ROLL CALL - LISTA The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 9:30 AM on Wednesday, March 1, 2023, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix, AZ 85003, with the following members present: Clint Hickman, Chairman, District 4; Jack Sellers, Vice Chairman, District 1; Thomas Galvin, Supervisor, District 2; Bill Gates, Supervisor, District 3; Steve Gallardo, Supervisor, District 5 (entered meeting late). Also present: Juanita Garza, Clerk; Joy Rich, County Manager; Andrea Cummings, Legal Counsel; Kelly Gardiner, Minutes Coordinator. 2. INVOCATION - INVOCACIÓN Supervisor Galvin introduced his guest, John Crane, the new Mayor of Carefree. Mayor Crane offered the invocation. 3. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Mayor Crane led the Pledge of Allegiance to the flag. Supervisor Galvin talked briefly about Mayor Crane’s previous role as Vice Mayor in Carefree and his being elected last year as Mayor. He also serves with Maricopa Association of Governments (MAG) - Economic Development, and the Maricopa County Parks and Recreation Advisory Commission. Mayor Crane spoke and thanked the Board. He said with a professional background in the semiconductor field, serving on MAG Economic Development has been enjoyable and is an exciting area at this time. Mayor Crane talked about Parks and Recreation, the great staff, the many volunteers, and the plans being made for 2030. He said it was great to see the public’s continued interest in the outdoors. 4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Kim Powell, representing Animal Care and Control, introduced Mulberry, an eight-year- old, 80-pound dog. Mulberry is easy-going yet has plenty of energy and is food motivated. Ms. Powell said the Bissell Empty the Shelter adoption event is going on at the shelter through March 6, and all adoption fees are waived for dogs over six months of age. Chairman Hickman asked the Clerk if there were any announcements or corrections to the agenda. The Clerk replied there were none. PRESENTATIONS - PRESENTACIÓNES 5. ED WINFIELD RETIREMENT Recognition of Ed Winfield, Chief Information Officer, for his years of service to Maricopa County (C-20-23-009-X-00) Formal Meeting Minutes 03/01/2023 Page 3 of 59 Joy Rich, County Manager, began the presentation and spoke highly of Ed Winfield. She said he came to Maricopa County with large-county IT Director experience and was the backbone of Maricopa County during COVID. Mr. Winfield has been customer service oriented, is a kind and humble leader and she thanked him for his service. ~ Supervisor Gallardo entered the meeting ~ Mr. Winfield spoke and said it was an honor to serve and it has been satisfying to work with a government that serves the people. He thanked the Board for their support. He acknowledged the many departments and people who work to serve the people of Maricopa County. He reviewed the many IT accomplishments that had taken place over the years which allowed County business to continue through the pandemic. He said this has been possible because the County embraced technology and promoted the Digital Initiative. Mr. Winfield said technology and customer service have been paramount over the past five years and added he was proud of his team and leaves with pride and optimism for the future of technology in Maricopa County. Supervisor Gates talked about the digital transformation that has taken place under Mr. Winfield’s leadership. The many technological accomplishments that were mentioned by Mr. Winfield reminded Supervisor Gates that implementation of the technology during COVID was vital for the County to continue to serve the citizens. He thanked Mr. Winfield for his dedication. Supervisor Galvin spoke about the positive impact that Mr. Winfield’s leadership and his team had on the Treasurer, the Recorder, and the Assessor, enabling them to continue to do their job during COVID. The advancement of technology is felt in all the departments, and he thanked Mr. Winfield for his service. Supervisor Gallardo thanked Mr. Winfield for all his great work. He was particularly appreciative of his work in supporting the school districts, using federal dollars to purchase Chrome books for under-privileged areas to help students get homework done. He mentioned the importance of the collaboration between County and schools by putting “hotspots” in various locations across the County, giving internet access to families in need. Supervisor Gallardo thanked Mr. Winfield for helping transform the County. Supervisor Sellers said he agreed with his colleagues’ comments and talked about how refreshing it is to hear the good things that have been accomplished. Chairman Hickman talked about the importance of technology in the County. He said as he listened to the many accomplishments that have happened over the years, they seemed to occur quickly and effortlessly. Chairman Hickman was glad to hear Mr. Winfield talk about his team, which indicated to the Chairman that OET is being left in good hands. The Board gathered in front of the dais for a picture. 6. DELIA BORUNDA RETIREMENT Recognition of Delia Borunda, Client Services Supervisor, Treasurer's Office, for 32 years of dedicated service to Maricopa County. (C-43-23-064-X-00) Supervisor Hickman asked John Allen, Treasurer, to come forward and introduce Delia Borunda, Client Services Manager, who has been with the County for 32 years. Formal Meeting Minutes 03/01/2023 Page 4 of 59 Treasurer Allen reviewed some of the history and changes in Maricopa County and the world during Ms. Borunda’s tenure at the County. Treasurer Allen said despite the many changes in the world, Ms. Borunda and her team have weathered the variety of situations that occur in public service. He said he was proud of her excellent work and thanked her for her service. Ms. Borunda said she has enjoyed her time working at Maricopa County and plans to spend time with her grandkids. The Board came down for a picture. 7. PROCLAMATION PUBLIC DEFENSE RECOGNITION WEEK Proclaim the week of March 13, 2023, as Public Defense Recognition Week. WHEREAS, March 18, 2023, marks the 60th anniversary of the United States Supreme Court’s decision in Gideon v. Wainwright; and WHEREAS, on March 18, 1963, the United States Supreme Court ruled in Gideon that the United States Constitution’s Sixth Amendment right to the assistance of counsel is essential to a fair trial, and requires the appointment of counsel for indigent defendants accused of felonies in state court; and WHEREAS, the Supreme Court recognized in Gideon that “. . . lawyers in criminal courts are necessities, not luxuries;” and WHEREAS, Maricopa County upholds and affirms the guarantee of the Sixth Amendment’s right to counsel, recognizing counsel as essential to the fairness of criminal proceedings; and WHEREAS, Maricopa County Public Defense Services’ attorneys and support staff continue to work tirelessly to provide essential, constitutionally-guaranteed legal services to those who would not otherwise have access to representation; and WHEREAS, Maricopa County Public Defense Services not only represents its clients but also upholds the rights set forth in the United States Constitution. NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors does hereby proclaim that the week of March 13, 2023, shall be recognized as “Public Defense Recognition Week” in appreciation of the essential role played by the attorneys and staff of Public Defense Services in upholding the Sixth Amendment guarantee of counsel and protecting the fundamental right to a fair trial. (C-56-23-006-X-00) Supervisor Hickman asked the Clerk to read the Proclamation Public Defense Recognition Week. The Clerk read the proclamation. A copy of the proclamation is on file with the Clerk of the Board's Office and retained in accordance with LAPR retention guidelines. Chairman Hickman talked about the importance of the Sixth Amendment particularly the right to counsel for the accused. Supervisor Gallardo thanked the Chairman for bringing this forward. He stated it is a right of every citizen to have defense regardless of economic status. Supervisor Gallardo said it is important for the County to have resources available in the Public Defender’s Office to handle these defense cases for those in need. Formal Meeting Minutes 03/01/2023 Page 5 of 59 Chairman Gates acknowledged the importance of Public Defense no matter what the economic circumstance is. He said the Board stands for the rights of all citizens and he was glad this proclamation has been brought forward. Supervisor Galvin agreed with his colleagues and talked about the history of defense and upholding the sixth amendment of the Constitution. He thanked the Public Defender’s office. Supervisor Hickman asked Rosemarie Pena, Director of Public Defense Services, to come forward. Ms. Pena thanked the Board for supporting Defense Services. She said through this proclamation, there is a statement being made that the Board supports the Constitutional rights that the Office of Public Defense’s office protects. The Public Defense team come forward to have a picture taken with the Board. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “101 & Northern: Zoning Exhibit “, consisting of 1 full-size sheet, dated December 7, 2022, and stamped received December 9, 2022, except as modified by the following conditions. In lieu of a pre-annexation service agreement, the developer must provide a ‘will serve’ letter from the certificated water and sewer provider, unless otherwise approved by Maricopa County Environmental Services Department. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the subject site. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. (C-44-23-098-X-00) Chairman Hickman asked Tom Ellsworth, Director of Planning and Development, and Darren Gerard, Planning Division Manager, to come forward. Chairman Hickman asked the Clerk if there were any registered speakers received for item 10. The Clerk said there was a comment-only in opposition from Kathleen Falcon. The applicant was available to speak if necessary and had a presentation. The following were speakers present in the auditorium in opposition: Melody Sandell, John Johnson, Jim Meadows, Roger Swagel, Ron Howard, Kim Howard, Stephen Nichols, and Michael Ady. Mr. Ellsworth reviewed the slide above and said the case noted was requesting a rezone to accommodate the future development of townhomes. He offered details on densities and other specifics of the proposed development. Formal Meeting Minutes 03/01/2023 Page 10 of 59 Mr. Ellsworth said this is within the municipal planning area for the City of Peoria and they have been notified but there has been no comment in favor or opposition. Mr. Ellsworth said the expressed concerns are the densities and the incompatibility with the surrounding rural area, increased traffic, noise and loss of property values. The Planning and Zoning Commission met on September 22, 2023 and unanimously approved this request. Chairman Hickman asked the applicant, Ashley Marsh, Gammage and Burnham, to come forward and asked how much time she thought she would need to present. She stated approximately eight minutes. Ms. Marsh thanked Planning and Development for preparing the robust overview of this case. Formal Meeting Minutes 03/01/2023 Page 11 of 59 Ms. Marsh used the slide above to highlight the importance of housing in the Greater Phoenix Area as cited by Economist, Elliott D. Pollack & Company. Ms. Marsh reviewed the above slide, showing the different land uses currently in the Peoria area. Formal Meeting Minutes 03/01/2023 Page 12 of 59 Ms. Marsh used the above slide to illustrate the need for multifamily housing, pointing out the proposed site that is outlined in red. Ms. Marsh reviewed the slide above as it showed a closer view of the proposed site, emphasizing the proximity to Thunderbird Road with medical offices and retail. She stated that the land is undeveloped but is in a corridor that is fully developed. Formal Meeting Minutes 03/01/2023 Page 13 of 59 Ms. Marsh reviewed the slide above that showed a variety of zoning in the area. She noted that immediately adjacent to the proposed site is a development that has a multifamily designation and allows for densities higher than what is being proposed for The Ville. Ms. Marsh used the above slide to talk about the site plan, unit size, traffic flow, built in buffers and the targeted occupant being young professionals. Formal Meeting Minutes 03/01/2023 Page 14 of 59 The Project Rendering slide was displayed to highlight the specific amenities. Ms. Marsh reviewed the New Conceptual Site Plan slide and discussed the revisions to address the stated concerns. One aspect she highlighted was reducing the number of units from 80 to 72, amounting to a 10% decrease in density. Formal Meeting Minutes 03/01/2023 Page 15 of 59 Ms. Marsh reviewed the above slide, Concerns Addressed, which showed the traffic flow changes and the additional parking. Ms. Marsh summarized the presentation, adding there was a Staff recommendation and an agreement on stipulations. Supervisor Hickman reviewed the speaker slips and invited those in opposition to consolidate their comments to total approximately eight minutes. John Johnson, resident of Weedville has a family history there. He expressed concerns about the impact that the project will have on the surrounding residents, his main concern was traffic in and out of the area. Formal Meeting Minutes 03/01/2023 Page 16 of 59 Jim Meadows, a resident in the area for 60 years, spoke on his concerns about additional traffic cutting through their neighborhood, the road surface durability and the people who will move into this rural setting. He said there is a drainage problem and no accommodation for irrigation. Chairman Hickman called on Roger Swagel who gave his time to Melody Sandell. . Ron and Kim Howard are residents in the area. Ms. Howard spoke and said their small dirt road borders the development. They are concerned about privacy and as they look outside their front door, they will be looking at the development. She said high density housing does not fit in the area and traffic and renters will be a problem. Mr. Howard reiterated the comments and concerns adding the added traffic will tear up the dirt roads that are maintained by the residents. Stephen Nichols, resident, said he is opposed to rezoning to multifamily and suggested single family rezoning. He said traffic and cut through is already a problem and this development will exacerbate the problem. Michael Ady, resident, and 3rd generation owner of the home that his grandpa homesteaded back in the 1940’s. Mr. Ady said he just sold his Glendale home to have this forever home where he wants to raise his kids. He said, just like his neighbors, he wants to keep the rural feel and does not feel safe with a multifamily complex in their backyard. Melody Sandell owns a home and property adjacent to the proposed development. Ms. Sandell was concerned that as a longtime landowner, contiguous with the proposed site, she has not received any notifications on this rezoning project. She said this is not the right place for this type of development. She stated Weedville is a wonderful rural town. Chairman Hickman asked Ms. Marsh to come forward. He mentioned the growth that is inevitable. He said he knows this proposed area well and does not feel good about this kind of development and asked Ms. Marsh to speak about what she would like him to consider. Ms. Marsh requested an indefinite continuance to consider the resident’s concerns and what other options may be available. Chairman Hickman asked about the definition of indefinite continuance. Mr. Ellsworth said an “indefinite continuance” would take it out of the notification process and would start all over in the future. Chairman Hickman reiterated that change and growth are coming and he appreciates the residents who desire to keep the area rural. He said there is potential for Peoria to come in and annex the area and then do whatever they want. Chairman Hickman said he wants to be a part of this development going forward and would like to support responsible development as much as possible. The adjacent area is currently under development for industrial uses requiring roadway improvements. These improvements require the deannexation of 32 feet along Sossaman Road to accommodate an arterial roadway. This deannexation will ensure the roadway is fully within unincorporated Maricopa County and reduce conflict of liability. The roadway improvements are a necessary improvement to the traveling public. The Board action will result to add 0.0019 square miles to County ownership and enable the County to assume responsibility for road maintenance. Financial Status: Cost of the roadway(s) development falls to the developer with no initial cost to Maricopa County. Cost of maintenance moving forward is typical of roadway maintenance cost and will be the responsibility of Maricopa County. The cost of roadway maintenance provides a benefit to the traveling public. Ms. Medaris said this is the first step in the process and allows proponents to gather signatures. Mike Reid spoke in opposition. Mr. Reid said he has maintained his pipes for years and is now wanting to change to desert landscape. He said he does not want to pay a tax, nor should his aging neighbors be forced to pay for something they will not be using. The grant award is for a mandated function as it goes to jail school education for 16-to-18- year old's already in County jail. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 28.82% or $19,597.60. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $19,597.60. The grant is awarded through the Arizona State Homeland Security Department- State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The targeted residences will be those occupied by seniors and non-ambulatory adults. The Home Box Program will offer a secure way for first responders to access homes when responding to elderly, chronically ill and homebound community members during emergency situations. This will allow the ability to expedite entry into a residence using a key rather than using forced entry methods. The City of Buckeye will provide small key vaults that will hold a single key and can be easily mounted near the door of homes. The Agreement amount is not-to-exceed $50,000 for the first year. Licensee shall provide County with base rent and shared operation costs associated with the operations of the facilities which are not considered revenue. The purpose of this Amendment No. 8 is as follows: A. Increase Licensee’s use of space in Facility 4 to total space of 1,308 SF. With the space increase the Licensee costs will also increase. Commencing March 1, 2023 through June 30, 2023 Licensee shall pay a monthly amount of $4,703 for base rent and $949 for shared operations costs. B. This Amendment extends the term of the Agreement as of July 1, 2023 through June 30, 2024. Licensee shall pay a monthly amount of $4,762 for base rent and $996 for shared operations costs for the extension term. APPLY FOR GRANT FUNDING OPPORTUNITY FROM CENTERS OF DISEASE CONTROL AND PREVENTION Approve MCDPH to apply for a Grant funding opportunity from the Centers for Disease Control (CDC) NOFO title “BOLD Public Health Programs to Address Alzheimer’s Disease and Related Dementias”. The anticipated funding and term date has yet to be determined. The estimated award date will be issued September 2023 with the final amount and terms. This is a competitive award, at this time, it has not been determined if it will be reoccurring. There is a cash or in-kind matching requirement of 30% during the cooperative agreement period. Match can be provided through additional funds by MCDPH and in-kind services. Should the agreement cease, ongoing contributions are not required. This grant allows for full indirect cost reimbursement. The indirect rate for (FY23) is 17.24%. Indirect costs are fully recoverable. The grant award is not a mandated function but provides a benefit to the citizens in Maricopa County by building an infrastructure and increase capacity in the field of Alzheimer’s Disease and related Dementia. Funding for this grant will be provided by Centers for Disease Control and Prevention. Chairman Hickman asked the Clerk if there was anything to report regarding Public Comment email responses. The Clerk said there were two emails regarding Animal Care and Control and those emails have been shared with the Board offices. The Clerk also reported there was one speaker form from David Berrey who would like to speak. Chairman Hickman asked Andrea Cummings, Legal Counsel, to review the Public Comment guidelines. David Berrey came forward and spoke about a concern he had regarding a 1956 dedicated easement formerly called Usery Pass that connected McDowell Road and Omega Street. Mr. Berrey talked about the historic secession of that property and believed the easement should be voided according to the law and the land should be returned to the public who is the beneficiary. Because of the limited time allotment, Mr. Berrey concluded that he hoped there could be some open communication on this subject. SUMMARY OF CURRENT EVENTS - EL RESUMEN DE TEMAS DE ACTUALIDAD 105. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Joy Rich thanked the Board for the opportunity on Monday to highlight the many departments of Maricopa County and the good work they do daily. Supervisor Gallardo highlighted recent outdoor activities including the Laveen Barbeque. He also talked about the upcoming Melrose Street Fair and the Tolleson Street Fair. Supervisor Gallardo said it is important to showcase the many things that Maricopa County has to offer. Supervisor Gates introduced and welcomed District 3’s recent staff addition, Carly Friday. He mentioned the state basketball championship, Boys AAAA coming up this weekend and the Regional High School Mock Trial is returning live having been on Zoom since 2020. This year the tournament returns to the Capital for live trials. Supervisor Gates reported, on a sad note, that Scott Seeley passed away. He talked briefly about Mr. Seeley and how grateful he was for his service to Maricopa County, highlighting his accomplishments. Supervisor Galvin spoke briefly about Scott Seeley and what an inspiration he was to Maricopa County. He said he and Recorder Richer were at ASU Law School with a Formal Meeting Minutes 03/01/2023 Page 56 of 59 Property Law class and said the future is bright with the law students coming out of law school. He concluded by mentioning an event he and his family were invited to at the Japanese Friendship Garden where he participated in a traditional Good Luck ceremony. Supervisor Sellers reiterated the positive comments from the Monday meeting that highlighted the accomplishments of Maricopa County. He said he attended a variety of State of the Town and State of the City events, the NaCO conference in Washington D.C., among many other civic activities. He talked about the variety of critical infrastructure group meetings he has attended since that is a necessary focus for Maricopa County. Chairman Hickman said he appreciated Todd Sanders with Greater Phoenix Chamber of Commerce reaching out and allowing him to sit on a panel with Stephen Richer regarding elections. Chairman Hickman said it was important to be on the radio and talk about how the whole election issue affected the Board. Chairman Hickman then touched on the recent meeting on Monday where the highlight was the many accomplishments of Maricopa County. He then compared the good work the County does with a recent hearing at the Legislature. He expressed his irritation with the legislators when they recently allowed an unvetted speaker to speak on the house floor. That speaker talked about conspiracy theories and Chairman Hickman stated it was irresponsible for the legislators to let that happen.
