18. MOU BETWEEN MARICOPA COUNTY ATTORNEY’S OFFICE AND MARICOPA COUNTY DEPARTMENT OF PUBLIC HEALTH Approve the Memorandum of understanding (MOU) between Maricopa County Attorney’s Office (MCAO) and Maricopa County Department of Public Health (MCDPH) to establish MCAO’s Opioid Use—Felony Diversion Program (OU -FDP) Pilot. The purpose of the MOU is to use MCDPH Justice Reinvestment Funds to fund this Pilot project. The funds are to be used for defendants who are deemed eligible for the diversion program by a Deputy County Attorney assigned to a Family Violen ce Bureau AND are uninsured/underinsured. The goal of this Pilot is to provide the defendant an opportunity to opt in for therapeutic interventions to address a substance use disorder rather than be prosecuted and convicted of a felony offense. In additi on, the Pilot provides wraparound services to the defendant’s family to ensure the family unit may stay together if it is safe for the child/children. The term of this MOU shall become effective November 21, 2022 and shall remain in effect until November 21, 2025. Referrals to the Pilot will conclude on May 1, 2024, therefore permitting eighteen (18) months for a defendant to complete the program by the MOU expiration date. The MOU shall remain effective unless terminated by either party in writing, term inate the instrument in whole, or in part, at any time before the date of expiration. The MOU may be extended upon the written approval of both parties. The mutual benefit for the parties is to develop a program that supports offenders in need of treatm ent, while strengthening family resiliency and reducing recidivism. Defendants will receive the support they need to be successful in life and with their family. MCDPH will pay for up to 50 enrolled defendants. Should the number of defendants exceed 50, the Director of Diversion Strategies Group shall contact MCDPH to discuss additional funding. (C-19-23-051-X-00)

AMEND COMPETITION IMPRACTICABLE CONTRACTS FOR SAGE COU NSELING AND AVERTEST LLC, DBA AVERHEALTH Increase the expenditure amounts for competition impracticable contracts (CI) with Sage Counseling, Inc. (220221-CI) and Avertest LLC DBA Averhealth (220222-CI) and the addition of the Opioid Use—Felony Diversion Program Pilot Program as follows: 1. Sage Counseling, Inc. - increase the contract amount by $80,390.90 for the Opioid Use—Felony Diversion Pilot Program from $2,485,000 to $2,565,390.90. 2. Avertest LLC, DBA Averhealth - increase the contract amount by $32,140 from $300,000 to $332,140 to provi de additional testing services for the various diversion programs for the Maricopa County Attorney's Office (MCAO). The increased expenditures will be funded utilizing funding from Maricopa County department of Public Health Justice Reinvestment Funds to be approved 11/16/2022 (C-19-23-051-X-00). The Maricopa County Department of Public Health funding is available through November 21, 2025. MCAO is adding an Opioid Use – Felony Diversion Program (OU-FDP) Pilot project to assist up to 50 defendants during the pilot period with funding from Maricopa County Department of Public Health. Additional funding may be available from Maricopa County Department of Public Health if the number of defendants exceeds the estimated number of budgeted participants. ARPA funding will be used as long as ARPA funding is available. The CI's were approved with agenda item C-19-22-108-X-00. (C-19-22-108-X-01)

49. AMENDMENT TO MOU WITH MARICOPA COUNTY ATTORNEY'S OFFICE Approve Amendment 1 to Memorandum of Understanding (MOU) by and through the Maricopa County Department of Public Health (MCDPH) and the Maricopa County Attorney's Office (MCAO) to fund MCAO’s Opioid Use – Felony Diversion Program (OU-FDP). The term of this agreement is November 21, 2022 through November 21, 2025, or when 50 defendants are enrolled, with a not-to-exceed amount of $65,358. The above-named contracts are hereby amended as specified below: I. The total not-to-exceed amount is $65,358.00 for the Term of November 21, 2022 to November 21, 2025 — a decrease of $54,642.00 II. Section II. Term is revised to extend the end of the term to November 21, 2025 or when reaching 50 enrolled III. Section VI. Compensation is revised to reduce the budgeted amount to $65,358.00 to support individuals who are uninsured/underinsured IV. All other terms and conditions of the original contract and its amendments shall remain in full force and effect (C-19-23-051-X-01)

29. INTERDEPARTMENTAL AGREEMENT WITH MARICOPA COUNTY DEPARTMENT OF PUBLIC HEALTH FOR FELONY DIVERSION PROGRAM EXPANSION Approve the Interdepartmental Agreement (IDA) between the Maricopa County Attorney’s Office (MCAO) and the Maricopa County Department of Public Health (MCDPH) to support the Felony Diversion Program Expansion (FDP Expansion). This agreement formalizes collaboration to deliver coordinated, evidence-based services that promote recovery, reduce recidivism, and improve public health outcomes for individuals referred by MCAO for Felony Diversion. Under the FDP Expansion framework, MCAO and MCDPH will jointly support treatment, harm reduction, and case management through approved providers. Term: December 1, 2025 – November 30, 2026 (with option to extend). Funding: Not-to-exceed $245,470.92 for all program activities, including case management, harm reduction, family support, administrative coordination, and related expenses. MCDPH funding is only applicable to participants residing in Maricopa County at the time of service initiation. MCAO and MCDPH have a long-standing partnership addressing substance use disorders, including the Opioid Use–Felony Diversion Program Pilot (C-19-23-051-X-00). This new IDA expands that collaboration to achieve outcomes that support clinical, educational, research, and public service goals. (C-19-26-067-X-00)
