ORDINANCE NO. 5154 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, 
ARIZONA, AMENDING THE CODE OF THE CITY OF CHANDLER, 
CHAPTER 30-20 BY ADDING SUBSECTION O PROHIBITED NUISANCE – 
BIRD KEEPING OR FEEDING; PROVIDING FOR THE REPEAL OF 
CONFLICTING ORDINANCES; AND PROVIDING FOR SEVERABILITY. 
WHEREAS, in accordance with Ariz. Rev. Stat. § 9-240, the City Council may adopt by ordinance 
any change or amendment to the regulations and provisions set forth in the Chandler City Code; 
and 
WHEREAS, the City Council wishes to amend the Chandler City Code to prohibit nuisance caused 
by the keeping or feeding of non-domesticated birds.  
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, 
as follows: 
Section 1. 
That the Chandler City Code Section 30-20 Subsection O is hereby added to read as 
follows (additions in ALL CAPS, deletions in strikethrough): 
O. PROHIBITED NUISANCE – BIRD KEEPING OR FEEDING.

NOTWITHSTANDING SECTION 30.O.2, NO PERSON SHALL KEEP OR 
FEED NON-DOMESTICATED BIRDS IN A MANNER THAT INTERFERES 
WITH THE PEACE, QUIET, COMFORT OR ENJOYMENT OF NEIGHBORING 
PUBLIC OR PRIVATE PROPERTY, OR THAT CONSTITUTES A PUBLIC 
HEALTH AND/OR SAFETY HAZARD.  PROHIBITED CONDITIONS 
INCLUDE, BUT ARE NOT LIMITED TO, ANY UNSANITARY CONDITION  
OR PROPERTY DAMAGE CAUSED BY THE KEEPING OR FEEDING OF 
NON-DOMESTICATED BIRDS. 
2. 
BIRD KEEPING AND FEEDING ARE PERMITTED ONLY IF THE 
FOLLWING CONDITIONS ARE MET: 
A. THE FEEDING DOES NOT CREATE AN ACCUMULATION OF 
DROPPINGS ON THE NEIGHBORING PROPERTIES, OR ON THE 
FEEDER’S PROPERTY, SUCH THAT THE ACCUMULATION OF 
DROPPINGS IS DISCERNIBLE BY SIGHT AND/OR SMELL FROM A 
NEIGHBORING PUBLIC OR PRIVATE PROPERTY; AND 
B. THE PROPERTY DOES NOT BECOME AN ATTRACTANT FOR 
RODENTS OR OTHER WILD ANIMALS; AND 
C. ALL BIRDFEEDERS ARE PLACED AT LEAST FIVE FEET ABOVE 
THE GROUND.

D. THIS SECTION DOES NOT APPLY TO CHICKENS KEPT IN 
COMPLIANCE WITH CHAPTER 14. 
 
Section 2. 
Providing for Repeal of Conflicting Ordinances. 
All ordinances or parts of ordinances in conflict with the provisions of this ordinance, 
or any parts hereof, are hereby repealed. 
Section 3. 
Providing for Severability. 
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is 
for any reason held to be invalid or unconstitutional by the decision of any court of 
competent jurisdiction, such decision shall not affect the validity of the remaining 
portions thereof.
