A. Discuss and consult with the City’s attorneys for legal advice; discuss and consult with the City’s
designated representatives to consider its position and to instruct its representatives regarding
ongoing litigation in the matter of Fuller v. City of Scottsdale, Case No. CV2020-052874 in Maricopa
County Superior Court, and Arizona Court of Appeals Case No. 1 CA-CV 24-0785. A.R.S. § 38-
431.03(A)(3) and (4).
B. Discuss and consult with the City’s attorneys for legal advice; discuss and consider its position and
give possible instruction regarding House Bill 2447, 2025 Legislative Session, Chapter 31 as the Bill
relates to Administrative Approvals and the Scottsdale Development Review Board process. A.R.S.
§ 38-431.03(A)(3).

If authorized by a majority vote of the Scottsdale City Council, the executive session will be held
immediately after the vote and will not be open to the public.
– Councilwoman Whitehead made a motion to adjourn into Executive Session to:
A. Discuss and consult with the City’s attorneys for legal advice; discuss and consult with the
City’s designated representatives to consider its position and to instruct its representatives
regarding ongoing litigation in the matter of Fuller v. City of Scottsdale, Case No. CV2020-
052874 in Maricopa County Superior Court, and Arizona Court of Appeals Case No. 1 CA-CV
24-0785.
B. Discuss and consult with the City’s attorneys for legal advice; discuss and consider its
position and give possible instruction regarding House Bill 2447, 2025 Legislative Session,
Chapter 31 as the Bill relates to Administrative Approvals and the Scottsdale Development
Review Board process.
Vice Mayor Kwasman seconded the motion, which carried 7/0, with Mayor Borowsky; Vice Mayor
Kwasman; and Councilmembers Dubauskas, Graham, Littlefield, McAllen, and Whitehead voting in
the affirmative.
Adjourn to Executive Session in the Kiva Conference Room – 4:08 P.M.
