5. CADORA DESERT HILLS Case #: Z240023 Supervisor District: 3 Applicants & Owners: Holly Reading, Tiffany & Bosco/Cadora Desert Hills Request: Zone Change Modification of Conditions to Rural-43 RUPD Site Location: Generally located at the northwest corner of Desert Hills Dr. and 7th Ave. in the Anthem area Commission Recommendation: On 3/20/25 the Commission voted 6-0 (motion by Vice Chair Curley D3, seconded by Commissioner Toma D4) to adopt a motion recommending the Board of Supervisors approve Z240023 subject to conditions ‘a’ - ‘g’ with the modification to condition d.1 as follows: a. Development of the site shall be in conformance with the narrative report entitled "Cadora Desert Hills", consisting of 41 pages, dated January 16, 2025, except as modified by the following conditions. b. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A traffic impact study must be submitted with future Preliminary Plat applications. 3. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. c. The Rural-43 RUPD zoning district for Cadora Desert Hills shall be subject to the following development standards: 1. Max. building height: 40’ 2. Min. side setback: 20’ 3. Min. rear setback: 30’ 4. Min. lot area: 35,000 sq. ft. 5. Avg. lot area per dwelling: 49,000 sq. ft. d. The following Maricopa County Department of Transportation (MCDOT) conditions shall apply: 1. Provide a total half-width of 40’ right-of-way dedication, or as otherwise required by MCDOT, on Desert Hills Drive with subdivision plat. 2. Provide a total half-width of 40' right-of-way dedication on 7th Avenue with subdivision plat. 3. Construct ultimate half-width improvements, including pavement, curb and gutter, to perimeter roads (7th avenue and Desert Hills Drive) with subdivision infrastructure permit. e. Major changes to the zoning exhibit and narrative report shall be processed as a revised application, with approval by the Board of Supervisors upon recommendation of the Planning and Zoning Commission. Minor changes may be administratively approved by the Planning and Development Department. Major changes to the project may require a new Citizen Participation Process as determined by the Planning and Development Department. f. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). g. Property owner and his successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with stipulations. (C-44-25-093-X-00)
