consult with the Board’s attorney for legal advice and to consider the Board’s position and to instruct the Board’s attorney regarding its position on the following items. The Board will take action on those items in open session. Action Agenda Item No. 1 and Discussion 1. Accidental Disability Application Wiley Consideration, Discussion, and Appropriate Action regarding the Application for an Accidental Disability for Paul Wiley. Mr. Paul Wiley and Ms. Kathryn Baillie are present for the proceedings. Modified Executive Session – Police Member Elect Werther made the motion to end the Open Session and to move into Modified Executive Session; Police Member Elect Ynclan seconded the motion, and the vote was unanimous to end the Open Session and move into Executive Session at 9:12 a.m. Page of 2 3 Open Session – Police Member Elect Werther made the motion to end the Modified Executive Session and move into Open Session; Police Member Elect Ynclan seconded the motion, and the vote was unanimous to end the Modified Executive Session and move into Open Session at 11:07 a.m. The Board took a Recess from 11:08 a.m. to 11:17 a.m. Executive Session – Police Member Elect Werther made the motion to end the Open Session and to move into Executive Session; Police Member Elect Ynclan seconded the motion, and the vote was unanimous to end the Open Session and move into Executive Session at 11:17 a.m. Open Session – Police Member Elect Werther made the motion to end the Executive Session and move into Open Session; Police Member Elect Ynclan seconded the motion, and the vote was unanimous to end the Modified Executive Session and move into Open Session at 12:05 p.m. Police Member Elect Werther stated having reviewed all the records provided, having heard all the testimony provided today, he has concerns with timeline and statements regarding the level of ability at times when Mr. Wiley was engaged in certain activities. That said, I also do take the point that a 15-minute exam, if that's true, which I cannot confirm it is, but I'll believe it is, is not what I want to base my decision upon. There is clearly more detail in this report provided from Dr. Steingart and details that I think I have to take seriously. And so that also factors into my decision-making. I would have liked to have seen more detail in Dr. Chang's IME addressing some of these concerns so that I could see both sides of the opinions on that. These are things that factor into my thinking as we go into making whatever motions and votes we're going to make. Police Member Elect Ynclan agrees with Police Member Elect Werther. The Board was provided with a lot of material prior to the meeting, there was some consistency through all of the different reports. It was clear that it seemed like none of the doctors had all of the records, and that was a little concerning to me. Mr. Wiley had referenced, the one exam was two hours, and the other exam was 15 minutes. Police Member Elect Ynclan’s point is if the Board is making a decision, she wants to be sure about what she’s reading and seeing and hearing from the doctors' reports. There is some information here that is lacking, and that's concerning her as far as some things that are subjective. But she thinks that the decision the board made previously based on the information they had was correct, but there's obviously more information that's here. And if she was going to make a decision, she wants to make it based on everything. And she doesn’t think everything is here, and that's concerning her. Citizen Member Remington stated she would have to agree with the Board member’s statements. When she was looking at the records, she was asking Mr. Wiley about some of the timelines and what doctors he saw and when it seemed like there is missing information, and perhaps the report the board had and was based on for the February meeting might not have been as complete as the current records. Page of 3 3 Chairperson Turner thanked the Board Members for their statements and agrees with a lot of what's been said. Chairperson Turner believes what Mr. Wiley is experiencing is a natural progression of the injury that was sustained in 2012 he thinks was the original date of injury. And in cases with this board in the past, he wants to make sure that the board has an abundance of information and that the board is not restricting medical information. That's something he’s stood by, and he wants to make decisions based on everything available. He does have some concerns about some of the reporting from the doctors. There's a lack of consistency, he has some questions regarding the physicians, and especially the position of the constable. He has always followed his gut and followed his instincts in these matters and wants to make sure that the decision the board makes today and the decision they make in the future is done with all the information. That IME doctors have all the information and are taking the time to review that information in a great detailed manner because it's what is due for our police officers and our firefighters and as someone who a steward of this board and a steward of the PSPRS system he only thinks it's right that they make sure that they have full context and our doctors have full context of everything that they have reviewed. Action Agenda Item No. 1 Motion and Vote Police Member Elect Werther moved to rescind the board's decision to terminate the accidental disability benefits for Mr. Paul Wiley and to reinstate the benefits retroactively to February 2025. The motion was seconded by Police Member Elect Ynclan. Motion carried unanimously (4-0). Police Member Elect Werther moved to table the matter pending a follow-up IME with a target IME time of August 2025, and furthermore that all pertinent medical records in the possession of Mr. Paul Wiley or his representatives be provided to the board before that IME. The motion was seconded by Police Member Elect Ynclan. Motion carried unanimously (4-0). Adjourn Police Member Elect Werther moved to adjourn the meeting; seconded by Police Member Elect Ynclan.
