39. IGA WITH THE CITY OF AVONDALE FOR AFFORDABLE HOUSING OPPORTUNITIES Approve a financial Intergovernmental Agreement between the City of Avondale (“Subrecipient”) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is to expand availability of affordable housing for homebuyers in the Avondale area. Through two projects, the Subrecipient will develop 8 single family homes. Two of the homes will be sold to households with income at or below 80% of the Area Median Income and 6 of the homes will be sold to households at or below 120% of the Area Median Income. The County shall provide the Subrecipient with $2,750,000 in American Rescue Plan Act (ARPA) Funds under the Assistance Listing Number 21.027. The Agreement is effective beginning September 13, 2023, through December 31, 2025. Also request authorization for the Chairman to approve and execute Administrative Change Orders upon the recommendation of the Human Services Director and Legal Counsel as identified in Section 5.0 (Administrative Change Orders). AMENDMENT TO IGA WITH CITY OF AVONDALE FOR AFFORDABLE HOUSING OPPORTUNITIES Approve non-financial Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between the City of Avondale (“City” or “Subrecipient”) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is to expand availability of affordable housing in the Avondale area. The County provided Avondale with $2,750,000 in American Rescue Plan Act (ARPA) funds under the Assistance Listing Number 21.027 in order to develop and construct homes to be sold to low-income homebuyers. Avondale will partner with an eligible subrecipient or developer to construct the homes. The term of the Agreement is September 13, 2023, through December 31, 2025. The purpose of Amendment No. 1 is to address the following: A. Revise Paragraph 9.0 (Compensation), Subparagraph 9.1 to add language related to the use of ARPA funds and Developer Fees. B. Revise Exhibit A Statement of Work to update language and budgets. C. Revise Exhibit B Statement of Work to update language and budgets. D. The County provided funds remain unchanged at $2,750,000. The County provided the City with $2,750,000 in American Rescue Plan Act (ARPA) State and Local fiscal Recovery Funds (SLFRF) funds under the Assistance Listing Number 21.027, in order to develop and construct homes to be sold to low-income homebuyers. The City will partner with an eligible subrecipient or developer to construct the homes. The term of the Agreement is September 13, 2023, through December 31, 2025. The purpose of Amendment No. 2 is to address the following: A. Extend the Agreement term from December 31, 2025, through December 31, 2026. B. Update Agreement required language. The County provided the City with $2,750,000 in American Rescue Plan Act (ARPA) State and Local fiscal Recovery Funds (SLFRF) funds under the Assistance Listing Number 21.027 for the Work Statement activities. The City will partner with an eligible Subrecipient or Developer to construct the homes. The term of the Agreement is September 13, 2023, through December 31, 2026. The purpose of Amendment No. 3 is to address the following: A. Incorporate Federal Award Identification Number (FAIN) and Award Date into the Agreement. B. Add required Agreement language. C. Revise Exhibit B (Avondale Infill Housing Program Statement of Work) and replace Paragraph 3.4 (Program Income). This Amendment shall be effective upon approval and signature by both Parties.
