CADORA DESERT HILLS Case #: Z240023 Supervisor District: 3 Applicants & Owners: Holly Reading, Tiffany & Bosco/Cadora Desert Hills Request: Zone Change Modification of Conditions to Rural-43 RUPD Site Location: Generally located at the northwest corner of Desert Hills Dr. and 7th Ave. in the Anthem area Commission Recommendation: On 3/20/25 the Commission voted 6-0 (motion by Vice Chair Curley D3, seconded by Commissioner Toma D4) to adopt a motion recommending the Board of Supervisors approve Z240023 subject to conditions ‘a’ - ‘g’ with the modification to condition d.1 as follows: a. Development of the site shall be in conformance with the narrative report entitled "Cadora Desert Hills", consisting of 41 pages, dated January 16, 2025, except as modified by the following conditions. b. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A traffic impact study must be submitted with future Preliminary Plat applications. 3. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. c. The Rural-43 RUPD zoning district for Cadora Desert Hills shall be subject to the following development standards: 1. Max. building height: 40’ 2. Min. side setback: 20’ 3. Min. rear setback: 30’ 4. Min. lot area: 35,000 sq. ft. 5. Avg. lot area per dwelling: 49,000 sq. ft. d. The following Maricopa County Department of Transportation (MCDOT) conditions shall apply: 1. Provide a total half-width of 40’ right-of-way dedication, or as otherwise required by MCDOT, on Desert Hills Drive with subdivision plat. 2. Provide a total half-width of 40' right-of-way dedication on 7th Avenue with subdivision plat. 3. Construct ultimate half-width improvements, including pavement, curb and gutter, to perimeter roads (7th avenue and Desert Hills Drive) with subdivision infrastructure permit. e. Major changes to the zoning exhibit and narrative report shall be processed as a revised application, with approval by the Board of Supervisors upon recommendation of the Planning and Zoning Commission. Minor changes may be administratively approved by the Planning and Development Department. Major changes to the project may require a new Citizen Participation Process as determined by the Planning and Development Department. f. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). g. Property owner and his successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with stipulations. (C-44-25-093-X-00)

22. ADDITIONAL FY2025 TITLE III GRANT CONSORTIUM ALLOCATIONS FROM ARIZONA DEPARTMENT OF EDUCATION Approve the acceptance of an additional $36,005 in Title III grants for consortium school districts from the Arizona Department of Education (ADE). The Board of Supervisors previously approved the initial FY2025 grant allocations in July 2024 (C-37-25-001-X-00). The additional allocations include FY2024 recipient carryforward and additional available funds allocated to recipients by ADE. This is a federal entitlement grant that provides funds to support students who are learning the English language. The Maricopa County School Superintendent’s Office (MCSSO) serves as the fiscal agent since by federal law recipients must participate in the grant through a consortium when their allocation is less than $10,000 a year. There are 16 school districts or charter schools that are part of the consortium in fiscal year 2025. The term of this grant is for one year, July 1, 2024, to June 30, 2025. The grant awards are reoccurring, do not have an in-kind match requirement during the grant award period, and do not require ongoing cash contributions. This is a federal entitlement grant, and therefore, is non-competitive. MCSSO’s indirect cost rate for fiscal year 2025 is 0.80 percent. However, MCSSO passes all monies through to the Consortium members and does not charge the school districts for indirect costs. There are no additional costs that will need to be absorbed by the Department’s operating budget. As a result of this funding and pursuant to A.R.S. §42-17106(B), approve an adjustment to the FY2025 County School Superintendent (D370) Schools Grants Fund (715) Operating (OPER) revenues and expenditures budget in the amount of $36,005. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-37-25-001-X-01)

23. SUPPLEMENT TO AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) – INITIATIVE XXXIV Approve Supplement #1 to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G24SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The amount of supplement #1 is ($12,861.44), decreasing the amount from $667,152 to $654,290.56. The term of this funding is unchanged, January 1, 2024, to December 31, 2025. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. The MCSO indirect cost rate for FY25 is 26.71%. There are no unrecoverable indirect costs associated with this decrease in funding. This award was initially accepted in BOS action C-50-23-177-X-01 on May 22, 2024. 32. DELEGATION AGREEMENT WITH ARIZONA DEPARTMENT OF HEALTH SERVICES Approve the Delegation Agreement No. 2024-048 between the Arizona Department of Health Services (ADHS) and Maricopa County. This agreement authorizes the political subdivision of Maricopa County, through its Departments of Public Health (MCDPH) and Environmental Services (MCESD), to exercise functions, powers, and duties bestowed on ADHS by provision of law. The County, through MCESD, shall be responsible for ‘Food Safety and General Sanitation Control’ and ‘Pure Food Control.' The County, through MCDPH, shall be responsible for ‘Smoke-Free Arizona Act.’ This agreement is non-financial and has no effect on the County general fund. The term is from 30 days after approval by all parties through June 30, 2032, with the option of extending. The agreement may be terminated in whole or in part by the Director of ADHS or the County, effective ninety (90) days after either the Director of ADHS or the County provides written termination by certified mail to the other. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR HOUSING SUPPORT SERVICES Approve revenue Amendment No. 6 to the Intergovernmental Agreement (Agreement) with Arizona Department of Economic Security (DES) (DI23-002395) and Maricopa County (County), administered by its Human Services Department. DES provides funding to the County for administration of the Housing Support Services in Maricopa County by providing assistance to individuals/families experiencing homelessness to obtain stable housing and to provide emergency shelter and case management services while permanent housing options are located. The Purpose of Amendment No. 6 is to revise the Agreement as follows: A. Extend the term of the Agreement through June 30, 2026 B. Delete Subsections 10.3.2 and 10.3.3 from Section 10.0 (Reporting Requirements) The foregoing paragraphs contain all the changes made by this Amendment No. 6. All other terms and conditions of the Agreement and previously approved Amendments remain in full force and effect. The Amendment shall become effective on the date of last signature. Arizona Department of Economic Security contracts with the County on an annual reoccurring, non-competitive basis. Receipt of the funds from DES does not require in-kind or match funds and no future or ongoing contributions by the County are required at the end of the Agreement term. The Human Services Department indirect rate is 24% as approved by the U.S. Department of Health and Human Services for FY25 for salaries and employee related expenses. The total Amendment funding amount is $0.00 of which $0.00 is for salaries and employee related expenses. Funds will be passed through to subrecipients and are not subject to indirect cost recovery. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens of Maricopa County by providing housing assistance or supportive services to individuals and families to prevent homelessness. The Amendment revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this Amendment through future budget reconciliation. Receipt of funds will not impact the County General Fund. The purpose of the Agreement is for the City of Chandler to provide single-family owner-occupied housing reconstruction and tenant based rental assistance programs. The County provided the City with U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME) funds. The purpose of this Amendment No. 6 is to address the following: A. Revise the Contract Termination Date on Page 1 to September 30, 2027. B. Update County Lead Agency Representative C. Revise Section II (Special Provisions), Paragraph Q (Regarding Subcontracts and Vendors), Subparagraph 2 (DUNS Number) to update with UEI Number provision D. Revise Section II (Special Provisions), Paragraph U (General Conditions), Subparagraph 4 (Changes) to update Administrative Change Order provision. E. Revise Section III (Work Statement) to address the following: 1. Remove 2020 & 2021 Work Statement A that was added to the Agreement in Amendment No. 4 and reallocate $307,781 to a new revised PY20, PY21, and PY22 Work Statement B-TBRA. The City shall provide Tenant Based Rental Assistance. The funding for this Work Statement shall consist of $715,112 (HOME PY20-$200,000, HOME PY21-$107,781, and $407,331 which was previously allocated in Amendment No. 4). This expenditure timeframe for these funds is through June 28, 2027. 2. Update the expenditure timeframe for the Work Statement 2021 HOME-ARP to September 30, 2027. Update the expenditure timeframe for PY2023 HOME Work Statement A to September 30, 2027. 3. Add PY24 Work Statement A TBRA- For the City to provide Tenant Based Rental Assistance. The County shall provide the City with $399,251 in PY24 HUD HOME funds under ALN 14.239 for this activity. The expenditure timeframe for these funds is through September 30, 2027. F. Funding for Amendment No. 6 is $399,251 and the total Agreement funding amount has increased from $4,825,530.29 to $5,224,781.29. MOU WITH ARIZONA COMMUNITY ACTION ASSOCIATION, D/B/A WILDFIRE FOR DIAPER DISTRIBUTION Approve financial Memorandum of Understanding (MOU) between Arizona Community Action Association (“Wildfire”) and Maricopa County, administered by its Human Services Department. The purpose of this MOU is to establish a Diaper Distribution pilot program. Wildfire shall provide the Human Services Department with diapers and diapering supplies for distribution to eligible low-income residents. The term of this agreement is effective upon full execution of the MOU through September 29, 2025, and may be extended to additional terms. Wildfire shall provide the County with $34,375 for administration of the pilot program in Maricopa County. Cash match or in-kind is not required in the MOU term. The services provided under this MOU are not a mandated function but provide a benefit to the citizens by providing eligible low-income residents with diapers and diapering supplies. Receipt of the funds from Wildfire does not require future or ongoing contributions by the County at the end of the MOU term. This MOU is issued through a non-competitive process, as the Human Services Department provides services to residents that are low-income. The Human Services Department indirect rate for FY2025 is 24%. The total MOU amount is $34,375 of which $0 is for salaries and employee related expenses. The total estimated indirect costs are $0, with $0 being recoverable, costs will be absorbed by the Human Services Department budget. The grant award is reoccurring and has been awarded to the department for the past year. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. ACCEPT NEW FUNDING FROM DEPARTMENT OF HEALTH AND HUMAN SERVICES FOR MARICOPA COUNTY PUBLIC HEALTH CRISIS RESPONSE COOPERATIVE AGREEMENT Approve the retroactive acceptance of new grant funds from Department of Health and Human Services (HHS) for Public Health Crisis Response in the amount not-to-exceed $1,339,555.00 to support the county’s ability to rapidly mobilize, surge, and respond to public health emergencies. The grant award began on January 17, 2025, and ends January 16, 2026. This Grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% indirect cost reimbursement as delegated in the Grant Agreement. The MCDPH indirect rate for FY25 is 15.79%. Full indirect costs are estimated at $27,460.87 of which $26,086.96 is recoverable and $1,373.91 is unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. This grant was competitive, and it is unknown whether the grant will be awarded again. There is no in-kind match requirement, and the grant does not require on-going cash contributions. The purpose of this grant is to provide support to MRC units and to encourage these units to provide certain information for the State of Arizona. The 2025 Medical Reserve Corps (MRC) ORA aims to build the operational readiness capabilities of MRC units to meet the emergency preparedness and response needs of their local, regional, or statewide stakeholders. The awards are intended to be flexible to meet the needs of all MRC units, support efforts to build MRC capabilities, strengthen stakeholder awareness of MRC capabilities, and identify or sustain integration of the MRC into local, state, and/or regional emergency response plans. The not-to-exceed amount is $10,000 and the term of the Agreement shall begin from the later date of signature (effective date) and shall continue until September 29, 2025. This grant has been awarded to MCDPH in the past, however, it is unknown if it will be awarded again. The grant was competitive and there is no cash or in-kind match required. This grant is not a mandated function but provides a valuable service to the community. The Department of Health’s indirect rate for FY25 is 15.79%. This is a Noncompeting Continuation (NCC). The NOA NCC is in the amount of $497,200.00 for the revised budget period April 01, 2025, through March 31, 2026, bringing the total not-to-exceed amount to date to $1,799,245.00. The term of the award is May 01, 2024, through March 31, 2029. HRSA’s Healthy Start grant award is competitive, however, this is not the first time it has been awarded to the Department. H49MC00174-25-00 is the newly awarded competitive support, for a new five (5) year period. The grant does not require an in-kind match and ongoing cash contributions are not required. Healthy Start services are not a mandated function but provide valuable benefits to Maricopa County residents. All program costs are allocated to the grant so there will be no additional burden on the Department’s operating budget. The Department of Health’s indirect rate for FY25 is 15.79%. Indirect costs are estimated at $67,801.95, all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and any future indirect rate will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. DEANNEXATION FROM CITY OF PHOENIX TO MARICOPA COUNTY Pursuant to A.R.S. §9-471.03(D), set a hearing for May 7, 2025 to determine if the public interest is served by de-annexing road right-of-way from City of Phoenix jurisdiction to Maricopa County in accordance with City of Phoenix, Ordinance No. S-51232. Also, for the hearing, direct MCDOT to prepare an analysis of the requested action. Right-of-way location: 107th Avenue south of Broadway Road. Supervisory District No. 5. At the hearing, if after reviewing the analysis and hearing those that may appear for or against the action, the Board determines that the public interest is served by this de-annex/annexation action, the Board shall file in the Clerk of the Board’s Office an ordinance setting forth the legal description of the public right-of-way and declare the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute which would include setting a second public hearing on this matter. AMENDMENT TO IGA WITH CITY OF TEMPE FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 6 to the Intergovernmental Agreement between City of Tempe (City) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is for the City to provide single family homebuyer assistance to low-income households. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The purpose of Amendment No. 6 is to address the following: A. Revise Contract Termination Date to September 30, 2027. B. Revise Lead Agency Point of Contact. C. Add the following required clauses to the Agreement: 1. Unique Identity Identifier and System for Award Management 2. Force Majeure D. Revise Section II (Special Provisions), Paragraph Q (Regarding Subcontracts and Vendors), Subparagraph 2 (DUNS Number). E. Revise Section II (Special Provisions), Paragraph U (General Conditions), Subparagraph 4 (Changes). F. Revise Section III (Work Statements) to address the following: 1. Add PY2023 Work Statement TBRA-For the City to expand the TBRA program. The County shall provide the City with $575,285 in PY23 HUD HOME Investment Partnership funds under ALN 14.239 for this activity. The funding period of availability is retroactive to October 1, 2024. The expenditure timeframe for these funds is through September 30, 2027. 2. Add PY2024 Work Statement TBRA-For the City to expand the TBRA program. The County shall provide the City with $451,473 in PY24 HUD HOME Investment Partnership funds under ALN 14.239 for this activity. The funding period of availability is retroactive to October 1, 2024. The expenditure timeframe for these funds is through September 30, 2027. G. The Agreement total funding amount shall be increased from $5,489,268.97 to $6,516,026.97. The Agreement is amended to incorporate the changes contained in this Amendment No. 6. All other terms and conditions of the Agreement and previously approved amendments shall remain unchanged and in full force and effect as executed by the Parties. IGA FOR LAW ENFORCEMENT SERVICES BETWEEN THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY AND MARICOPA COUNTY ON BEHALF OF THE SHERIFF’S OFFICE Approve an Intergovernmental Agreement between Maricopa County Flood Control District and Maricopa County on behalf of the Sheriff’s Office for Law Enforcement Service effective October 1, 2024, through September 30, 2030, with up to six, one-year automatic renewals. This item supersedes the Intergovernmental Agreement between the Flood control District and Maricopa County on Behalf of the Sheriff's Office approved by the Board for the Sheriff's Office on October 22, 2014, in agenda C-50-15-030-0-00. Approval of this Agreement allows the Sheriff's Office to assign one specific full time sworn Sheriff's deputy to patrol Flood Control District land/property and enforce the law and statutory mandates. The Flood Control District will reimburse the Sheriff's Office 100% of the employment costs of the Flood Control Deputy position plus a proportionate amount for Deputy Supervision. The Flood Control District will fund all Sheriff's required standard equipment for its patrol deputies plus operational costs (either through reimbursement or direct pay). The FY 2025 cost under this agreement is anticipated to be $202,145.09. The Sheriff's Office will notify the District each year of the costs for the coming fiscal year. IGA WITH THE CITY OF PEORIA FOR GRAND AVENUE, OLIVE AVENUE, & 75TH AVENUE REGIONAL DRAINAGE IMPROVEMENTS PROJECT Approve Intergovernmental Agreement (IGA) FCD 2024A009 for the Grand Avenue, Olive Avenue, and 75th Avenue Regional Drainage Improvements Project (PROJECT) between the City of Peoria (CITY) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date, or upon Project completion, whichever occurs first. Background: The Grand Avenue, Olive Avenue, and 75th Avenue Regional Drainage Improvements project area is located within the City of Peoria (CITY). The PROJECT is intended to mitigate the flood hazards in the southwest corner of the intersection of Grand Avenue, Olive Avenue, and 75th Avenue. The area was the subject of the Glendale/Peoria Area Drainage Master Plan (GPADMP) prepared in November 2011. The GPADMP was used as the basis for the Peoria Storm Drain Master Plan prepared in 2014 which took a closer look at the existing storm drain system and made improvement recommendations to mitigate the flood hazards in the southwest corner of the intersection of Grand Avenue, Olive Avenue, and 75th Avenue. The estimated cost for this Project is $4,500,000 and the PROJECT cost will be shared between the DISTRICT and the CITY. The District’s estimated share of the Project cost is $2,925,000 and the City’s estimated share of the Project cost is $1,575,000. The City will operate and maintain the completed Project. 78. IGA FOR LAW ENFORCEMENT SERVICES BETWEEN THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY AND MARICOPA COUNTY ON BEHALF OF THE SHERIFF’S OFFICE Approve an Intergovernmental Agreement between Maricopa County Flood Control District and Maricopa County on behalf of the Sheriff’s Office for Law Enforcement Service effective October 1, 2024, through September 30, 2030, with up to six, one-year automatic renewals. This item supersedes the Intergovernmental Agreement between the Flood control District and Maricopa County on Behalf of the Sheriff's Office approved by the Board for the Sheriff's Office on October 22, 2014, in agenda C-50-15-030-0-00. Approval of this Agreement allows the Sheriff's Office to assign one specific full time sworn Sheriff's deputy to patrol Flood Control District land/property and enforce the law and statutory mandates. The Flood Control District will reimburse the Sheriff's Office 100% of the employment costs of the Flood Control Deputy position plus a proportionate amount for Deputy Supervision. The Flood Control District will fund all Sheriff's required standard equipment for its patrol deputies plus operational costs (either through reimbursement or direct pay). The FY 2025 cost under this agreement is anticipated to be $202,145.09. The Sheriff's Office will notify the District each year of the costs for the coming fiscal year. There will be a corresponding agenda item with the Maricopa County Sheriff's Office. (C-69-25-027-X-00)

81. Public comment on matters pertaining to Maricopa County government. Please limit comments to two minutes. Note that pursuant to Arizona Open Meeting Law, Board members may not discuss matters raised under this public comment portion of the meeting; however, an individual Board member may respond to criticism made by those who have addressed the Board, ask staff to review an issue raised or may ask that the matter be placed on a future agenda. Written comments will be summarized at the meeting noting the topic or topics. All written comments will be forwarded to each Board Office for their review.
