VPC DISCUSSION & RECOMMENDATION: 
 
Mr. Bojorquez, Staff, introduced himself and provided a presentation on the proposed 
request regarding deletion, modification, and technical corrections to the stipulations. 
He discussed each stipulation, comparing the original stipulation and the proposed 
language revision to each, compared the approved and the proposed site plan, and 
showed the conceptual building elevations proposed by the applicant. 
 
Ms. Elyse DiMartino, with ABLA Studio, introduced herself and went over her 
presentation slides. She showed an aerial map and went over the background on the 
case. She then discussed the proposed site plan, circulation plan, wall plan, and 
compared the original site plan approved in 2009 with the new proposed site plan. She 
discussed each stipulation modification proposed, including the deletion of Stipulation 
No. 7 regarding Southern Avenue as the Street Transportation Department would 
support ending Southern Avenue at the current location due to conflicts with the Tres 
Rios site to the east. She ended her presentation by displaying the conceptual building 
elevations proposed for approval. 
 
Chairwoman Perez asked for additional information on the public input received so far 
on the proposal. 
 
Ms. DiMartino responded that no public comments had been received on the project 
yet. She added that no public meetings were required to be held by the applicant as part 
of the Planning Hearing Officer (PHO) application process. 
 
Chairwoman Perez asked for clarification on what type of access was existing along 
the south of the site as there is a gravel road. She also asked if access will be provided 
from the subject site to the Tres Rios wetlands to the east. 
 
Ms. DiMartino responded that the existing gravel road along the south serves as 
access for the existing residences to the south of the project site. She added that the 
proposed trail along the south of the subject site will be available to the public, but is not 
sure that the adjacent property owner, Arizona Department of Transportation (ADOT), to 
the east of the site will allow for access from the project site to the Tres Rios wetlands. 
 
Chairwoman Perez opened and closed the public comment portion of the meeting as 
no requests to speak from members of the public were received by staff. 
 
Member Bill Barquin joined the meeting at 7:15pm bringing the quorum to 7 members. 
 
Chairwoman Perez called for a motion or discussion.

Mr. Mark Cardenas made a motion to approve case PHO-1-20—Z-14-09-7 as filed.  
Mr. Dan Rush seconded the motion. 
 
VOTE:  
 
4-2-1 Motion passed; Members Cartwright and Perez dissented. Member Barquin 
abstained from the vote as he joined the meeting shortly before the vote and did not 
have enough background on the request.
