53. AMENDMENT TO THE FY/PY2021-22 ANNUAL ACTION PLAN FOR ALLOCATION OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT HOME-ARP FUNDS Request approval of the following actions: 1. Approve the submittal of Amendment No. 1 to the FY/PY 2021-22 Annual Action Plan (AAP) to the U.S. Department of Housing and Urban Development (HUD). The amended AAP identifies the activities to be conducted with the HOME-ARP funds as identified in Attachment A: a. Development of Affordable Rental Housing, Development of Non-Congregate Shelter, Supportive Services, Tenant Based Rental Assistance, and Program Administration. 2. Authorize the Human Services Department Director or designee to submit any referenced plans and sign all documents related to the HUD grant funds. The changes in the FY/PY 2021-22 Annual Action Plan do not have a financial impact. Approval of this item shall not impact the County General Fund. On April 21, 2021, the Board of Supervisors approved the submission of the FY2021-2022 Annual Action Plan (AAP) for the HOME Consortium and Urban County; and acceptance of CDBG, HOME, and ESG funding for FY2021-2022 (C-22-20-038-G-01). On June 9, 2021, the Board of Supervisors approved the receipt of an unanticipated increase of CDBG allocation funds in the amount of $41,978 in U.S. Department of Housing and Urban Development (HUD) for Community Development Block Grant (CDBG) Programs (C-22-20-038-G-02). On June 9, 2021, the Board of Supervisors approved the receipt of the $16,756,617 in HOME Investment Partnerships Program - American Rescue Plan Act of 2021 (HOME-ARP) funds from the U.S. Department of Housing and Urban Development (HUD) (C-22-21-126-X-00). Approval of the allocation of funds to specific agencies or activities does not impact the previously received HOME-ARP funding amount of $16,756,617. 74. MAR ICOPA COUNTY FY/PY2022-2023 ANNUAL ACTION PLAN FOR HUD FUNDED ACTIVITIES AND RECEIPT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FUNDS Approve the following items regarding the Maricopa County Annual Action Plan for the U.S. Department of Housing and Urban Development (HUD) for funded activities for the Community Development Block Grant (CDBG); HOME Investment Partnerships Program (HOME); and Emergency Solutions Grant (ESG) Programs: Approval of this item includes: (1) Approve the submissi on of the FY2022-2023/PY2022-2023 Annual Action Plan (AAP) for the HOME Consortium and Urban County; and acceptance of CDBG, HOME, and ESG funding for FY2022-2023. HUD notified the County of fund allocations for HUD program year 2022 which begins for the County on July 1, 2022. The AAP activities are based on the HUD allocations and prior year’s un-programed funds as well as prior year’s program income. Funds will be spent over multiple years per allowable regulations and may be reallocated if necessary a nd with input through the Citizen Participation Plan as previously approved by the Board of Supervisors. Submittal of an AAP is a HUD requirement. (2) Approve the receipt of FY2022-23 HUD total funds in the amount of $8,215,422 allocated per program: • $5,136,058 HOME Investment Partnerships Program (HOME) • $2,836,377 Community Development Block Grant (CDBG) • $242,987 Emergency Solutions Grant (ESG) (3) Approve the use of HOME Consortium Program Income funds generated by prior year HUD agre ements and activities to be allocated for Maricopa County HOME projects. The Program Income amounts are $220,077.92 (generated by Maricopa County) and $378,972.28 (generated by the HOME Consortium and allocated for HOME Consortium HOME projects) for a tota l of $599,050.20. (4) Approve the expenditure of $750,000 of previously approved Maricopa County HOME funds that were allocated to other activities to be utilized for FY22-23 program year projects. The HOME Consortium Grant FY22-23 allocation amounts w ill be $5,136,058, $599,050.20 of program income, and $750,000 of prior-year funds for a total of $6,485,108.20. (5) Approve the expenditure of $3,958 of CDBG Program Income funds generated by prior year HUD agreements and activities to be allocated and utilized for FY22-23 program year CDBG projects. (6) Approve the expenditure of $156,874 of CDBG Program Income funds generated by prior year HUD agreements and activities to be allocated and utilized for FY22-23 program year CDBG projects. The Urban County CDBG Grant FY22-23 allocation amount will be $2,836,377, $3,958 of program income, and $156,874 of prior-year funds for a total of $2,997,209. (7) Authorize the Human Services Department Director to submit the referenced plans and sign all documen ts related to the grant funds. Maricopa County is the recipient of annual, reoccurring, non-competitive HUD funding. MARICOPA COUNTY FY/PY 2024-2025 ANNUAL ACTION PLAN FOR HUD FUNDED ACTIVITIES AND RECEIPT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FUNDS Approve the following items regarding the Maricopa County Annual Action Plan (AAP) for the U.S. Department of Housing and Urban Development (HUD) for funded activities for: Community Development Block Grant (CDBG); HOME Investment Partnerships Program (HOME); and Emergency Solutions Grant (ESG) Programs: Approval of this item includes: (1) Approve the submission of the Fiscal Year/Program Year (FY/PY) 2024-2025 Annual Action Plan (AAP) for the HOME Consortium and Urban County, including the HUD Contingency Plan. (2) Approve the acceptance and expenditure of CDBG, HOME, and ESG funding as listed in Attachment A by project. (3) Authorize the Chairman to: a) execute amendments to the AAP and revised Attachment A for project changes or program type as approved in Citizen Participation Plan of the County’s HUD 5-year Consolidated Plan, approved by the Board of Supervisors on May 20, 2020, C-22-20-038-G-00. b) approve the Human Services Department to submit amended AAP and Attachment A to HUD. (5) Approve the receipt of FY/PY 2024-2025 HUD total funds not-to-exceed amount of $8,578,807.00 allocated per program: a) $3,020,680.00 Community Development Block Grant (CDBG) b) $249,288.00 Emergency Solutions Grant (ESG) c) $5,308,839.00 HOME Investment Partnerships Program (HOME) (6) Approve expenditure of CDBG funds in the amount of $3,776,627.00 consisting of the following and listed on Attachment A: a. $3,020,680.00 HUD FY/PY 2024-2025; b. $400,234.00 previously approved funds to be reallocated c. $44,620.00 Program Income d. $311,093.00 previously approved CDBG-CV funds (7) Approve expenditures of ESG funds in the amount of $1,479,704.00 consisting of the following and listed on Attachment A: a) $249,288.00 HUD FY/PY 2024-2025 b) $1,230,416.00 anticipated Department of Economic Security - Housing Support Services. *Formal Board of Supervisors approval to be submitted once IGA is received. (8) Approve expenditures of HOME Funds in the amount of $5,803,839.00 consisting of the following and listed in Attachment A: a. $5,308,839.00 HUD FY/PY 2024-2025; b. $500,000.00 previously approved funds to be reallocated. (9) Authorize the Human Services Department Director to submit the referenced plan and sign all documents related to the grant funds. Receipt of the HUD grant funds will not impact the County General funds. The Human Services Department FY2025 approved provisional indirect cost rate is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The total grant funds are $8,578,807.00 of which $1,112,939 is for salaries and benefits (CDBG $711,734 and HOME $401,205). The total estimated indirect costs and fully recoverable are $247,073 ($158,005 for CDBG funds and $89,068 for HOME). Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of July 1, 2024. The County receives HUD funding allocations on an annual, non-competitive basis. The services provided by the grant funds are not mandated services but are a benefit to County residents by providing funding to communities that improve infrastructure and increase affordable housing. Receipt of the grant funds do not require match funds or future or ongoing contributions at the end of the funding availability period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. Approval of this item shall not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this grant through a future grant reconciliation.
