56. AMENDMENT TO IGA WITH CITY OF TEMPE FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 4 to the Intergovernmental Agreement between City of Tempe and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to provide single family homebuyer assistance to a low income households. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The purpose of Amendment No. 4 is to address the following: A. Clarify the extension term for Amendment No. 2 to the Agreement. The Agreement term is extended from September 30, 2021, through September 30, 2023. B. Clarify the extension term for Amendment No. 3 to the Agreement. The Agreement term is extended from September 30, 2022, through September 30, 2024. C. Change Lead Agency Point of Contact. D. Extend the term of the Agreement from September 30, 2023, through September 30, 2025. E. Revise Section 3 (Work Statement) to address the following paragraph: Add an additional Work Statement referred to as “2022 Work Statement TBRA” attached and incorporated into the Agreement. The City shall provide tenant based rental assistance to 155 Tempe residents. The County shall provide the City with Program Year 2020, 2021 and 2022 funding in a not-to exceed amount of $1,649,079 HOME Investment Partnerships Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. If the City has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. All work performed, or costs incurred shall be reimbursable through September 30, 2025. The City shall contribute $710,905 (PY2020 $249,000, PY2021 $328,000, and PY2022 $133,905) Program Income towards Work Statement activities. F. The Agreement funding amount shall be increased from $1,570,250.97 to $3,219,329.97 in HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 4. All other terms and conditions of the Agreement and previously approved amendments shall remain unchanged and in full force and effect as executed by the Parties. 34. AMENDMENT TO IGA WITH CITY OF TEMPE FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 5 to the Intergovernmental Agreement between City of Tempe (City) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is for the City to provide single family homebuyer assistance to low-income households. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The purpose of Amendment No. 5 is to address the following: A. Revise Section 1 General provisions to add the following required clauses: CCC. UYGHUR FORCED LABOR PREVENTION ACT (UFLPA) and DDD. PROVISIONS REQUIRED BY LAW B. Revise Section 3 (Work Statement) to Add an additional Work Statement referred to as “Work Statement – 2021 HOME ARP” 1. The City shall 1) provide supportive services, specifically, bridge shelter case management and housing navigation; and 2) acquisition, construction, rehabilitation, and reconstruction of housing, specifically, transitional non-congregate Bridge Shelter. 2. The County shall provide the City with Program Year 2021 funding in the amount of $2,269,939 HOME Investment Partnerships Program (HOME ARP) funds through the U.S. Department of Housing and Urban Development (HUD), under ALN 14.239, in accordance with HUD CPD Notice CPD-21-10. C. The funding amount for Supportive Services under this Amendment shall be $1,369,939, and the expenditure term for these Work Statement related activities shall expire on October 30, 2027. The funding amount for Non-Congregate transitional Bridge shelter acquisition and construction under this Amendment shall be $900,000, and expenditure term for these Work Statement related activities shall expire on September 30, 2025. D. The Agreement total funding amount shall now be increased from $3,219,329.97 to $5,489,268.97 in HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 5. All other terms and conditions of the Agreement and previously approved amendments shall remain unchanged and in full force and effect as executed by the Parties. Add the following required clauses to the Agreement: 1. Unique Identity Identifier and System for Award Management 2. Force Majeure D. Revise Section II (Special Provisions), Paragraph Q (Regarding Subcontracts and Vendors), Subparagraph 2 (DUNS Number). E. Revise Section II (Special Provisions), Paragraph U (General Conditions), Subparagraph 4 (Changes). F. Revise Section III (Work Statements) to address the following: 1. Add PY2023 Work Statement TBRA-For the City to expand the TBRA program. The County shall provide the City with $575,285 in PY23 HUD HOME Investment Partnership funds under ALN 14.239 for this activity. The funding period of availability is retroactive to October 1, 2024. The expenditure timeframe for these funds is through September 30, 2027. 2. Add PY2024 Work Statement TBRA-For the City to expand the TBRA program. The County shall provide the City with $451,473 in PY24 HUD HOME Investment Partnership funds under ALN 14.239 for this activity. The funding period of availability is retroactive to October 1, 2024. The expenditure timeframe for these funds is through September 30, 2027. G. The Agreement total funding amount shall be increased from $5,489,268.97 to $6,516,026.97. The Agreement is amended to incorporate the changes contained in this Amendment No. 6. All other terms and conditions of the Agreement and previously approved amendments shall remain unchanged and in full force and effect as executed by the Parties.
