C-19-24-013-X-00
RESOLUTION REVISING DELEGATION OF AUTHORITY TO COLLECT AND 
COMPROMISE CLAIMS OF THE PLANNING AND DEVELOPMENT DEPARTMENT
Whereas, on April 1, 2009, the Board adopted Resolution C-44-09-108-M-00, which 
authorized the Planning Director to compromise civil penalties accrued for code violation, 
without Board approval, provided the accrued penalty did not exceed $100,000.00. One 
condition of said delegation was that the Director was to “provide to the Board of 
Supervisors, on a monthly basis, a detailed list of each claim that was referred to litigation, 
compromised or settled pursuant to the authority granted by this Resolution.”
Whereas, Article 1501.3.1 of the Zoning Ordinance for the Unincorporated Area of 
Maricopa County and Section 103.2 of the Local Additions and Addenda to the Building 
Code grant all authority to enforce said Ordinance to the Planning Director.
Whereas, at the time said Resolution was adopted, allowing the Director to compromise 
penalties was a new concept, so the Board wished to be regularly informed.  
Whereas, over the last 14 years, this delegated authority has been used on a regular 
basis without issues. During that time, a few matters involved penalties in excess of the 
$100,000 limit and those items were brought to the Board for resolution. 
WHEREAS, the requirement for reporting becomes burdensome and serves little 
purpose. Often the amount of penalty accrued and compromised is rather small. 
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors hereby deletes 
from the requirement of Resolution C-44-09-108-M-00 the condition that the Director 
provide to the Board of Supervisors, on a monthly basis, a detailed list of each claim that 
was referred to litigation, compromised or settled.
BE IT FURTHER RESOLVED that in all other aspects Resolution C-44-09-108-M-00 is 
ratified, affirmed and remains effective without interruption.
