WITTMANN STORAGE Case #: Z2024060 Supervisor District: 4 Applicant & Owners: Bill Dougherty, Viking Development Inc. / Van Pelt Land & Livestock LLC Request: Zone Change from Rural-43 WHSC & C-2 WHSC to C-2 CUPD WHSC with a plan of development Site Location: Generally located NWC of Grand Ave frontage & US Hwy 60 in the Wittmann area Commission Recommendation: On 1/23/25, the Commission voted 4-0 (motion by Commissioner Montoya D5, seconded by Commissioner Curley D3) to adopt a motion recommending the Board of Supervisors approve Z2024060 subject to conditions ‘a’ – ‘h’: a. A Plan of Development is approved subject to site plan entitled “Wittmann Storage” consisting of 1 full-size sheet, dated revised September 3, 2024. The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established CUPD development standards as approved by the Board of Supervisors. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Wittman Storage Narrative”, consisting of 4 pages, dated November 14, 2024, except as modified by the following conditions. c. The CUPD shall limit entitled uses to indoor self-storage facilities and accessory residential caretaker unit. The total number of residential dwelling units (caretaker’s quarters) shall not exceed one (1). d. The following C-2 CUPD standards shall apply: 1. Min. Front yard setback - 5’ 2. Min. Side yard setback – 5’ 3. Min. Street-side yard setback – 5’ 4. Min. Rear yard setback – 5’ Min. Parking - 1:200 sq. ft. of office space – no screening requirements, 1 per dwelling unit, 0 spaces required for self-storage space with garage-door entrance to an internal drive-aisle. 5. Minimum Screening – Chain link e. The following engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 3. Site in a Special Flood Hazard Areas (SFHAs). Disturbance to any floodplain will require a floodplain use permit concurrent with building permit. 4. Finished floors must be set to or above the Regulator Flood Elevation determined by the engineer 5. Applicant to notify ADOT of proposed development through the Red-Letter Process, RedLetter@azdot.gov , due to proximity to US60 6. Driveway access to County Road(s) must be paved and will require a permit from MCDOT issued concurrent with building permit(s) required for site development. Drainage flow along the roadway must be maintained. 7. Storage of materials, walls/fence, parking and storm water retention are prohibited in the right-of-way. 8. Retention basins/underground storage to drain within 36 hours 9. Prior to Building permit issuance, a will serve letter for fire protection services must be provided. f. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. 8. DEANNEXATION FROM THE CITY OF AVONDALE TO MARICOPA COUNTY Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing regarding the de-annexing road right-of-way from City of Avondale jurisdiction to Maricopa County. Right-of-way location: West side of 107th Avenue North of Broadway Road. Supervisory District No.5. The Board of Supervisors determined at a public hearing on February 26, 2025 that such action would be in the public interest and has complied with the additional requirements of A.R.S. § 9-471.03. If approved, the Board of Supervisors: 1. Orders that the public right-of-way be returned as specified in City of Avondale Ordinance No. 2004-0125., returning the public right-of-way to Maricopa County. 2. Pursuant to ARS § 9-471.02, directs the Clerk of the Board to notify the City of Avondale that the Board of Supervisors order regarding the de-annexation of the public right-of-way was approved, and 3. Directs the Clerk of the Board to certify a copy of the order of the Board and file it for record in the Office of the County Recorder. Legal description of the roadway being de-annexed, identified as Exhibit "A", is attached. MCDOT Analysis: This roadway is identified as a principal arterial roadway requiring a 65 ft half street. Current half street right of way is 33 ft the additional 32 ft will complete the required half street right of way. The Board action will result to add 0.0034 square miles to County ownership and enable the County to assume responsibility for road maintenance. Financial Status: Cost of the roadway development falls to the developer with no initial cost to Maricopa County. Cost of maintenance moving forward is typical of roadway maintenance cost and will be the responsibility of Maricopa County. The cost of roadway maintenance provides a benefit to the traveling public. (C-06-25-286-X-02)

RESOLUTION APPROVING THE SUBMISSION OF PROJECTS FOR CONSIDERATION IN ARIZONA’S 2026 GOVERNOR'S OFFICE OF HIGHWAY SAFETY PLAN Adopt a Resolution approving the application and acceptance of up to $646,320 in reimbursable grant funding from the Governor’s Office of Highway Safety (GOHS). This pass-through federal funding will be used for overtime, training and equipment to accomplish projects related to highway safety. This resolution for Maricopa County specifically authorizes the filing and acceptance of grant funding from the priority Program areas: 1) a. Impaired Driving (DUI Enforcement; Underage Drinking Enforcement; Officer Training for Recognizing Impairment) $372,457; and b. Impaired Driving (Warrant Details) $51,000; 2) Accident Investigation, $95,048; and 3) Police Traffic Services (Aggressive Driver Education and Enforcement, Speed Related Patrol Enforcement, School Speed Zone and Construction Zone Enforcement and Buckle Up AZ Enforcement) $127,815. The anticipated term of the funding is October 1, 2025, through September 30, 2026. The Sheriff’s Office has received this funding for approximately 22 years. It is competitive, and recurring. There is no match requirement. This funding does not allow indirect cost recovery. The Sheriff’s Office indirect cost rate for FY2025 is 26.71%. This funding is earmarked primarily for overtime expense, training and the purchase of program related equipment. There are no capital equipment purchases, for an indirect cost base of $646,320 and estimated unrecoverable indirect costs of $172,632. There are no future or ongoing contributions required after the grant ends. This funding supports and enhances the Sheriff’s Office public safety mandate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. AGREEMENT WITH THE DRUG ENFORCEMENT ADMINISTRATION FOR ORGANIZED CRIME DRUG ENFORCEMENT TASK FORCES (OCDETF) - FFY2025 Retroactively approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug Enforcement Administration, Organized Crime Drug Enforcement Task Force (OCDETF) Investigative/Strategic Initiative # MN-23-0047/SWAZ-0972 in the amount of $382,374.87 for the award period beginning October 1, 2024, and terminating on September 30, 2025. This Agreement may be terminated by any of the parties by written notice to the other parties ten (10) business days prior to termination. The funding award is recurring and has been awarded to the Sheriff’s Office the past thirteen (13) years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY25 is 26.71%, applicable to the award amount of $382,374.87 less capital expenses of $5,245.49 for an indirect cost base of $377,129.38 and indirect costs of $100,731.26 which will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends; however, property (items) purchased with these funds must remain available to the Strike Force/Strategic Initiative for the duration of its existence. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in Maricopa County and the State of Arizona resulting in a more safe and secure community. This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. This is reimbursement funding that will be used to purchase capital and non-capital equipment; to maintain &/or repair previously purchased equipment; to secure subscriptions for technical service; to pay monthly data charges relating to several types of equipment; and to secure contracted analyst service. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. SUPPLEMENT #5 TO THE AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) – INITIATIVE XXXIII Approve Supplement #5 to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G23SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The amount of supplement #5 is $4,764.41, decreasing the amount from $630,967.67 to $626,203.26. The term of this funding is unchanged, January 1, 2023, to December 31, 2024. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. The MCSO indirect cost rate for FY25 is 26.71%. There are no unrecoverable indirect costs associated with this decrease in funding. This award was initially accepted in BOS action C-50-22-169-X-00 on June 8, 2022. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 23. MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD RECERTIFICATION Approve documents necessary for recertification of the Maricopa County Workforce Development Board (MCWDB). Documents will be submitted to the Arizona Office of Economic Opportunity (OEO) for the Program Years (PYs) 2024-2025 as required by the Workforce Innovation and Opportunity Act (WIOA). The Board of Supervisors authorizes and approves certification of the following: 1. MCWDB recertification submission requirements for program years 2024 and 2025 to Arizona Office of Economic Opportunity (OEO). 2. MCWDB recertification submission requirements for program years 2024 and 2025 (Exhibit1200A) to OEO. 3. Board of Supervisors Chair to sign recertification (Exhibit1200A). All documents received legal review prior to processing for signatures and will be filed with the Clerk of the Board’s office. The Maricopa County Workforce Development Board Recertification request serves as formal notification to the Governor, Workforce Arizona Council, and Arizona Department of Economic Security (DES) of the County‘s request for Recertification for the PY 2024-2025. The MCWDB is established and receives its authority in accordance with the Workforce Innovation and Opportunity Act (WIOA), which was signed into law on July 22, 2014 as Public Law 113-128. Documents will be submitted to the Arizona Office of Economic Opportunity (OEO) for the Program Years (PYs) 2024-2025 as required by the Workforce Innovation and Opportunity Act (WIOA). The Board of Supervisors authorizes and approves certification of the following: 1. BANFIELD FOUNDATION PREVENTIVE CARE GRANT AGREEMENT AND BUDGET ADJUSTMENT Approve the application and acceptance of grant funds from Banfield Foundation Agreement (the “Agreement”) in the amount not-to-exceed $3,590. The grant provides funding to cover the cost of sponsored dog licensing for veterans at the upcoming Maricopa County Veteran StandDown event. The grant award begins upon execution and ends on April 30, 2025. Authorize the Chairman to sign the Agreement and authorize the Animal Care and Control appointed authority and/or designee to sign other grant-related documents, such as reporting requirements, etc., as applicable to administer the grant. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) by $3,590 in Fiscal Year 2025. The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of Finance has calculated the Fiscal Year 2025 indirect cost rate at 12.28% or $441. The recoverable cost rates for administering this grant are $0 and the Animal Care and Control will absorb the non-recoverable indirect cost of $441 into the department’s operating budget in the current fiscal year. This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditure of the funds is not prohibited by the budget law. The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Funding for this agreement is provided by a Grant from Banfield Foundation and was competitively bid. The grant cannot be used in any way that decreases the allocation or budget of governmental funds for animal welfare purposes. AMENDMENT TO LICENSE AGREEMENT FOR USE OF REAL PROPERTY WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY Approve and execute Amendment No. 11 to License Agreement for Use of Real Property between Maricopa County (Licensor) and Arizona Department of Economic Security (Licensee) for the use of County controlled facilities located at West Valley One Stop Career Center at 4425 W Olive Ave, Glendale, AZ also identified as “Facility 3” and East Valley One Stop Career Center located at 1001 W Southern Ave, Mesa, AZ also identified as “Facility 4”. Licensee shall provide County with base rent and shared operation costs associated with the operations of the facilities. The License Agreement Expiration date is June 30,2026. The purpose of this Amendment No. 11 is to address the following: A. Revise Section 4.0 (TERM), by deleting it in its entirety and replacing it with updated language regarding renewal by adding 4.1 option to enter into a new agreement. B. Revise Section 12.0 (FACILITY WORKSPACE AND COMMON AREA), by replacing it with updated Facility Workspace and Common area as reduced Square Footage (SF) for Licensee Facility 3 and Facility 4: C. Revise Section 13.0 (SHARED FACILITIES OPERATION COSTS) by deleting subsections 13.3 and 13.4 in their entirety and replacing with language outlining DES reduced shared Operating Costs as follows: 13.3 Facility 3: Commencing January 1, 2025, through June 30, 2025, Licensee shall pay a monthly amount of $3,204.50 for base rent and $147.00 annually for shared operations costs. From July 1, 2025, through June 30, 2026, Licensee shall pay an amount of $3,286.67 for base rent and $147.00 annually for shared operation costs. 13.4 Facility 4: Commencing January 1, 2025, through June 30, 2025, Licensee shall pay $3,421.63 for base rent and $82.00 annually for shared operations costs. From July 1, 2025, through June 30, 2026, Licensee shall pay an amount of $3,421.63 for base rent and $82.00 annually for shared operations costs. D. Update Point of Contact for Licensee. E. Replace Exhibits “1A” & “1B” in the Agreement with revised Floor plans F. Replace Exhibit “3” (FACILITY SPACE AND RENT COSTS), by deleting in its entirety and replacing with updated Costs Exhibit as reduced. G. Replace Exhibit “4” (DES SPACE ALLOCATION), by deleting in its entirety and replacing with updated Space Allocation Exhibit as reduced. Funds received under this Agreement are not considered revenue as the Federal Workforce Innovation and Opportunity Act (WIOA). WIOA, Section 121(c) and (h) requires the development of Agreements with partners located in the One-Stop Career Centers. Agencies co-located in the One-Stop Career Centers must pay for their proportionate share of costs for the operation of the Career Centers. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of the funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. This Agreement does not contain County General funds. APPROVAL TO SUBMIT REQUEST FOR YEAR 5 CONTINUATION FUNDING FOR HEAD START/EARLY HEAD START FY2026 PROGRAM ACTIVITIES Request approval for the Maricopa County Head Start program to submit the request for its 5th Year continuation funding to the U.S. Department of Health and Human (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), for the Grant No. 09CH012079. The Grant funding continuation application is for Fiscal Year 2026 (FY26) Head Start/Early Head Start program performance. The continuation application for the FY26 Budget Period is due on April 1, 2025. The Grant continuation funding available is $22,323,586 and the period of funding availability is July 1, 2025, through June 30, 2026 (“budget period”). The Office of Head Start awarded Maricopa County with Grant No. 09CH012079 for Head Start/Early Head Start program for the Project Period of July 1, 2021, through June 30, 2026 (FY21-FY26). The County is a current recipient of the stated Grant, and the application is for the non-competitive continuation of Year 5 of the Project Period, FY21 through FY26. Also request authorization for the Chairman to sign documents related to this Grant funding continuation application. The Office of Head Start requires the Maricopa County Board of Supervisors Chairman to sign all grant applications, applications for continuation funds, as well as amendments and budget revisions to the Grant. Amendments are required if the program needs to transfer funds between budget line items in an aggregate amount of $250,000 or more. The Maricopa County Human Services Department administers the Head Start/Early Head Start programs. The Head Start Program goals are: 1. Better physical, cognitive, and social and emotional development in children 2. Improved Parent and Child Interactions that lead to increased family well-being 3. Increase Parent Self-Reliance and Empowerment to aid families’ economic independence and productivity 4. Expand and Improve the Quality of the Early Childhood Workforce The Grant requires a 20% non-federal share (NFS) match of the total approved project costs. The total required NFS for FY2026 is $5,580,896 for the budget period of July 1, 2025, through June 30, 2026. NFS is generated through in-kind donations of goods and services as well as parent volunteering. The services provided under this grant are not a mandated function but provide a benefit to the citizens by providing eligible children with high quality care and education by integrating Head Start performance measures. The purpose of the Maricopa County Head Start Zero-Five Program is to promote school readiness by educating children and supporting families. Head Start services are provided by Maricopa County and Childcare Providers procured under Serial No. 220226. Once notified of funding continuation award by OHS, the Human Services Department will request approval for the acceptance of funds from the Board of Supervisors in a separate future agenda item. The rescind action is necessary due to ADES issuing a new DSA requesting four sections be revised in the new Agreement. Replace item C-86-25-039-X-00 with a new ADES Data Sharing Agreement with ADES for Legal Refugee Resettlement Programs which allows for eligible verification of legal consumers, enrollment into RRP funded services, and the completion of mandated federal reporting. All data shall be transmitted solely through the Arizona Refugee Resettlement Program Online Data System (ARRPODS). The overall purpose of this grant is to annually increase the number of Registered Dietitian Nutrition in the Arizona WIC Program to continue to improve nutrition services for eligible families. The not-to-exceed amount is $186,726.42 per year. The term of the contract is October 01, 2024, through September 30, 2029. This is a new IGA with a new five-year term; however, it is not the first time the grant has been awarded to MCDPH. It is unknown if the grant will be awarded in the future after the term date end. This is a non-competitive grant and there is no cash or in-kind match required. Additionally, this is not a mandated service but does provide a valuable service to the community. The Department of Health’s indirect rate for FY25 is 15.79%. Indirect costs are estimated at $25,463.43, all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. ACCEPT END CUSTOMER INVESTMENT FUNDS FOR MICROSOFT TEAMS PHONE MIGRATION Authorize and digitally sign the acceptance of $246,390 in End Customer Investment Funds (ECIF) from Microsoft to support Maricopa County’s migration to Microsoft Teams Phone. These funds are a project contribution and are not subject to reimbursement if the County completes services in accordance with the agreement. These funds will be paid directly from Microsoft to ANM (Advanced Network Management), a trusted Microsoft partner and County contracted vendor, after County signoff of the completion of services, to provide professional services for the migration effort for all County departments currently on the Avaya phone system. MOU TO PROVIDE VOLUNTARY SOUTH PHOENIX HEALTHY START SERVICES TO THE GLENDALE ELEMENTARY SCHOOL DISTRICT Approve a Memorandum of Understanding (MOU) between Maricopa County, on behalf of its Department of Public Health ("Provider"), and Glendale Elementary School District ("District"). The purpose of this MOU is to formalize the partnership that allows the Provider to deliver South Phoenix Healthy Start (SPHS) services. These voluntary services are provided to students and families that meet the program criteria and have parental/guardian consent. Services include: maternal health education, doula support, and father engagement programs to eligible students, their families, district staff, and the community. The agreement ensures that the District will provide the necessary space and facilitate access to students while maintaining confidentiality and adhering to parental consent requirements. The MOU further outlines the responsibilities of both parties. The District agrees to provide a confidential meeting space, identify eligible students, and support their participation without academic penalties. The Provider agrees to deliver services at no cost to the District, offer multilingual support as needed, and report non-confidential participation metrics. Both parties must comply with federal and state regulations, including confidentiality standards under FERPA and HIPAA, and the agreement specifies that the Provider must notify the District if service delivery becomes unsustainable. The agreement is effective from March 1, 2025, through March 1, 2027, with automatic renewal unless terminated. Either party may terminate the agreement with a 30-calendar-day written notice sent by certified mail. (C-86-25-051-X-00)
