1. Approve a determination of disharmony with the Maricopa County Attorney's Office pursuant to the Romley v. Daughton decision (Ct.App. 2010) based on legal strategy decisions. Also, confirm assignment of The Cavanagh Law Firm in the Maricopa County v. Ogletree, Deakins, Nash, Smoak & Stewart PC (CV 2011-002493); The Cavanagh Law Firm for Maricopa County and Communications Director, Cari Gerchick in the related Special Action filed by Ogletree, Deakins, Nash, Smoak & Stewart PC ( LC2011-0458-001DT), and assignment of additional outside counsel by Risk Management for Clerk of the Board, Fran McCarroll in the same Special Action. Additionally, direct The Cavanagh Law Firm to take all actions necessary and appropriate to carry out these actions. (Discussed in Executive Session on July 20, 2011).
