45. AMENDMENT TO THE IGA WITH CITY OF AVONDALE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES Approve Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between the City of Avondale (“City”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the City to provide down payment, closing costs, principal reduction, and other appropriate assistance to eligible first-time homebuyers. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment is to address the following: A. Extend the Agreement termination date from September 30, 2024 through September 30, 2025. B. Add two additional Work Statements: i . Add an additional Work Statement hereinafter referred to as “2021 Work Statement A”, attached and incorporated into the Agreement. The 2021 Work Statement A is for the City to provide single family, owner-occupied housing rehabilitation assistance to qualified low-income households. The County shall provide the City with $179,706 for the 2021 Work Statement A activities. All work performed or costs incurred or expensed shall be reimbursable through September 30, 2024. ii. Add an additional Work Statement hereinafter referred to as “2021 Work Statement B”, attached and incorporated into the Agreement. The 2021 Work Statement B is for the City to provide down payment, closing costs, principal reduction, and other appropriate assistance to eligible first-time homebuyers. The County shall provide the City with $31,590 for the Work Statement B activities. All work performed or costs incurred or expensed shall be reimbursable through September 30, 2025. C. The increase amount for this Agreement is $211,296. The funding for Amendment No. 1 is provided by (Program Year 2021 (PY21)) HOME Investment Partnerships Program (HOME) from the U.S. Department of Housing and Urban Development (HUD) funds, CFDA No. 14.239 D. The Agreement amount shall now be increased to a total not-to-exceed amount of $417,666. E. Revise Section 1 (General Provisions) to address the following paragraphs: 1. Revise Paragraph 51.0 (CONTRACTOR EMPLOYEE WHISTLEBLOWER RIGHTS AND REQUIREMENTS TO INFORM EMPLOYEES OF WHISTLEBLOWER RIGHTS) to address the Whistleblower Rights process. 2. Add Paragraph: 53.0 FORCE MAJEURE F. Revise Section 2 (Special Provisions) to address the following paragraph: 1. Revise Subparagraph 19.1 (ADMINISTRATIVE CHANGE ORDERS) to address the Administrative Change Order process. G. Revise Section 4 (Compensation) to address the following paragraph: 1. Revise Paragraph 3.0 (TIMELINESS) to address the Timeliness process. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. 80. AMENDMENT TO THE IGA WITH CITY OF AVONDALE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES Approve Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) between the City of Avondale (“City”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the City to provide down payment, closing costs, principal reduction, and other appropriate assistance to eligible first-time homebuyers, as well as provide Tenant Based Rental Assistance (TBRA) to help prevent homelessness by providing affordable rental housing for families in need. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment is to address the following: A. Change Lead Agency for Maricopa County. B. Revise Section 1 (General Provisions) to add required Agreement language C. Revise Section 3 (Work Statement) to add two additional Work Statements for Program activities: 1. Add “2023 Work Statement” attached and incorporated into the Agreement: The 2023 Work Statement is for the City to provide down-payment, closing cost, principal reduction, and other appropriate assistance to eligible first-time homebuyers. The County shall provide the City with $214,593 for the Work Statement activities. The funding for Work Statement is provided by PY23 HOME Investment Partnerships Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. All work performed or cost incurred or expensed shall be reimbursable through September 30, 2025. 2. Add “2022 TBRA Work Statement” attached and incorporated into the Agreement: The 2022 TBRA Work Statement is for the City to administer the Tenant Based Rental Assistance (“TBRA”) Program to help prevent homelessness by providing decent and affordable rental housing for families in need. The County shall provide the City with $231,257 for the Work Statement activities. The funding for Work Statement is provided by PY22 HOME Investment Partnerships Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. All work performed or cost incurred expenses shall be reimbursed through September 30, 2025. D. The Agreement funding amount shall now be increased by $445,850 from $417,666 to $863,516 in HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. The Agreement term is April 21, 2021, through September 30, 2025. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment is to address the following: A. Extend the Agreement Termination date from September 30, 2025, through September 30, 2027. B. Update County Lead Agency Representative C. The 2021 Home-ARP Work Statement is for the City to deliver eligible supportive services to qualified residents. The County shall provide the City with $371,794 for the Work Statement activities provided by PY21 HUD HOME Investment Partnerships Program-American Rescue Plan Act (HOME-ARP) funds under ALN 14.239. All work performed or cost incurred or expensed shall be reimbursable through September 30, 2028. C.
