The Applicant is an existing business historically operating with an Arizona Department of Liquor License & Control (“ADDLC”) Series 12 liquor license. Pursuant to the findings of an audit by ADLLC it was determined the applicant failed to satisfy the requirement of the food/non-food ratio of 40%/60%. The business operates as a bar with a limited food menu. The hours of operation are 11:00 AM until 2:00 AM daily. The business totals three thousand seventy- seven (3,077) square feet, of which the attached outdoor patio totals five hundred forty (540) square feet and the interior portion totals two thousand five hundred thirty-seven (2,537) square feet. The business has a seating capacity of one hundred ninety-nine (199) people, with sixteen (16) people designated for the bar area, ninety-nine (99) people designated for the attached outdoor patio, and eighty- four (84) people designated for dining area. The business employs twenty-five (25) people with various job functions. Five (5) people are full-time and twenty (20) are part-time. The applicant has live evening entertainment on Fridays, Saturdays, and holidays. The entertainment is live bands with amplified music performed both inside the premises and on the attached outdoor patio from time to time, weather permitting. Live Entertainment typically begins between 5:00 PM and lasts until 2:00 AM when the business closes. The Applicant employs directional speakers in their respectful efforts to mitigate ambient sound becoming a nuisance to the adjacent residential zone. ⚫ Page 3 October 27, 2025 The applicant has installed 10-6.5” directional speakers with a standard output of 70-80 decibels inwardly directional to control and direct the sound inward to their attached outdoor patio. In addition, live entertainment will also include miscellaneous live Sports Radio shows for ASU football, AZ Cardinals, Bunker to Bunker golf show, Etc. Radio shows have begun as early as 7:00am for golf along with 5:00pm-6:00pm and 7:00pm for the other sports programs. They will also have live music occasionally starting from 12:00 noon, 5:00pm, 6:00pm to 7:00pm with all sports programs and music ending at 12:00 midnight. Live entertainment will consist of Misc. Live Sports Radio shows for ASU football, AZ Cardinals, Bunker to Bunker golf show, Etc. Radio shows have begun as early as 7:00am for golf along with 5:00pm-6:00pm and 7:00pm for the other sports programs. They will also have live music occasionally starting from 12:00 noon, 5:00pm, 6:00pm to 7:00pm with all sports programs and music ending at 12:00 midnight. The attached outdoor patio is illuminated with low- voltage exterior LED string-type lighting with covers over each light source. The barrier around the exterior of the patio is in full compliance with ARS Title IV and ⚫Page 4 October 27, 2025 exists are property signed with “No Alcohol Beyond This Point.” The business has ample adjacent shared parking spaces with other tenants. The owner of the property is responsible for the maintenance and cleanliness of the outdoor car park. The approval of this Use and Entertainment Permit will not cause any significant increase in pedestrian or vehicular traffic in adjacent areas. The general and surrounding areas contain businesses and restaurants.
