Statement of Participation
Anyone wishing to address the Council regarding items listed on the agenda or during Call to the Public must completely fill out a Request to Comment card located in the back of the Council Chambers and hand it to the Town Clerk prior to the start of the meeting. Once the meeting has started, late requests to speak cannot be accepted. When your name is called, please approach the podium, speak into the microphone, and state your name and if you are a resident for the public record. Comments may not exceed three minutes. It is the policy of the Mayor and Council not to comment on items brought forth under "Call to the Public." However, staff can be directed to report back to the Council at a future date or to schedule items raised for a future Council agenda. To avoid disruption of the meeting, to maintain decorum, and provide for an equal and uninterrupted presentation, applause is not permitted, except during Proclamations, Awards, and Recognitions. All meeting participants must maintain proper decorum as specified in Section 6 of the Council Rules of Procedure.

Consent Agenda

CONSIDERATION AND POSSIBLE ACTION: Approving Resolution 2026-20, accepting Gila River Indian Community Grant Funding on behalf of the Fountain Hills Unified School District.
Proposition 202 (Gaming Compact with the State of Arizona) was a ballot measure passed by the Arizona voters in the 2002 state general election and codified in ARS 5-601.02. This legislation allows for distribution of funds to cities, towns, and counties for their programs from Arizona Indian Tribes for government services that benefit the general public, including public safety, mitigation of the impacts of gaming, and the promotion of commerce and economic development. The Gaming Compact permits the Nation to allocate 12% of fees it pays to the State to cities, towns and counties in the State of Arizona. Many non-profit organizations also request Proposition 202 funding as "pass through dollars" from cities, towns, and counties to support programs within their communities. Since the legislation required funds to be solicited by a municipality or county, the Town Council approved Resolution 2025-26, which adopted the Town's policy and procedures relating to the Proposition 202 application process for the procurement of funds on behalf of various entities (i.e. as a pass through for funds).The Gila River Indian Community has awarded the Fountain Hills Unified School District (FHUSD) $50,000 for the Native American Cultural Center and Club. The Town will serve as the "pass through" in accordance with Prop 202 and the administration of the grant will be the sole responsibility of the FHUSD.

CONSIDERATION AND POSSIBLE ACTION: Approving a Budget Authority Transfer from Capital Projects Fund contingency into the budget for the Fountain Park Ramada Replacement Project.
The Town Council previously authorized a total of $520,000 for the replacement of ramada structures at Fountain Park, including $320,000 in FY2026 and $200,000 in FY2027.Following a competitive procurement process, the Town selected Richmond Construction & Infrastructure as the contractor. The contractor completed demolition work during FY2026, for which the Town paid $141,376. However, less construction work was completed in FY2026 than originally anticipated, resulting in a larger portion of the project carrying into FY2027.Approximately $375,000 in remaining contract work is now anticipated during FY2027. The FY2027 Adopted Budget currently includes only $200,000 in budget authority for the project. Staff is therefore requesting Council approval to transfer $175,000 in budget authority from the Capital Projects Fund contingency to the Fountain Park Ramada Replacement Project.This request does not increase the total project funding previously approved by Council. Rather, it reallocates budget authority between fiscal years to reflect the revised construction schedule and ensure sufficient FY2027 authority is available to complete the project and make final payments to the contractor.The total project cost the previously approved $520,000.

The Town Council authorized $1.4 million in the FY2027 Adopted Budget for construction of Skyview Park, a new stargazing park located at Bainbridge Avenue and Golden Eagle Boulevard. Following a competitive procurement process, staff selected AR Mays Construction as the contractor, with a total contract amount of $1.4 million, including an owner’s allowance for unforeseen construction costs. The FY2027 Capital Improvement Plan identifies the Parks Development Impact Fee Fund as the funding source for the project.Construction is expected to begin in the coming months. Since the Parks Superintendent, who was responsible for overseeing the project, recently left Town employment, the Community Services Director is requesting an additional $25,000 in budget authority to retain J2 Engineering and Environmental Design LLC (J2 Design) to provide construction administration and project management services throughout construction.Given the recent staff transition, retaining J2 Design will provide continuity and additional oversight to help ensure the project is completed in accordance with the approved scope, contract requirements, and Town expectations. Construction administration services will also help support quality control, coordination, schedule management, and resident safety throughout the project.With Council approval, staff will transfer $25,000 in budget authority from the Capital Projects Fund contingency to the Skyview Park project budget within the same fund.
