VPC DISCUSSION & RECOMMENDED STIPULATIONS:
Mr. David Simmons, staff, provided an overview of the request.  He went over 
the General Plan Land Use map designation for the site as the project is 
consistent with the plan. He also went over the surrounding land uses, which are 
also consistent with the proposal. Mr. Simmons went through the proposed 
stipulations for the project as well. 
Mr. Ricardo Romero asked if this was the same owner as the previous case 
proposed on the site.  
Mr. Simmons shared that the same owner is selling the site to the applicant 
contingent upon the rezoning request.  
Vice Chair Trilese DiLeo asked if this site is part of the Christmas tree lot. 
Mr. Russell Osborn stated that he believes too many trees are stipulated on the 
site.  
Chairman Joseph Grossman asked staff to review committee members email 
addresses to ensure they are accurate.  
Applicants Presentation: 
Mr. Nick Wood, representing the applicant, DR Horton, went over the request to 
include density, height, surrounding zoning, General Plan Land Use map

designation, architectural design and traffic volumes. He also spoke to Vice Chair 
DiLeo’ s inquiry and stated that this is not the Christmas tree lot.  
 
Mr. Ozzie Virgil asked if the applicant was planning to sell the product after 
construction.  
 
Mr. Wood shared that the developer planned on holding on to the property for at 
least two years. A hefty tax would be imposed on the builder if they opted to sell 
prior to the two-year period.  
 
Mr. Virgil asked if there was any opposition to the case.  
 
Mr. Wood shared that there was no public opposition.  
 
Chairman Grossman stated that the lack of public opposition was surprising.  
 
Vice Chair Trilese DiLeo asked if the applicant currently owns the parcel.  
 
Mr. Wood shared that it is currently under contract. If the rezoning is not 
approved, it will fall out of escrow. 
  
Vice Chair DiLeo asked if this was market rate and asked for the proposed price 
point.   
 
Mr. Wood shared that he does not have that information. 
 
Mr. Ricardo Romero asked if a traffic study had been reviewed.  
 
Mr. Wood shared that a traffic study had been approved, which reveled that an 
increase in traffic would not be substantial.  
 
Ms. Ann O’Brien asked what the traffic study revealed.  
 
Mr. Wood shared that only 262 units were proposed and will not create any 
significant traffic impacts on the frontage road.  
 
Mr. Virgil asked if the required neighborhood notification went beyond the 600-
foot requirement.  
 
Mr. Wood shared that they sent all property owners within 700 feet of the project 
boundaries and all neighborhood associations within one mile.  
 
MOTION: Ms. Ann O’Brien moved to approved Rezoning Case No. Z-42-20-2 
per staff’s stipulations.  Committee member Ms. Trilese DiLeo seconded the 
motion. 
 
VOTE:  10-1, motion to approve passed, with Committee Members 
Grossman, DiLeo, Gardner, Greenberg, Kenney, Levy, O’Brien, Osborn, 
Romero, S Shipman in favor. Mr. Ozzie Virgil not in favor.
