This SUP, if approved, will remedy a zoning violation (V202100487) 
for running a commercial business on the property without proper 
zoning entitlement. There are no outstanding concerns from 
reviewing agencies. The site is designated as Neighborhood in the 
City of Chandler’s General Plan. Arguably, since the primary land 
use is designed to serve the adjacent residential neighborhoods 
makes this land use in concert with the intent of their general plan. 
The City of Chandler was notified and as of the writing of this report 
has no comments on this request.  
 
During the Commission Hearing, this item was removed from the 
Consent Agenda to the Regular Agenda due to opposition from an 
adjacent neighbor who spoke at the hearing. There is no other 
known opposition. Their concerns are inadequate site parking and 
stored items being taller than the screening walls. Site development 
will include a delineated parking area that will meet the required 
parking for the facility and conditions will be in place to limit the 
height of stored items to not exceed the fence height to not be 
visible from adjacent properties.

Recommendation: 
On 7/27/23, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve Z2022099 
subject to conditions ‘a’ – ‘m’:  
 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Potteryland – Special Use Permit“, consisting of two full-size sheets, dated May 17, 2023, 
and stamped received June 7, 2023, except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan. Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Potteryland”, consisting of five pages, dated May 17, 2023, and stamped received 
May 19, 2023, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards, and best practices at the time of 
application for construction. 
 
2. 
Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure. 
3. 
Detailed grading and drainage (site infrastructure) plans must be submitted with 
the application for Building Permits. 
 
4. 
At the time of application for the building permits, the grading and drainage plans 
must indicate that all on-site areas flow to a retention basin including the 
“uncapturable” area at the southwest driveway. 
 
5. 
Cooper Road will be annexed to be within the jurisdiction of the City of Chandler. 
The applicant will be responsible for coordinating with the City to review any traffic 
impact, 
right-of-way 
dedication, 
permitting, 
or 
roadway 
improvement 
requirements. 
 
6. 
Prior to the Drainage Review approval on the Building Permit, a Storm Water 
Pollution Prevention Permit (SWPPP) from the County will be required prior to the 
issuance of any construction permits. 
 
7. 
Prior to the Drainage Review approval on the building permit, a reduction factor for 
the material stored in Retention Basin A must be applied to the volume-provided 
calculations.  
 
8. 
Maximum side slopes for the retention basins shall be 4:1.

d. 
This special use permit is valid for a period of ten (10) years and shall expire on August 9, 
2033, or upon the termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use.  
 
e. 
Prior to occupying the existing residence or any portion thereof for any use associated 
with the special use permit, the applicant shall obtain a building permit to retrofit the 
existing residence to meet current commercial building code requirements as applicable 
and shall obtain a certificate of occupancy for the retrofitted building prior to occupancy.  
 
f. 
Any outdoor storage shall not exceed the height of the perimeter fencing.  
 
g. 
Parking areas and driveways shall be surfaced with decomposed granite to minimize dust 
pollution, excluding ADA-accessible parking area(s) which shall be paved. Any surfacing 
shall meet Maricopa County Air Quality regulations. 
 
h. 
There shall be a minimum street side yard of nine (9) feet measured from Cooper Road’s 
ultimate 65-foot half-width right-of-way.  
 
i. 
The north sight-visibility triangle of the north driveway shall have a dimension of 13 feet 
by 25 feet and shall not occupy any area of an adjacent property. 
 
j. 
Solid fences more than two (2) feet in height shall be allowed in a sight-visibility triangle 
but must be spaced a minimum of 11 feet away from a vehicular travel lane of Cooper Rd.  
 
k. 
Any outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural 
or residential zoning district.  
 
l. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating 
revocation of this special use permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
m. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special 
use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell, or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been 
granted.

Project Summary: 
 
1. 
The applicant is requesting a special use permit (SUP) for the interim industrial use of outdoor 
storage and sales of outdoor landscaping décor on a property in the Rural-43 zoning district. The 
property owner has been operating a business on the site specializing in large planter pots, 
fountains, and other decorative outdoor items for 20 years without proper entitlement. This SUP, 
if approved, will remedy a zoning violation (V202100487).   
 
2. 
The development would consist of the following:  
 
a. 
A 48,787 sq. ft. outdoor display area where various landscaping décor items are set up in 
rows.  
 
b. 
An existing former 1,850 sq. ft. former residence in the south part of the parcel that will 
only be used as an office and storage since the property owners will not reside on the site.  
 
c. 
A 3,737 sq. ft. existing barn in the north part of the lot that will be used for storage.  
 
d. 
A delivery driveway with one loading/unloading space along the north property line.  
 
e. 
One customer parking area adjacent to the south property line with ten parking spaces 
and one ADA-accessible parking space accessed by a single driveway to Cooper Rd. to 
the west. 
 
3. 
On April 21, 2021, the property owner was issued a notice and order to comply that confirmed the 
property was being used as a commercial business without entitlement and directed that the 
violation be corrected by June 23, 2021 or have the case heard in a civil hearing if the violation 
was not corrected. On May 17, 2022, the violation was heard by the hearing officer in a civil case. 
During this hearing, the property owner was issued a judgment to pay non-compliance fees, since 
this SUP was submitted on the day before the date of the hearing and the operation of the 
business continued up to the hearing date. The City of Chandler recently completed a major road 
project for Cooper Rd. adjacent to the site. In the redevelopment of Cooper Rd., Chandler built a 
new sidewalk with three driveway approaches to the property and six-foot-tall solid screening 
walls along the property’s western boundary. 
 
4. 
As part of this SUP request, the applicant is requesting the following development standards be 
applied:  
 
a. 
Allow for parking areas (excluding the ADA-accessible parking space) and driveways to 
be surfaced with a layer of decomposed granite in lieu of asphalt pavement to minimize 
dust control.   
 
b. 
Reduce the property’s street-side yard from 20 feet to nine feet along Cooper Road. This 
will accommodate the existing barn that was permitted when the ultimate half-width right-
of-way of Cooper Rd. was less than 65 feet.  
 
c. 
Reduce the north sight visibility triangle (SVT) dimension of the north driveway from 25 
feet by 25 feet to 13 feet by 25 feet since part of the SVT crosses onto the property to the 
north, along with an allowance in the SVTs to have solid walls more than two feet in height 
to accommodate the existing solid six-foot walls along the site’s western boundary.

d. 
Limit the height of items stored outdoors to not exceed the fence height, so that these 
items are not visible to adjacent residential properties.

Chandler 2016 General Plan (adopted April 14, 2016): The general plan designates the site as 
‘Neighborhoods,’ and the predominant land use in this category is residential; however, a variety 
of other uses are allowed based on location and other compatibility criteria.  
 
Public Participation Summary:

The applicant met minimum ordinance requirements for outreach with the posting of the property 
and the notification to all property owners of record within 300 feet of the subject site. Staff has 
not received any notice of opposition or support to the request.  
 
Outstanding Concerns from Reviewing Agencies:

There are no outstanding concerns from reviewing agencies. The City of Chandler was notified, 
and staff has not received any comments or concerns about this SUP request.  
 
Staff Analysis:

Staff supports this SUP request. The SUP will rectify a code violation for running a business on 
the site, which has been operating for 20 years and only had one neighbor complaint two years

ago. The approval of this SUP will have a minimal effect and will not impact the adjacent 
neighbors since this use has been ongoing for two decades. Additionally, the use of the site as 
an outdoor landscape storage/sales complies with Chandler’s General Plan designation of 
Neighborhoods by maintaining a rural residential character that keeps the existing home and barn 
on the property with land uses that serve the adjacent residential areas.  
 
12. 
The request to vary the underlying Rural-43 standards to accommodate an existing barn is 
reasonable since it would have met the residential accessory development standards and the 
previous ultimate street right-of-way was less than the current 65 feet. The request to waive the 
required paving for parking areas and driveways is reasonable since these spaces will be surfaced 
(excluding the ADA-accessible space) with a layer of decomposed granite to minimize dust 
pollution. The request to vary the SVTs is reasonable since these requests will have a limited 
effect on vehicular visibility since the existing six-foot tall walls are located 11 feet or more away 
from a vehicular travel lane of Cooper Rd. and the north SVT reduced dimensions will have a 
minimal effect since the north driveway will rarely be used. Per Maricopa County Zoning 
regulations, 10 years is the maximum length of time allowed for an interim industrial storage SUP.  
Arguably, placing a time limit for this SUP of ten years is justified because this will allow an 
opportunity to measure the land uses impact on the surrounding area and will allow the property 
owners time to operate the business before the SUP renewal period.  
 
Recommendation: 
 
13. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2022099 subject to the following conditions ‘a’ – ‘m’:

INTERPRETATIONS OF DRAWING AND SPECIFICATIONS

FOR CONVENIENCE SPECIFICATIONS HAVE BEEN PREPARED FOR THIS PROJECT IN A 
SEPARATE MANUAL, EXCEPT AS INDICATED, AND ARE ARRANGED IN A NUMBER OF

PURPOSE OF REQUEST 
The property at 23843 S. Cooper Rd. is requesting a Special Use Permit for an interim industrial that 
will offer retail sales of outdoor landscaping décor for a pottery retail business in the Rural-43 zoning 
district. The property is located 921’ South of Chandler Heights Blvd and S. Cooper Rd. The request 
will rectify a few issues. The first is to go through the proper procedure to allow this family-owned 
business to continue servicing this area as they have for the past 20 years. This would also be 
addressing an open violation (V202100487) for running a business without an entitlement. They also 
have been included in the S. Cooper Rd. paving plan by the City of Chandler. They are getting a new 
sidewalk installed along Cooper and new site walls along the backside of the sidewalk. (See appendix) 
They want to provide a paved parking lot for customers on the property. 
DESCRIPTION OF PROPOSAL 
Potteryland, LLC is a veteran operated specialty pottery business specializing in large planting pots, 
landscape/ outdoor decor, and fountains. They have been in business for the past 20 years at this 
location and have cultivated a strong customer following. They provide various designs, colors, and 
size options for planting pottery that appeal to local HOA neighborhoods and residences. Other outdoor 
décor is also available, and customers can peruse inventory. This is a very closely related to the rural 
feel of the area as this supports local nurseries to provide a variety of homes for plants. 
Recently, it was discovered that this type of use is not currently allowed per the Maricopa County 
zoning code. Owners are requesting a special use permit to continue serving the local area for all of 
their pottery/ landscape décor needs. 1301.1.22. Outdoor storage including wholesale and retail sales 
of landscape materials, storage rental yards, construction yards and similar, interim industrial uses for a 
period not exceeding ten years. 
The overall site plan is divided into 4 sections: 
Section 1 (parking lot): parking lot will be located at the south side inside the property. 10 regular 
parking spots with 1 ADA van parking located closest to the checkout area. There will be one entrance 
and one exit to Cooper Rd. There is an existing driveway that pulls up to the house on the property and 
to the additional parking area in the southern portion of the property. There is a loading and unloading 
space North of the storage barn. 
Section 2 (pottery display area): adjacent to the parking lot, there is an open area for various sized 
pottery with wide walkways for customers to browse for their desired planting pot or other outdoor 
decor. This area is roughly +/- 48,787 sf .  
Section 3 (house): the existing house on the property is currently being used as additional storage for 
items that need to be locked up during hours the business is closed. There is a small room that is used 
as an office for general business used solely by staff. There is no public access to the house. The 
owners will not be living in the residence, as they once did. 
Section 4 (storage barn): there is an existing storage barn on the property that is used for storage and 
sorting of incoming deliveries. There is no public access to this building. 
DELIVERY DRIVEWAY: There will be one driveway with delivery.  North of the property (parking lot 
entry off of S. Cooper rd.) That leads to the storage building. Deliveries will only take place during 
business hours.

ENVIRONMENTAL/NEIGHBORHOOD IMPACT: The impact to the environment is not changing. 
This facility has been in place for the past 20 years. The only major changes are to the parking area to 
be paved. The provided grading and drainage plan will be showing steps taken to accommodate. 
The impact to the neighborhood is minimal. There will be screening provided by the city of chandler in 
the form of new site walls along s. Cooper rd. There are already existing CMU walls (6'-0") around the 
north, east, and south sides of the property. The storage is never higher than the walls. This is a small 
family-owned business.

HOURS OF OPERATION/EMPLOYEES: our hour of operations change with the seasons but are 
never before 7 am or after 6 pm Monday through Sundays, closed major holidays. Two owners will

RELATIONSHIP TO SURROUNDING PROPERTIES 
The property is situated South of Chandler Heights with subdivisions and small neighborhoods located 
North of Chandler Heights as well as South and to the East. Centrally, located on S. Cooper Rd. and E. 
Via De Palmas there are more rural multi-acre lots to the west. There are a few businesses also located 
in the area that relate to the pottery being sold (i.e., Greenhouse Gardens). This is a great location to 
serve the surrounding area for all plant pottery needs. 
Pottery is a major revenue generator for rural/ small family-owned businesses. This is a way for the 
people living In the surrounding area to engage with an artistic expressions and help support their 
decorative landscaping. To serve the surrounding community as a small family-owned business, 
residents do not have to be concerned with large crowds causing traffic Issues or big corporations 
building a sea of parking lot for a large store. This residential scaled business does not feel out of 
character with the surrounding community.

LOCATION AND ACCESSIBILITY 
The location of this property is on S. Cooper Rd. Between E. Chandler Heights Rd. and E. Riggs Rd. 
There will be a simplified parking lot installed on the property to have a single entry and exit to ease 
traffic in and out of the property. There will be a single van ADA space available as well as a walkway 
through the pottery area around and up to the check out area. The storage building and house are not 
places of public accommodation. These will remain as they are currently. 
CIRCULATION SYSTEM 
The circulation system starts at the Northern most portion of the property along S. Cooper Rd. This is 
the entry for the proposed parking lot and any deliveries. There is a single lane drive through the 
parking area and exits onto S. Cooper Rd. There is a second driveway on the property, and this is
intended for employees and overflow as the South parking area access. 
DEVELOPMENT SCHEDULE 
Once the application is submitted to Maricopa County, the owner will be sending out a letter to notify 
surrounding property owners of the intent for the Special Use Permit application as outlined in the 
Citizen Participation Plan. We anticipate that the application process will take roughly 3 months. At that 
point, with some coordination with MCDOT and the City of Chandler, construction on the parking lot will 
commence. The anticipated construction time is roughly 8 months. Looking at a completion in the 
Spring of 2023. 
COMMUNITY FACILITIES AND SERVICES 
The Santan Junior high school, Chandler Fire Department Station No. 10, the Eastern canal are all 
located with in a mile of the site. There are also a few golf courses near by as well as some parks, such 
as the Veterans Oasis Park. The site has a close proximity to highway 87 and is equidistant to the 202 
and interstate 10.  
PUBLIC UTILITIES AND SERVICES 
City water is served by city of Chandler water district and electric by SRP. Trash services provided by 
waste management. Property has an existing 96-gallon container for trash which will be taken out on 
trash days and put back in when picked up. This will sit behind an enclosure to screen. They will be 
Installing retention basins to control the storm water and keep as much as they can on the property. 
They have an exiting septic system that would remain In place. They are part of the fire station #10 In 
Chandler. There Is a police substation less than 3 miles from the property. The Chandler Police 
Department services the site. 
VARIED DEVELOPMENT STANDARDS 
We would like to vary Article 1102.7.1 of the zoning ordinance requiring paved parking area for the 
overflow parking area The parking lot will be composed of crushed/compacted gravel with alternative 
dust control, except for the ADA parking which will be asphalted. The owner would like to have as much

permeable area on the property as possible and to do their part to help fight climate change by 
reducing heat island effects of asphalt. 
The owner would like to vary reduce the required North rear setback from 40’-0” to 30’-0”. This an 
existing barn and has been on the property since the owners purchased the lot. They did not know that 
this was not to current zoning code requirements.  
The City of Chandler has just completed street improvements along the 37’-0” R.O.W. of S. Cooper Rd. 
and has informed us that the City has no plans on developing the full 65’-0” half-width R.O.W. keeping 
this only as 37’-0” of half焁 width ultimate reserved R.O.W. for S. Cooper Rd. The property has an 
existing barn on the property that is 16’-0” east of the ultimate reserved R.O.W. line inside the lot’s 
48’-0” required street side yard; therefore, we are requesting to vary the required street side yard from 
20’- 0” to 16’-0”. This request is because the barn has been on this property for 24 years, built by the 
previous property owners, and is non-conforming to the current zoning ordinance, making this request 
to vary the street side yard setback to accommodate the existing non-conforming structure.  
There is a request to vary the north Sight-Viability-Triangle(SVT) for the north driveway from 25'-0" by 
25'-0" to 13'-4" by 25'-0" since this triangle on another property to the north. Another request is to allow 
6'-0" tall walls inside a SVT since these walls already exist and were built by the City of Chandler during 
the recent street improvements for S. Cooper Rd.  These request will make a minimal impact because 
the north driveway will only be used occasionally for deliveries and the south driveway will only be a 
single exit/entry with the walls are only partially in the top of the triangle and will not obstruct vehicular 
visibility.
