68. IGA WITH THE CITY OF PEORIA FOR HOME FUNDED ACTIVITIES Approve a financial Agreement (“Agreement”) between the City of Peoria and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the acquisition and rehabilitation of two (2) single-family houses in Peoria, one single-family home for Program Year 2020 and one single-family home for Program Year 2021. The completed homes will be sold to eligible low-income homebuyers. The County will provide the City with U. S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME)) funds in the amount not-to-exceed $235,817 for Program Year 2020 and U. S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME)) funds in the amount not-to-exceed $232,061 for Program Year 2021. Agreement term shall begin December 12, 2021 and will expire September 30, 2025. Per Section 2 (Special Provisions), Paragraph 20.0 (General Conditions), Subparagraph 20.1 (Administrative Change Orders) request authorization for the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the CHDO. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. 76. AMENDMENT TO IGA WITH THE CITY OF PEORIA FOR HOME FUNDED ACTIVITIES Approve Amendment No. 1 to the financial Intergovernmental Agreement (“Agreement”) between the City of Peoria and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to create first-time homebuyer opportunities for low- to moderate-income families in Peoria. The City shall acquire and rehabilitation single family homes for eligible low-income homebuyers to purchase. Through Amendment No. 1, The City shall acquire and rehabilitate two (2) single-family houses for two (2) low-income, first-time homebuyers to purchase. If the City has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. The County shall provide the City with $275,546 in PY22 HOME Investment Partnerships Program (HOME) funds through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. The City shall contribute $5,000 of Program Income towards Work Statement activities. 34. AMENDMENT TO IGA WITH THE CITY OF PEORIA FOR HOME FUNDED ACTIVITIES Approve financial Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) between the City of Peoria (“City”) and Maricopa County, administered by its Human Services Department. The purpose of the Agreement is for the City to create homebuyer opportunities for low-to moderate income homebuyers in the city of Peoria. The County and the City may be referred to individually as the “Party” and collectively referred to as the “Parties”. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. Through this Amendment No. 2, the City shall acquire and rehabilitate two (2) scattered-site, single-family houses to be sold to eligible low-to-moderate income homebuyers in the City. Amendment No. 2 addresses the following: A. Extend the Agreement termination date from September 30, 2025, through September 30, 2026. B. Revise Section 3 (Work Statement) to address the following paragraphs: 1. Add an additional Work Statement hereinafter referred to as “2023 Work Statement”, attached and incorporated into the Agreement. The 2023 Work Statement is for the City to acquire and rehabilitate two (2) single-family houses in the City of Peoria. This project is a scattered-site single-family homeownership project. Expenditures for this Work Statement and all work performed, or costs incurred shall be reimbursable through September 30, 2026. The County shall provide the City with $297,476 for the Work Statement activities. The funding for Work Statement is provided by PY23 HOME Investment Partnerships Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. C. Under the Amended Agreement, County funding shall therefor be increased from $743,424 to $1,040,900 in total HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement and previously approved Amendment shall remain unchanged and in full force and effect. The City, through three projects, shall develop and or acquire and rehabilitate six separate single-family homes in the City of Peoria as scatter-site single-family homeownership projects. The County provided the City with U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME) funds in the amount of $1,040,900 in total Agreement funding under ALN. 14.239. The Agreement term is December 12, 2021, through September 30, 2026. The County and the City may be referred to individually as the “Party” and collectively referred to as the “Parties”. The purpose of Amendment No. 3 is to address the following: A. Extend the Agreement termination date through September 30, 2027. B. Revise County Lead Agency Representative. C. Revise Section 1 (GENERAL PROVISIONS), Paragraph 11 (Budget Adjustments) and replace Subparagraphs 11.1 and 11.2 D. Revise Section 1 (GENERAL PROVISIONS), Paragraph 12 (Disputes) and replace Subparagraph 12.2 E. Add required provisions to the Agreement: F. Revise Section 2 (SPECIAL PROVISIONS) and replace first paragraph, STANDARDS. G. Revise Section 2 (SPECIAL PROVISIONS), and replace Paragraph 1.0 (Compliance With Laws, Rules & Regulations H. Revise Section 2 (SPECIAL PROVISIONS), Paragraph 15 (Subcontracts and Vendors) and replace 15.2 to update with UEI number provision I. Add an additional Work Statement hereinafter referred to as “PY24 Work Statement A-Acquisition and Rehab for Homebuyers” attached and incorporated into the Agreement. The County shall provide the City with $130,599 for the Work Statement activities provided to the County by HUD PY24 HOME Investment Partnership Program (HOME) funds through the US. Department of Housing and Urban Development (HUD) under ALN 14.239. All work performed or costs incurred shall be reimbursable through September 30, 2027. 4. Add an additional Work Statement hereinafter referred to as “PY24 Work Statement B- Acquisition and New Construction for Homebuyers” attached and incorporated into the Agreement. The County shall provide the City with $136,707 for the Work Statement activities provided to the County by HUD PY24 HOME funds through the US. Department of Housing and Urban Development (HUD) under ALN 14.239. All work performed or costs incurred shall be reimbursable through September 30, 2027. K. The Agreement total funding amount shall be increased by $267,306 in PY24 HOME funds, from $1,040,900, for new Agreement total funding in the amount of $1,308,206. AMENDMENT TO IGA WITH CITY OF PEORIA FOR HOME FUNDED ACTIVITIES Approve Amendment No. 4 to the Intergovernmental Agreement (IGA) between the City of Peoria and Maricopa County by and through its Human Services Department (HSD) to provide grant funding for HOME Investment Partnerships Program (HOME) activities. The purpose of the Agreement is for the City to create homebuyer opportunities for eligible low-to moderate income homebuyers in the City of Peoria. The City, through separate projects, shall develop and or acquire and rehabilitate separate single-family homes in the City of Peoria as scatter-site single-family homeownership projects. The County provided the City with U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME) funds under ALN. 14.239. The Agreement term is December 12, 2021, through September 30, 2027. The above-named IGA is amended as follows in attached Amendment No. 4 to the Agreement: A. Add $270,017 in PY2025 HOME funding for a new Agreement total of $1,578,223. B. Extend Agreement termination from 9/30/2027 to 9/30/2028. C. Revise Section 1 (General Provisions) as follows: 1. Paragraph 49 (Certification Regarding Debarment, Suspension, Ineligibility, And Voluntary Exclusion). 2.
