Commission Recommendation: On 4/6/23, the Commission voted 9-0 to adopt a motion recommending the Board of Supervisors approve Z2022183 subject to conditions ‘a’ – ‘t’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “ Harquahala Generating Station”, consisting of 17 pages, dated March 24, 2023, and stamped received March 24, 2023, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “New Harquahala Generating Company, LLC”, consisting of 6 pages, dated March 10, 2023, and stamped received March 10, 2023, except as modified by the following conditions. c. The following IND-2 IUPD Zoning District standards shall apply: 1. Max. Height: 190’ for existing area of site, 50’ for expansion area including evaporation ponds 2. Parking Spaces Required: 37 spaces including 2 ADA spaces 3. Loading and Unloading Spaces: No loading and unloading spaces required 4. Landscaping: No landscaping setback required 5. Screening: Min. 6’ chain-link fencing along the perimeter of the site, existing fencing associated with the existing site may remain in the existing location 6. Sight Visibility Triangles (SVT): SVT’s waived at project site entry/exit points, section line and midsection line intersecting alignments 7. Article 902.9.1: Evaporation ponds and utility uses associated with the generating station permitted outdoors d. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. 4. The entire area covered by any new development associated with the Plan of Development and its adjacent half-streets’ runoff shall be retained onsite. If portions of adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ runoff shall be retained unless separately addressed by the other jurisdictions. 5. Sufficient retention volume shall be provided onsite to retain the required 100-year, 2-hour runoff from all contributing areas from any new development associated with the Plan of Development. Retention basins with stormwater depths exceeding one foot shall provide one foot of freeboard. 6. All retention basins shall drain within 36 hours per County requirements. e. The IUPD overlay is applied to restrict the use of the site. IND-2 IUPD shall limit the use of the site exclusively to an electric generating facility including ancillary offices, ancillary uses and existing agricultural uses. f. Existing encroachments within the new right-of-way may remain until notified by the Maricopa County Department of Transportation Director. If/when a relocation is required due to a public improvement project; it shall be done so in a timely manner at the owner/developer’s expense. g. Prior to drainage clearance approval, a time limit for any temporary construction lay down areas shall be stated on the Grading and Drainage Plan. h. Interior driveways and parking spaces (both permanent and temporary) shall be surfaced with a form of dust-proofing deemed acceptable by Maricopa County Air Quality Control at the time of zoning clearance. i . Any reporting requirements associated with the Facility shall require reporting data from the original development of the Harquahala Generating Project to present. The conditions of Z2022183 supersede or otherwise retain or modify the prior conditions of approval from prior cases including CPA1999002, Z2000049, Z2001004, Z2001044, Z2002019, Z2002131, Z2003101, Z2006043, Z2009088 and Z2022078. j. Harquahala Generating Facility shall use CAP water as its primary source of water subject to annual availability. k. Harquahala Generating Facility may withdraw groundwater from the Harquahala Irrigation Non-Expansion Area for electrical generation and related uses in an amount not to exceed 62,500 acre feet per ten year period as determined by using a ten-year rolling average commencing upon the date the Harquahala Generating Project originally began withdrawing groundwater in connection with the Project in 2003. Groundwater withdrawal in excess of 62,500 acre feet per 10 years shall require a revised application processed as either a major amendment or modification of conditions and be subject to public hearing and Board of Supervisors approval. l. Harquahala Generating Facility shall site and operate its wells in a manner to prevent “unreasonably increasing damage” as determined by the Arizona Department of Water Resources consistent with A.A.C. R12-15-830, to any well of record with ADWR as of the original date of Board of Supervisors approval of Z2000049. m. The applicant shall submit a written report outlining the status of the development five years from the date of Board of Supervisors approval. The status report shall be reviewed by Staff to determine compliance with conditions of approval and whether the report needs to be reviewed by the Planning and Zoning Commission. The status report shall contain groundwater monitoring reports with annual withdrawals as well as all other annual water use itemized by type and quantity. In addition, a copy of the applicant’s annual CAP allotment shall be submitted. No further status reports will be required if the five year status report is approved by Staff. n. All outdoor lighting shall be designed as recommended by the International Dark-Sky Association and shall be in compliance with Section 1112 of the Maricopa County Zoning Ordinance. o. The owner/developer shall provide to MCDOT an acceptable form of assurance to guarantee repairs and/or reconstruction of the damaged roads during construction and at time of completion. p. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. q. Amendments to the zone change shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance requirements. r. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance, and may be grounds for further action, including zoning revocation, by the Maricopa County Board of Supervisors. s. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. t. The granting of this Zone Change has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of the application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of the application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in the value of the property from the value it held on the date of application due to such revocation. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and changing to the prior land use designation results in the same value of the property as if the Zone Change had never been granted. 12. IGA WITH KYRENE ELEMENTARY SCHOOL DISTRICT TO PARTICIPATE IN THE TEACHER POWERED SCHOOL NETWORK Approve an Intergovernmental Agreement (IGA) with the Kyrene Elementary School District, No. 28 for the purpose of providing participation in the Maricopa County Teacher Powered School Network (“MCTPSN” or “The Network”). The IGA shall become effective upon execution by the last signer and shall expire on September 30, 2024. The MCTPSN is designed to address the recruitment and retention crisis in Arizona through the strengthening of strategies, practices, and structures that have been correlated with low teacher turnover. The Parties agree to cooperate and assist each other as they explore ways to strengthen collaborative practices, elevate teacher voice, and create a regional TPS network. Funding for the MCTPSN is provided by the Arizona Department of Education through an ESSER LEA Capacity Building Support Grant. 13. APPLICATION AND ACCEPTANCE OF FUNDING FROM THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) PROGRAM – INITIATIVE XXXIV Approve Application and Acceptance of up to $740,895 with the Office of National Drug Control Policy (ONDCP) Award Number G24SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The term of this funding is January 1, 2024 to December 31, 2025. This amount represents the total FY 24/25 budget and spending ceiling for this initiative. The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County. The Maricopa County Sheriff’s Office will receive up to $596,086. The Maricopa County Attorney’s Office will receive up to $144,809. The Sheriff’s Office funding award is designated for two separate initiatives: Intelligence Initiative (HIDTAISC): $71,931 and Interdiction Initiative (MCDST): $524,155. The total indirect cost amount for these two initiatives is $73,318.58 ($8,847.51 and $64,471.07). The Sheriff Office indirect rate is 12.30% and MCSO will not recover $73,318.58. The County Attorney’s funding award is designated for the Investigation Initiative (MISTIC) and its indirect rate is 22.35%. The total indirect cost amount for this initiative is $32,364.81 and MCAO will not recover $32,364.81. This funding supports the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 18. APPLY FOR GRANT FUNDS FOR INSTALLATION OF PUBLICLY ACCESSIBLE ELECTRIC VEHICLE CHARGING STATIONS Authorize the Maricopa County Air Quality Department (MCAQD) to apply for the Department of Transportation Federal Highway Administration Charging and Fueling Infrastructure (CFI) Grant. This will provide funds for the installation of publicly accessible electric vehicle charging stations in Maricopa County. MCAQD intends to apply for the full $15 million available. This is a one-time grant award. The cash or in-kind match is 20% of the total project costs ($3,000,000) and indirect costs are fully recoverable, ongoing cash contributions not applicable. Matching costs will be paid by the owner of the facility where the charging station is installed. For County-owned facilities, the 20% match will come from department(s) that utilize the facilities where the charging stations are installed. The grant award is not a mandated function but provides a benefit to the citizens by building public infrastructure for electric vehicle charging. The grant will be awarded as part of a competitive process. Eligible applicants include states, and political subdivisions of states; metropolitan planning organizations; units of local government; special purpose districts or public authorities with a transportation function, including a port authority; and Indian Tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. § 5304)). The expected award date for the grants is in Fiscal Year 2024, with allocation by 2026 and completion by 2031. The total funding is $18,000,000, including the Federal Grant of $15,000,000 and the $3,000,000 match. The Department's FY2024 authorized indirect cost rate at time of application will be 35.34%. All indirect costs are allowable and fully recoverable. Indirect costs will be applied to the County retained, direct cost amount of $11,083,200; recoverable indirect costs are $3,916,800. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. A budget adjustment is not required. This grant application is to obtain Federal funds from the U.S. Department of Transportation, Federal Highway Administration under Notice of Funding Opportunity number 693JJ323NF00004. AMENDMENT TO REVOCABLE LICENSE AGREEMENT WITH CITY OF SCOTTSDALE Approve and execute the Renewal to the Revocable License Agreement (P-50303) between City of Scottsdale (“City” or “Licensor”) and Maricopa County (“County” or “Licensee”). The City owns the property located at 6535 East Osborn Road, Scottsdale, AZ. The County’s Human Services Department utilizes a portion of the property to provide Head Start services. The Amendment extends the license term from June 30, 2023, through June 30, 2024, and allows the Assistant County Manager for Maricopa County and/or the Real Estate Director for Maricopa County to administer this Agreement. Maricopa County, as Licensee, has been at this location for 20 years. This Amendment will modify the terms and term of the Agreement. The term of the renewal will commence July 1, 2023 and expire June 30, 2024. The Licensor shall provide 3,090 square feet of classroom space and additional playground area space for Head Start program activities. Use of the Premises will be weekdays between 7:00 a.m. and 5:00 p.m. during the term. The Use Fee rate will be $7,725.00, plus $3,152 for utility costs per quarter. MARICOPA COUNTY FY/PY 2023-2024 ANNUAL ACTION PLAN FOR HUD FUNDED ACTIVITIES AND RECEIPT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FUNDS Approve the following items regarding the Maricopa County Annual Action Plan for the U.S. Department of Housing and Urban Development (HUD) for funded activities for: Community Development Block Grant (CDBG); HOME Investment Partnerships Program (HOME); and Emergency Solutions Grant (ESG) Programs: Approval of this item includes: (1) Approve the submission of the Fiscal Year/Program Year (FY/PY) 2023-2024 Annual Action Plan (AAP) for the HOME Consortium and Urban County; and acceptance of CDBG, HOME, and ESG funding. HUD notified the County of fund allocations for HUD FY/PY 2023-2024 which begins for the County on July 1, 2023. The AAP activities are based on the HUD allocations and prior year’s un-programed funds as well as the prior year’s program income. Funds will be spent over multiple years per allowable regulations and may be reallocated if necessary and with input through the Citizen Participation Plan as previously approved by the Board of Supervisors. Submittal of an AAP is a HUD requirement. (2) Approve the receipt of FY/PY 2023-2024 HUD total funds in the amount of $8,578,807 allocated per program: • $5,308,839 HOME Investment Partnerships Program (HOME) • $3,020,680 Community Development Block Grant (CDBG) • $249,288 Emergency Solutions Grant (ESG) (3) Approve FY2024 expenditures of HOME Funds in the amount of $5,756,233.30 consisting of the following: a. $5,308,839.00 HUD FY/PY 2023-2024; b. $90,052.30 HOME Consortium Program Income fund generated by Maricopa County activities; c. $357,342.00 FY2018-2019 previously approved Maricopa County HOME funds that were allocated to other activities. AFFILIATION AGREEMENT WITH MADISON SCHOOL DISTRICT FOR DIETETIC INTERNSHIP PROGRAM Approve the Affiliation Agreement with Madison School District #38 to provide clinical nutrition training experience for graduate students in the dietetic internship. The agreement is non-financial, and the term is to be from July 1, 2023 through June 30, 2033. As a part of its established accredited dietetic internship program, the Department of Public Health seeks to provide its dietetic interns with a broad and diverse practicum experience. This agreement with Madison School District will allow dietetic interns to continue to receive approved practicum experience in clinical nutrition. Supervised by MSD registered dietitians in MSD facilities, interns would continue to be responsible to Public Health. This agreement is non-financial and does not affect the County general fund. PURCHASE ORDER FROM ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HEPATITIS C TESTING AND PATIENT NAVIGATION PROGRAM Approve a retroactive purchase order (PO) for Intergovernmental Agreement IGA2020-051 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for Hepatitis C Testing and Patient Navigation. The IGA term is August 01, 2020-July 31, 2025. The not-to-exceed amount is $223,664.000 for the budget period August 01, 2022-July 31, 2023. This is year 3 of this grant and it is not certain whether it will continue beyond the initial five-year term. The award was non-competitive and there is no cash or in-kind match required. This project is not mandated but provides a benefit to County residents through the provision of Hep C services. Should the grant be discontinued, ongoing cash contributions should not be required. The Department of Public Health’s indirect rate for FY23 is 17.24%. Indirect costs are estimated at $32,889.52, which are fully recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 41. AMENDMENT TO ARIZONA DEPARTMENT OF HEALTH SERVICES IGA FOR WOMEN, INFANT AND CHILDREN SERVICES Approve Amendment 11 to Intergovernmental Agreement (IGA) Contract no. CTR04876 between Arizona Department of Health Services (ADHS), Women Infant and Children (WIC) Services and Maricopa County, by and through its Department of Public Health (MCDPH), to provide continued funding for WIC Services, Breast Feeding Peer Counseling Services Program (BFPC), WIC Special Projects. Additional monies have been added to Other Operating Expenses (Local Agency Projects Funding) of $252,066 for Maricopa County for the Hope Center WIC Clinic site that will include costs related to the clinic set up including furniture, cubicle and equipment installation; computer, printer, and internet installation; and data and electrical infrastructure costs. This Amendment has a combined total Price Sheet in the not-to-exceed amount of $10,139,664.00 (WIC - $9,099,160, BFPC - $570,000, WIC Special Projects - $218,438 and Local Agency Projects Funding-$252,066.00). The budget period covers October 1, 2022 through September 30, 2023. The IGA term is from October 1, 2018 through September 30, 2023. The Department of Public Health’s indirect rate for FY23 is 17.24%. Indirect costs are estimated at estimated at $1,338,020 for WIC, $83,818 for BFPCFD, $32,121 for WICSPROJ and $37,066 for LAPF. For a total of $1,491,025 total indirect, all of which is recoverable. Departmental Indirect Rates are reestablished at the beginning of each fiscal year and the future Indirect rate will be collected at the corresponding rates. The WIC services award is reoccurring and has been awarded to the department for many years. This grant does not require match, indirect costs are fully recoverable and ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing food vouchers for approved foods (milk, cheese, cereals, peanut butter, eggs, infant formula, juice, etc.) for low-income pregnant, post-partum, breast-feeding women, infants, and children up to five (5) years of age. Clients also receive nutrition and breast-feeding education and referrals to applicable social services. The grant award is competitive, and there are no costs that will need to be absorbed by the department’s operating budget. The Women, Infants, and Children Supplemental Food Nutrition Education Program (WIC) is funded by the U.S. Department of Agricultural and administered through ADHS. For fiscal year 2022-2023 the Board of Supervisors approved the Department of Transportation capital budget of $129,736,700 with the condition that any movement of budget funds between projects must be approved by the Board. The requested adjustment is necessary to realign project budgets to provide funding to more closely match the year-end projected expenditure amounts . CHANGE ORDER NO. 2 FOR GUADALUPE FRS INTERIM FIX FINAL DESIGN AND POST DESIGN Approve Change Order No. 2 in the amount of $350,000 to the contract that will allow the designer to remain as the engineer of record during the demolition and to write the completion report required by ADWR. The consultant will also assist the District with getting approval from ADWR and NRCS on the final permanent condition for the outlet. Black and Veatch Inc. has prepared plans at the 100% level for the complete demolition of the existing intake structure and its replacement with a gated inlet located on the dam embankment. Those plans have not been approved by either ADWR or NRCS. The gated inlet construction cost is estimated to be over $500,000 for what was to be the interim condition. The District wants to avoid expending those funds without knowing what the approved final long-term solution can be. The Flood Control District is empowered by Arizona Revised Statutes Section (A.R.S.) 48-3603, to enter into this Agreement. The Town of Gilbert is empowered by A.R.S. Section 11-952 as amended, to enter into this Agreement. The Gilbert Storm Water Master Plan (STUDY) will develop a comprehensive Storm Water Master Plan for Gilbert which is designated as a regulated municipal separate sewer system (MS4). The Master Plan will be completed in accordance with applicable statutes and requirements and will focus on storm water including, but not limited to: storm water infrastructure, permit compliance and coordination, floodplain mapping, storm water drainage issues, system resiliency, data evaluation, capital planning, future infrastructure impacts, future rate study planning, compliance with the National Pollution Discharge Elimination System (NPDES) standards, coordination with the Flood Control District of Maricopa County’s upcoming Gilbert Chandler Area Drainage Master Study/Plan Update and will provide a methodology for regular Storm Water Master Plan updates. 66. RESOLUTION FOR THE STAPLEY DRIVE AND BROADWAY ROAD DRAINAGE IMPROVEMENTS PROJECT Adopt Resolution FCD 2023R002 for the Stapley Drive & Broadway Road Drainage Improvements Project (Project), authorizing the Director of the Flood Control District of Maricopa County (District) to include funds for Project implementation in the District’s current and future Five-Year Capital Improvement Program; to negotiate and prepare Intergovernmental Agreements for cost sharing, rights-of-way acquisition, design, construction, construction management and future operation and maintenance of the Project; to advertise, select, negotiate, and award contracts for Project engineering and construction services as appropriate. The Stapley and Broadway Drainage Improvement Project area is located within the City of Mesa (CITY) in the vicinity of the intersection of Stapley Drive and Broadway Road. In 2008, the City of Mesa in conjunction with the Flood Control District of Maricopa County (DISTRICT) completed a Storm Drain Master Plan which identified several storm drain systems within the CITY that were deficient with this area being one of the worst. The construction of this PROJECT will consist of storm drains and other improvements in the vicinity of the intersection of Stapley Drive and Broadway Road to mitigate flooding caused by the 10-year event. In January 2023, the CITY submitted 100% design documents to the District for review. It is anticipated that the estimated cost for this Project is $3,500,000 and the PROJECT cost will be shared between the DISTRICT and the CITY, and the CITY will be the lead agency for the PROJECT. RESOLUTION FOR THE GRAND AND 83RD AVENUE DRAINAGE IMPROVEMENTS PROJECT Adopt Resolution FCD 2023R001 for the Grand & 83rd Avenue Drainage Improvements Project (Project), authorizing the Director of the Flood Control District of Maricopa County (District) to include funds for Project implementation in the District’s current and future Five-Year Capital Improvement Program; to negotiate and prepare Intergovernmental Agreements for cost sharing, rights-of-way acquisition, design, construction, construction management and future operation and maintenance of the Project; to advertise, select, negotiate, and award contracts for Project engineering and construction services as appropriate. The Grand Avenue and 83rd Avenue Drainage Improvement Project area is located in a developed urban area within the City of Peoria (CITY) near 83rd Avenue and Grand Avenue. The project is intended to mitigate excess stormwater runoff that impacts existing residences, businesses, and educational facilities using primarily retention basins and storm drains. The proposed improvements were studied as part of the City of Peoria Storm Drain Master Plan (PSDMP) prepared in January 2014. This study recommended a retention facility located at the intersection of 83rd Avenue and Varney. However, the CITY is unable to obtain the required land at this location. Updating the study, project design, and construction are the next steps for implementing the PSDMP for this area, with the CITY as the lead agency. The estimated cost for this Project is $4,000,000 and the PROJECT cost will be shared between the DISTRICT and the CITY. This Agenda Item impacts Supervisorial District 4. (C-69-23-052-X-00)
